Dear Ms. Schectman and Board,
I sent you an email on February 5, that you still have not responded to.
The purpose of that email was to continue our negotiations to resolve the five year old controversies regarding
CEQA, the Russian Ridge preserve and the CAL FIRE five burns that have done a cumulative $20 million in
damages to the rare and endangered wildflower and native grass natural resources at that preserve, over the
past 14 years.
Since you have not replied in six weeks, a reasonable person would assume that instead of resolving these issues
ourselves, you and the Board want these controversies decided by a San Mateo County Superior Court judge?
I love taking a government agency to court on an environmental issue and winning, like the 1985 Felton case that
I organized and Vic Sher argued in Santa Cruz County vs. the State of California on the gypsy moth pesticide
spraying issue in Felton.
There is a good chance that your District could lose if we were to go to court about Russian Ridge, just like the
State did in the Felton case, because you have not given me a single legal reason why everything that 1 am
saying--that the five Russian Ridge fires were illegal under CEQA, and resulted in $20 million in damages to the
natural resource--is not 100% correct?
In the Felton case, in oral arguments, the State's attorney was reduced to babbling something about Sherlock
Holmes--exactly what that had to do about spraying a pesticide, I never found out--but it showed just how weak
the State's case was.
I am hoping that going to court will not be necessary, but if we go to court in San Mateo County, we have
automatic ADR here, so wouldn't it be best to get some of the easy parts of this old controversy nailed down
beforehand as written stipulations, so we would not waste so much of the court's or the ADR's time?
Stipulations like:
1.) Stipulate that the District acknowledges that the State of California considers the District's non-serpentine
native wildflower fields and native bunchgrass habitats, are among the rarest and most endangered plant
communities in California--considering the tiny percentage of existing relicts in 2011 when compared to their
original statewide coverage in pre-European times.
2.) Stipulate that the Russian Ridge preserve wildflower fields are the best non-serpentine examples of that
habitat in northern California, within a 200 mile radius.
2.) Stipulate that a public resource agency should never use such a rare and endangered natural resource--the
best example of non-serpentine wildflowers in Northern California at Russian Ridge--as a fire training site for
five fires, without doing any before-and-after vegetation impact monitoring, nor doing any EIRs, without offering
any alternatives, and ignoring numerous reports of measured cumulative damages done to that rare resource by
the five fires.
3.) Stipulate that a full EIR should have been written for each of those Russian Ridge burn projects, with thresholds
and analyses, before-and-after monitoring, alternatives given to the public including the no-project alternative,
and that the Board or CAL FIRE should have held CEQA scoping meetings to get input from the public before the
burn projects proceeded.
4.) Stipulate that the Board knows that it cannot Categorically Exempt itself from CEQA, to avoid ever having to
write an EIR for "Management of existing native vegetation,"--which is what the Board tried to do in their
2001 resolution--and that exemption is illegal under CEQA, is vague, arbitrary, capricious, and unenforceable,
and that error will be amended by the Board with another Resolution at a Board meeting set for a date certain,
out of court.
5.) Stipulate that the planned burn by CAL FIRE for the Russian Ridge preserve was canceled in 2010, according
to the June 18 CAL FIRE email, for "CEQA issues", and the District will outline in detail, exactly what CEQA issues
CAL FIRE is talking about, that caused the 2010 fire to be postponed.
6.) Stipulate that all of the burns conducted by CAL FIRE, were done without an EIR under CEQA, and that any
pre-burn checklists done by CAL FIRE for the five Russian Ridge burns, are not legal substitutes for an EIR.
7.) Stipulate that the District acknowledges that damages have been done to the wildflower and native grass
resources by the five fires at Russian Ridge.
8.) Stipulate that those damages can be measured by comparing the 1996 weed map and mapping the extent
of the weeds today, plus comparing Erik Goetze's Russian Ridge panorama wildflower pictures on the web with
a survey of those sites today, and that the Board is going to have that work done by September 1 of this year.
9.) The District also stipulates that it could be as much as $20 million to lower the weed cover and increase the
natural resources back to pre-burn levels, and the Board is going to get an independent quote for the total costs,
out of court, and inform the public what those costs will be.
10.) The District stipulates that it is solely responsible for any mitigation costs for damages caused by the five
burns conducted by CAL FIRE, including the $20 million in natural resource damages, in part because of the hold-
harmless agreement between the agencies.
11.) The District stipulates that it will repair the fire damages to Russian Ridge, to control the weeds back to their
pre-burn levels, and restore the extent of the wildflower fields and bunchgrasses to their preburn levels, with an
EIR written before the project is begun, small scale test plots conducted to test and develop successful methods,
and annual reports for the public published of their progress by September 1 of each year, and the fire
damage mitigation project to be finished by June 1, 2015.
12.) Stipulate that the District will conduct a full EIR for any native plant management project or any weed
management project in the future, that is conducted within any grassland habitats on any of its preserves.
I look forward to your reply by March 31 of this year, and I also look forward to a promise that I will get the
District's stipulations on these issues by a certain date, no later than May 1?

