HomeMy Public PortalAboutOrd. 0077ORDINANCE NO. 77 AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE CITY OF LYIB70OD', FIXING MATER RATES AND OTHER CHARGES IN THE ?'LATER DEPARTIaENT OF SAID CITY OF LYNWOOD AND APvIENDING AND ANNULLING CERTAIN PORTIONS OF CERTAIN ORDINANCES. The Board of Trustees of the City of Lynwood does ordain as follows: Section 1. All of Ordinance No. 52 is hereby annulled. Section 2. All of Section 5 of Ordinance No. 5 is hereby annulled. ad Section 2 (a). That portion of Section 7, Ordinance No. 5, reading as follows: "For 2,500 cu, ft., or less, of water used per month, $1.50. For all water used in excess of 2,500 cu, ft., per month, for each 100 cu, ft., 5 cents," is hereby annulled. Section 3. That portion of Section 8, Ordinance 5, reading as folloris: "If not paid on or before the fifteenth of the month in which the water is used, a penalty of 25 cents shall be added to the charge for water used for such month," is . hereby annulled.. Section 4. All of Section 12, Ordinance No. 5, is hereby annulled. Section 5. The water rates for all water furnished from the ?Municipal dater System of the City of Lynwood are hereby fixed and established for water used each month as follows: . For each private dwelling house occupied by only one family and including water for all ordinary domestic purposes, and for use on one lot not to exceed 15,000 square feet in area, p1.50. For each additional residence upon 'the same lot, under the same ownership, where service is furnished upon application and the owner pays all bills,. -$.75. . For any group of residences on one or more lots adjoining and owne% by one person or firm and commonly called a court, tho water rate shall be as follows: The first such house shall be charged for each month X1.50. The next t =.;o or more such houses shall be charged for each month each 1.50. The above rates for courts shall be charged each month without regard as to whether such houses arc occupied or not. For the irrigation of each additional 10,000 square feet or any part thereof, in excess of 15,000 square feet of lot or yard, and for lot or yard when not in conjunction with use of water in dwelling house, - the c'-)arge shall be for each month from May lst to Nov. lst, or untilothe use of such water for irrigation purposes is discontinued, $.75. For each store, shop and separate place of business equipped with plumbing and facilities for the use of water, other than a public garage or auto repair shop, the charge shall be'$1.25. For every public garage or auto repair shop the charge shall be $1.75. . For every public school or the irrigation of grounds adjacent thereto, the charge shall be at the rate of lz cents per student per month, the same to be computed to the nearest 50 students in number. This computation to be made at the beginning of the month following the beginning of each school semester. Section 6. Where the Board of Trustees have deemed it necessary to install a meter under the provisions of Section 7, Ordinance No. 5, the rate shall be as follows: For 1,000 cu. ft. or less of water the rate for each month shall be 41.50. For all water used in excess of 1,000 cu. £t. per month the rate for each 100 cu, ft. shall be $.10. Section 7. All bills for water used except when metered shall be due and payable in advance at the City Hall on the first day of each and every month in which water is used. If paid on or before the 20th day of the month in which said bill for water is due, a rebate of $.25 shall be allowed on each such bill providing said bill is not less than $1.25. Section 8. No person shall be entitled to a water connection or to water service until the owner of the premises or his duly authorized agent shall make application for same and deposit with the Water Clerk the necessary fee for same. The amount of this fee shall be as follows: For inch tap or'under, "$10.00 (ten For each 1 tap, 12.50 (twelve Dollars and fifty cents.) For each lz inch tap, 15.00 (fifteen dollars). For each 2 inch tap, $20.00 (Twenty dollars). Section 9. 1`11,ere one or more Lots adjoining are Re- Subdivided ard water connections aT,)nl9.ed for by the Subdividor, the Sub- di -vidor shall be required to have installed and pay for a tap of suitable size to supply each lot, under such sub- division with a 3/4 inch supply. The Sub - divid'or shall be required to install piping to each lot of such He- Sub - Division of suitable size and provide a shut off for each lot, which shall become the property of the City of Lynwood and shall be installed under the supervision of the Water Superintendent. Section 10. For every water service or water connection not herein specified, the rate per month shall be $1.50. Section 11. If any section, subsections, sentence, clause or phrase of this Ordinance-is for any reason held to, -be un- constitutional, in violation of law, or inoperative, such decision shall not affect the validity of the remaining portion of this Ordinance. The Board of Trustees of the City of Lynwood hereby declare that it would have passed this Odinar_ce, and each section, sub - section, sectence, clause and phrase thereof irrespective of the fact that any one or more sections, sub- sections, sentences, clauses or phrases be declared un- constitutional, in violation of the law, or inoperative. C Section 12. This Ordinance is urgently required as an immediate public necessity and the City Clerk shall certify to its passage by at least a three - fifths vote of the City Trustees and cause it to be published once in the Lynwood Tribune, and it shall take effect and be in force on and after the first day of March, 1927.
