HomeMy Public PortalAboutOrd. 0038Ordinance No _ b_ An Ordinance of the Board of Trustees of the City of Lynwood, Cal., approving the Annexation to the said City of Lynwood of "Addition No 4. Whereas the Board of Trustees of the City of Lynwood on the ,30th day, of April 1924, received a waitten petition signed by not less than one - fourth (i) of the qualified electors residing in the territory described therein (and hereinafter described) as shown by the registra- tion of voters of the County of Los Angeles, being the Counts* in which such territory is situated, which said petition contained a description of certain now territory proposed to be annexed to the City of Lynwood, and asked that such territory be annexed to, incorporated in and i:iade a part of the said City of Lynwood; and whereas the said petition contained a request that the question be submitted'to the electors residing in the said territory, as hereinafter set forth, and Whereas the said Board of Trustees immediately after the re- ceipt of the said petition and on the 30th day of April, 1924, did by its Resolution No. 177 on file in the office of the City Clerk of the City of Lynwood order that a Special Election be held in the territory so proposed to be annexed on the 31st day of May, 1924; and that notice of such Spec- ial Election be given by the publication of a Notice thereof in "The.New Compton," the same being a newspaper of geheral circulation printed and published outside of the City of Lynwood but in the County of Los Angeles, at least once a week for a period of five successive weeks next preceding the date of such election, the said Notice being set forth.substantially in said Resolution, and Whereas the said petition requested, and the said Notice spec- ified, that the said election be called and held in pursuance of the pro- visions of the Act of the Legislature of the State of California entitl.od. "An Act to provide for the Alteration of the Boundaries of and for the An- nexation Territory to TAinicipal- Corporations, for the Incorporation of - - such Annexed Territory in and as a part thereof, and for the Districting, Government and Municipal Control of such Annexed Terr.itory," approved June 11th, 1913; and all amendments thereof, and Whereas the said Notice set forth in detail all matters required by law, including the date of such election, the proposal required to be submitted, a specific description of the boundaries of the territory proposed to be annexed and a designation of said territory as "Addition No. 4 to the City of Lynwood," and whereas pursuant to the proceedings hereinafter indmcated and in accordance with the provisions of the said Act of the Legislature of the State of California, and all amendments thereof, a Special Election was held in the territory in said petition and hereinafter described and designated as "Addition No. 4 to the City of Lynwood," on the 31st day of A4ay, 1924; at which election there was submitted to such electors the said proposition, and Whereas notice of such election was given by publication in the time, form and manner required by said Act, as appears from the affida- vit of publication on file with the City Clerk of the City of Lynwood, and Whereas it appears that the said Special Election was duly X called and held pursuant to said Notice and in accordance with.law on the 31st day of May, 1924; that the polls for said election were kept open dur- ing.the time required by law and in accordance with the said Notice and that the said Special Election was held and conducted and votes thereof received and canvassed and the result thereof determined and declared in the time, form farm- and manner required by law, and Whereas the said Board of Trustees did on the 4th day of June, 1924, being the'time provided for, its regular meeting next after the ex- piration of three days from and after the date of said election, meet and canvass the returns of the said Special Election as required by law, where- upon the result of the said canvass having been found to be as hereinafter stated, and entered upon the Minutes, Now Therefore The Board of Trustees of the City of Lynwood does ordain as follows, to -wit: _.- -; Section 1: That the new territory proposed to be annexed to the City of Lynwood, as aforesaid, is particularly described as follows, to -wits Beginning at the most easterly corner of Block 15 of Belle -Ver- non Acres, as'shown on map recorded in Book 9, Page 196, of Maps, records of Los Angeles County, being a point'in the westerly boundary line of the City of "Lynwood as'it existed April 24, 1924; thence northwesterly along the north - easterly line of said Belle- Vernon Acres to the westerly line of Belle- Vernon,. Boulevard (formerly named Long Beach Boulevard,) as shown on the aforesaid man of Belle- Vernon Acres; thence southerly along the westerly line of said Belle= Vernon Boulevard to the westerly prolongation of the - southerly line of Lot,4,.Block 12, of said Belle- Vernon Acres; thence easterly along said pro- longation "and southerly line'to the southeast corner of said Lot 4; thence easterly in a•direct line to the southwest corner -of Lot 9,of, said Block 12; thence easterly in a direct line to the southeast corner 'of Lot 21 of said Block 12; thence northerly along the easterly line of said Block 12 to the southwest corner of the City of Lynwood, as it existed.April 24th, 1924; thence northerly along the westerly boundary line of said City of Lynwood to the point of beginning. ✓ Section 2: That there was but one election precinct established and provided for -the holding of said Special, "Electio "n,'•the boundaries of which were, and are, the.boundaries of the said territory. Section 3: • That the proposition voted on in said Special Elec- tion was whether said described territory should be 'annexed to the City of Lynwood; and that the whole number of votes cast on said proposition at said Special Election on May 31st, 1924, was Fifty -Nine (59) votes; and that the number of votes cast at such election in favor of said proposition was Thirty (30) votes, and the number of votes cast against the came was Twenty -Nine (29) And whereas.it appears from the canvas3 of the returns of the said election so held in said territory on said proposition are in favor of said annexation. It is further ordained that the annexation of the said territory to the City of Lynwood is hereby approved; and the said territory is hereby declared to be annexed to, incorporated in and made a part of the City of Lynwood. And it is hereby, ordered that a copy of 'this Ordinance, giving the date of its passage, under the seal of the City of jynvrood, be submitted to and filed with the Secretary of State of the State of California. From and after the date of which filing the annexation of such territory shall be deemed to be complete, and thenceforth the -said annexed territory shall be to all intents and purposes a part of the City of Lynwood. _ Passed and approved this _/_L -day of June, 1924..