I mis-counted and find that there are actually 13 Stipulations, so let's call them the Lucky-13 Stipulations, because

habitat in northern California, within a 200 mile radius.
3.) Stipulate that a public resource agency should never use such a rare and endangered natural resource--the
best example of non-serpentine wildflowers in Northern California at Russian Ridge--as a fire training site for
five fires, without doing any before-and-after vegetation impact monitoring, nor doing any EIRs, without offering
any alternatives, and ignoring numerous reports of measured cumulative damages done to that rare resource by
the five fires.
4.) Stipulate that a full EIR should have been written for each of those Russian Ridge burn projects, with thresholds
and analyses, before-and-after monitoring, alternatives given to the public including the no-project alternative,
and that the Board or CAL FIRE should have held CEQA scoping meetings to get input from the public before the
burn projects proceeded.
5.) Stipulate that the Board knows that it cannot Categorically Exempt itself from CEQA, to avoid ever having to
write an EIR for "Management of existing native vegetation,"--which is what the Board tried to do in their
2001 resolution--and that exemption is illegal under CEQA, is vague, arbitrary, capricious, and unenforceable,
and that error will be amended by the Board with another Resolution at a Board meeting set for a date certain,
out of court.
6.) Stipulate that the planned burn by CAL FIRE for the Russian Ridge preserve was canceled in 2010, according
to the June 18 CAL FIRE email, for "CEQA issues", and the District will outline in detail, exactly what CEQA issues
CAL FIRE is talking about, that caused the 2010 fire to be postponed.

Right this very minute at Russian Ridge, hundreds of millions of native seeds are germinating, and the seedlings
that are about on inch tall today, but many will die, because of the weeds spread by the fires.
Those native seedlings are in the process of being killed and covered by o tsunami of weed thatch and weed

GENERAL MANAGER'S RECOMMENDATIONS
1. Determine that the recommended actions are categorically exempt from the California

SUMMARY
Midpeninsula Regional Open Space District(District) is proposing to purchase a total of 21
parcels totaling 2.31-acres of Tax-Defaulted "Redwood Park"parcels as an addition to Purisima
Creek Redwoods Open Space Preserve, at a price not to exceed $41,000. The following report
presents a description of the property, a Preliminary Use and Management Plan, the
environmental review, purchase terms and conditions, and financial considerations.

DISCUSSION
I
Over the last twenty five years, the District has been acquiring, through gift or tax sale, "paper"
lots in the Redwood Park Subdivision adjacent to Purisima Creek Redwoods Open Space
Preserve. In 1990, the District received approximately 1,100 lots in the subdivision from San
Mateo County for open space preservation. The transfer agreement with the County also
required the District to endeavor to acquire all of the Redwood Park parcels located west of
Redwood Springs Road, which is the demarcation line between the developed parcels to the east
along Skyline Boulevard and the area west of this road that is almost entirely undeveloped(see
attached map). The current transaction includes an additional twenty one(21)parcels (32 lots)
from San Mateo County through a Chapter 8 Sale of Tax-Defaulted Property for a purchase price
not to exceed $41,000. A Chapter 8 Sale allows qualified public agencies to acquire tax-
defaulted properties at the minimum bid amount set by the County tax collector, without the
necessity of a public auction. These tax properties add to and help round out the District land
ownership pattern in the Redwood Park Subdivision. The tax-defaulted parcels contain
approximately 2.31 acres.
Property Description
The Redwood Park subdivision was filed in 1908. The area of the subdivision nearest to Skyline
Boulevard (State Highway 35) has been developed with single family residences and is part of
the Kings Mountain community. The westerly portion of the subdivision is largely undeveloped
with the exception of a couple private residences. The westerly property is a densely wooded
canyon consisting of redwood and Douglas forest, which includes the headwaters of No Name
Gulch. Primary access to the property is from Ridge Road via Skyline Boulevard to the west.
The land is surrounded by existing District land with a few neighboring private parcels. There
are no improvements on the properties proposed for purchase.

tract; the remaining portions of the subdivision are privately owned. The San Mateo County
Tax-Defaulted Parcels total 2.31 acres. The addition of these parcels would bring District
ownership in the Redwood Park"paper" Subdivision up to 92.08 acres (1,416 lots).
Approximately 35 acres of the entire subdivision consists of roads shown on the original
subdivision map of which most were never built. Most of the District-owned lots were received
from San Mateo County either by quitclaim deed or tax sale. San Mateo County established a
Dedication Boundary along Redwood Spring Road separating the residential developed area
along Skyline Boulevard from the undeveloped and heavily forested area of the subdivision. The
developed area of the subdivision occurs easterly of the"dedication line", and is the original
reasoning for the demarcation. The area designated as the"preserve boundary"that separates the
westerly undeveloped area includes approximately 139 acres; the easterly developed area
includes approximately 59-acres. This boundary line has been used as the District's demarcation
between dedicated and undedicated land, in accordance with the agreement with San Mateo
County

USE AND MANAGEMENT

I These properties are located in an unincorporated area of San Mateo County, within existing
District jurisdictional boundaries. All of these lots are part of the Redwood Park Subdivision,
generally located within the Kings Mountain area along Skyline Boulevard. The primary access
is off Skyline Boulevard to the west, connecting with Ridge Road along the southerly boundary
of this "paper" subdivision. All of these parcels adjoin, or are surrounded by, existing District
lands. The parcels received a low to medium rating for suitability as open space in the District's
master plan, and were identified in the Regional Open Space Study as an area where the District
owns some but not all of the parcels.
Preliminary Use and Management Plan (Next Steps)
The Preliminary Use and Management Plan will take effect at the close of escrow and remain
effective until the Plan is amended or a Comprehensive Use and Management Plan or Master
Plan is approved for Purisima Creek Open Space Preserve. The property will be maintained in
its current condition, with no changes anticipated. If changes to land use or the physical
environment are proposed in the future, the plan would be subject to further environmental
review and public input.

dedication area at this time. These parcels may be exchanged for other parcels
within the Redwood Park subdivision or for other open space lands in San
Mateo County.

CEQA COMPLIANCE
Project Description
The project consists of the acquisition of approximately 2.17 acres of land within the Redwood
Park paper subdivision as an addition to the Purisima Creek Redwoods Open Space Preserve,
and the adoption of a Preliminary Use and Management Plan for the property. The land will be
permanently preserved as open space and maintained in a natural condition.
CEQA Determination
The District concludes that this project will not have a significant effect on the environment. It is
categorically exempt from CEQA under Article 19, Sections 15301, 15316, 15317, 15325, and
15061(b)(3) of the CEQA Guidelines as follows:
Section 15316 exempts the acquisition of land in order to create parks if the site is in a natural
condition and the management plan proposes to keep the area in a natural condition. The
Preliminary Use and Management Plan specify the properties will be operated and maintained in
a natural condition and there will be no expansion of use. The properties will be closed to the
public.
Section 15317 exempts the acceptance of fee interests in order to maintain the open space
character of an area. The District will acquire fee interest and maintain the open space character
of the area. No development is proposed as part of this project.
Section 15325 exempts transfers of ownership of interests in land in order to preserve open
space. This acquisition will transfer fee ownership to the District and ensure it will be preserved
as public open space by incorporating it into the Redwood Park Area of Purisima Creek
Redwoods Open Space Preserve.
The project qualifies under all three sections. The project is also exempt under Section
15061(a)(3), as there is no possibility the actions may have a significant effect on the
environment.
TERMS AND CONDITIONS
The San Mateo County Tax-Defaulted Redwood Park properties are being acquired through
Chapter 8 Sale at a purchase price of approximately$38,600. A Chapter 9 Sale allows qualified
public agencies to acquire Tax-Defaulted properties at the minimum bid amount set by the
County tax collector, without the necessity of public auction. The purchase price is set by statute
as the cost of defaulted taxes and assessments and any cost of sale. The final cost figure is
determined on the effective date of the sale. It is anticipated that the final amount will not
exceed $41,000.

The Board of Directors of Midpeninsula Regional Open Space District does resolve as follows:
Section One. The Board of Directors of Midpeninsula Regional Open Space District does
hereby accept the offer contained in that certain Agreement to Purchase Tax Defaulted Property
between the County of San Mateo and the Midpeninsula Regional Open Space District, a copy of
which purchase agreement is attached hereto and by reference made a part hereof, and authorizes
the President or other appropriate officer to execute the Agreement on behalf of the District to
acquire the real property described therein ("the Tax Defaulted Redwood Park Properties").
Section Two. The General Manager, President of the Board of Directors, or other appropriate
officer is authorized to execute Certificate of Acceptance for the Grant Deed on behalf of the
District.
Section Three. The General Manager or the General Manager's designee shall cause to be given
appropriate notice of acceptance to the seller and to extend escrow if necessary.
Section Four. The General Manager is authorized to expend u p to $2,500.00 to cover the cost of

title insurance, escrow fees, and other miscellaneous costs related to this transaction.
Section Five. The General Manager and General Counsel are further authorized to approve an

technical revisions to the attached Agreement and documents, which do not involve any material
change to any term of the Agreement or documents, and which are necessary or appropriate to
the closing or implementation of this transaction.
Section Six. The purpose of this Section is to enable the District to reimburse its general fund
for the cost of certain land acquisitions. The District wishes to finance certain of these real
property acquisitions and expects to use tax-exempt debt, such as bonds,but a tax-exempt
financing is not cost justified for the District unless the principal amount of the financing is large
enough to justify the related financing costs. Consequently, it is the District's practice to buy
property with its general funds and, when a tax-exempt financing is cost justified based on the
aggregate value of acquisitions, to issue tax-exempt obligations to reimburse itself for previous
expenditures of general funds. These general funds are needed for operating and other working
capital needs of the District and are not intended to be used to finance property acquisitions on a
long-term basis.
U.S. Income Tax Regulation Section 1.150-2 requires an issuer of tax-exempt debt to declare its
intent to use a portion of tax-exempt debt proceeds for reimbursement of expenditures prior to
the payment of the expenditures. Accordingly, the Board of Directors hereby declares its intent
to issue tax-exempt obligations in the maximum principal amount of$41,000.00.

Approval of Strategic Plan Documents
STRATEGIC PLAN AD HOC COMMITTEE RECOMMENDATIONS
The Strategic Plan Ad Hoc Committee recommends that the Board:
1. Accept the proposed Identity Statement.
2. Accept the proposed Strategy Screen.
3. Accept the proposed Big Questions.
SUMMARY
In July 2010, the District began a strategic planning process and had a second workshop in October
2010, during which it developed an Identity Statement for the District. Since then, staff and the Ad Hoc
Committee have reviewed the Identity Statement with selected partner organizations, developed a
Strategy Screen, and identified Big Questions for the full Board to consider. This report presents the
final proposed Identity Statement, Strategy Screen, and Big Questions for the Board's approval.
DISCUSSION
Background
In July 2010, the District kicked off the strategic planning process at a Board workshop where staff
presented an overview of the proposed process, the suggested format of the Strategic Plan, and the
deliverables from the process. In October, the Board met again to develop the District's Identity
Statement and, subsequently, directed the Committee and staff to further refine the document as well as.
develop the Strategy Screen and Big Questions. A flow chart of the strategic planning cycle that
outlines how the Identity Statement, Strategy Screen, and Big Questions fit into the strategic planning
cycle can be found in Attachment A. It is important to remember that the strategic planning process is
iterative and dynamic and is intended to be a process that is revisited annually, or more frequently as
needed.
Since October, staff in the Strategic Plan Working Group has met bi-weekly to develop and finalize the
aforementioned items for consideration by the Committee. At the Ad Hoc Committee meetings on

March 8 and 25, the Committee reviewed and approved the proposed Identity Statement, Strategy
Screen, and Big Questions, and directed that these documents be presented to the full Board for
consideration.
Identity Statement
The Identity Statement captures the essence of who the District is through the following seven
components:
1. Mission— succinct statement of the District's mission, its reason for existence.
2. Impact—what the District is aiming to accomplish in fulfillment of the mission.
3. By Serving—who the District considers to be its "customers."
4. In—the geographic area in which. District services are provided.
5. Through—what"services" are provided by the District.
6. Differentiating Strengths—what attributes the District possesses that set it apart from other similar
organizations.
7. Revenue Sources—the financial revenue and in-kind contributions that sustain the District and
enable it to fulfill its mission.
At the Board workshop of October 2010, the Board worked through each of the seven sections of the
Identity Statement and, at the end, directed staff to work with the Ad Hoc Committee to consolidate the
comments and refine the Identity Statement.
Over the next two months, staff and the Committee developed a draft Identity Statement and, to gain
perspective on how others perceive the District, staff consulted with selected individuals from outside
partner organizations as well as a broad spectrum of District staff to solicit their feedback on the draft
Identity Statement (Attachment B). The organizations consulted consisted of San Mateo County Parks
Department, Peninsula Open Space Trust, Santa Clara County Parks Department, California State Parks
Santa Cruz Area, and the City of Mountain View. After reviewing the staff and partner feedback, the
Committee directed staff to propose revisions to the Identity Statement based on the feedback received.
The final proposed Identity Statement is included as Attachment C.
Strategy Screen
The Strategy Screen is essentially a discussion guide comprised of a list of criteria that will assist with
consistent decision-making and priority-setting based on what is most important to the District. The
proposed District Strategy Screen frames the evaluation of strategic options around the following
contexts:
1. Best way to achieve Mission
2. Are we the best-suited organization?

Big Questions
"A Big Question is an opportunity or threat to which the organization must respond. Usually, it is
beyond the scope of the organization's strategies, thus requiring a new strategy." (La Piana, 2008) Big
Questions generally fall into one of three categories:
1. An opportunity to do something new or expand an existing program or service.
2. It may be a threat or barrier negatively impacting the organization's current activities.
3. It may be a business model challenge which is a challenge that affects the entire industry.
The development of an Identity Statement and Strategy Screen has clarified the District's mission and
desired impact on the San Francisco Peninsula and communities, and has prepared the organization to
identify and respond to the proposed Big Questions. Big Questions are strategic challenges to the
organization and must be considered within the context of the District's mission and priorities. As such,
each Big Question includes a summary of the background and problem statement, the desired results,
and examples of current strategies the District is using. Below are the four proposed Big Questions
developed by staff and recommended by the Committee. The full text of the Big Questions can be
found in Attachment D.
1. The District has preserved approximately 59,000 acres of open space in the Santa Cruz Mountains,
however our financial ability to carry out the mission with the primary emphasis on land acquisition
is projected to substantially change within the next 3-6 years with current funding. How will we
respond?
2. How do we allocate resources among programs to achieve desired results?
3. Together with our partners, how can we most effectively take advantage of the opportunities to close
the gaps in the preserved conservation network within District boundaries, and address the threats to
natural open space resources, agriculture, and rural character?
4. How can the District diversify and increase its revenue stream, in the short and long term, to ensure
funds are available to continue to sustainably fulfill our mission?
These proposed Big Questions are interrelated and cannot be considered independently from each other.
However, Big Question #1 needs to be considered first as it directly impacts how the District can best
continue to fulfill its mission and thus influences the responses to Big Questions #2, 3, and 4.
Once the Board has approved the Big Questions, the District can begin to consider various strategies that
could be employed to respond to the challenges raised in the Big Questions. As potential strategies are
identified, the Strategy Screen can be used to assess the relative effectiveness, risk, feasibility, etc. of
each of the strategies, enabling the District to select the best options. After a number of potential
strategies have been identified, it is recommended that the Board refer them back to the Strategic Plan
Ad Hoc Committee for further analysis and refinement.
FISCAL IMPACT
Acceptance of the Committee's recommendations will have no impact to the District's budget.
PUBLIC NOTICE
Public notice was provided as required by the Brown Act. Notice was provided to individuals at partner
organizations consulted during the process and persons attending previous meetings. No additional
notice is required.

CEQA COMPLIANCE
The proposed actions are not a project under the California Environmental Quality Act (CEQA) and no
environmental review is required.
NEXT STEPS
If approved by the Board, discussion of potential strategic responses to the Big Questions can begin
during the Board Workshop immediately following the Regular Board Meeting on April 13. Further
workshops will be necessary to address all four of the Big Questions. Attachment F reflects the
anticipated timeline over the next six months.

Local kids help through a garden-based learning program
East Palo Alto, California [March 21, 20111 —On Saturday, the Nature Restoration Trust gave a
$40,000 grant to the City of East Palo Alto to help create Cooley Landing Park, which will connect the
community to the wonders of the San Francisco Bay. During Saturday's event, held in a greenhouse at
the East Palo Alto Charter School, local children with the non-profit Collective Roots program planted
seeds that will eventually be used to restore native vegetation at the proposed park through a garden-
based learning program.
The City of East Palo Alto and the Midpeninsula Regional Open Space District own portions of a spit of
bayfront land known as Cooley Landing, adjacent to breeding grounds for the largest concentration of
endangered California clapper rail birds in the world. They are working in partnership to clean up and
restore the former landfill site and create a nine-acre public nature park and education center. The project
will increase East Palo Alto's park space by over 50 percent.
The Nature Restoration Trust is a collaboration between Pacific Gas and Electric Company and the National
Fish and Wildlife Foundation, which has contributed$1 million from 2008 to 2010 to support similar
projects throughout their Northern and Central California service area.

POST, MROSD and Santa Clara County Partner to Protect Land and
Provide Public Access in Stevens Canyon near Cupertino
(San Francisco Peninsula, Calif.) - In a move that will link thousands of acres of
protected open space in the hills overlooking Cupertino, on March 11 Peninsula Open
Space Trust (POST) completed the purchase of a 54-acre piece of land in Stevens
Canyon for$1.5 million from private sellers. The purchase makes possible the future
extension of a popular hiking trail on nearby Santa Clara County parkland, serves as a
critical link for migrating wildlife and provides watershed protection within Stevens

Canyon.
The property joins the larger regional network of open space thanks to a fruitful
partnership between POST, Santa Clara County and the Midpeninsula Regional Open
Space District (MROSD), which is due to take ownership of the 54 acres from POST
within the next few weeks. POST, a private nonprofit land trust, will sell the land to
MROSD, a public agency, for$1.5 million.
"There's much work to be done to create a viable greenbelt of rural lands in our area,
and ongoing partnerships between land trusts like POST and public agencies is
essential to meet this need," said POST President Audrey Rust. "A greenbelt of
protected land close to our cities and suburbs will ensure we have clean air and clean
water, vital wildlife habitat and recreation opportunities that support public health and
enjoyment. This project brings us one step closer to those goals and also helps the
county leverage its limited financial resources."

"This property creates connectivity," said Midpeninsula Regional Open Space District
General Manager Steve Abbors. "It connects existing public open space and parkland in
Stevens Canyon for the benefit of watersheds and wildlife, while also providing the
opportunity for regional trail connections."
With impressive views of forested hillsides along Stevens Canyon, the property is
adjacent to MROSD's Monte Bello and Saratoga Gap open space preserves. The land
will expand the connection between the two preserves and is identified as a corridor for
the extension of the Stevens Creek Tony Look Trail between nearby Stevens Creek
County Park and Upper Stevens Creek County Park. The trail is named for Claude A.
"Tony" Look, the late County Parks commissioner and executive director and board
member of Sempervirens Fund who helped revive that organization in the late 1960s
and worked to expand land protection in the Santa Cruz Mountains until his death in
2006.
Santa Clara County will contribute $750,000 to MROSD toward the agency's eventual
purchase of this land. The county will also hold a conservation easement over the
property that ensures future public access, achieving the vision of many residents in
acquiring land for parks and open space that will provide future trail linkages. The
county previously partnered with MROSD to acquire other critical properties, the
Keyani and Hall acquisitions, which encompass 193 acres along this trail route. The
county's support of these purchases was made possible through the voter-approved
Park Charter, renewed in 2006 to fund county park acquisition, capital development,
operations and maintenance through the year 2021.
"This is the kind of project that requires sustained vision and persistence," said Santa
Clara County Supervisor Liz Kniss, whose district includes the newly protected
property. "The purpose of this effort is, over time, to provide public access to this
stunning canyon and provide the public with views of preserves and access to parks."
Created by voters in 1972, the Midpeninsula Regional Open Space District has success illy protected and managed
more than 59,000 acres of open space. The public enjoys the District's diverse and beautifid preserves 365 days a

Feb 01 A CalFire Captain came upon the scene of a dump site on District Property. It consisted of three 55 Rangers: 3
IR 11F027 gallon barrels, one 30 gallon barrel, several 5 gallon buckets, several one gallon cans, unknown bags of
what appeared to be concrete, and numerous tires. After notifying the District,three rangers responded
to the scene. Santa Clara County Fire evaluated and determined the dump was not actively releasing
hazardous material or that it was an immediate danger. District Rangers temporarily fenced off the area
until a Maintenance&Construction Supervisor could meet with a Haz Mat Clean-up Contractor who
removed all materials for$1,800.00.

District Staff before driving on District Land in the future.

meantime rangers and Santa Clara County Sheriffs Deputies were searching and came upon him about
100 yards beyond the Deer Hollow Farm back gate walking toward the farm.

MA 11S032 County Sherriff Office to respond to 16350 Skyline Boulevard regarding a report of overdue hikers. Police: 3
District Staff and Deputies went on foot from the Stillheart Center property and were able to verbally
make contact with the lost hikers from across the back creek canyon. It was dark and in steep terrain.
District Staff&Deputies drove around through a District gate and were able to locate and transport the 5
hikers back to the center.

Feb 10 A District Employee Resident Ranger received a call from Mountain View Communications of a woman Rangers: 5
IR 11So33 reporting her boyfriend and three others were overdue on their horses at Long Ridge OSP. A California Police: 5
Highway Patrol helicopter was sent to the area. District Staff responded and met with Santa Clara
County Sheriff Deputies and the friends of one of the missing riders. After extensive searching for over
five hours District Rangers received a verbal response back to their calls while on Canyon Trail near the
Table Mountain Trail in Upper Stevens Creek County Park. At 2:17 am, District Staff located the four
riders next to Stevens Creek, approximately 1000 feet to the east of the Grizzly Flat Trail. The
individuals were uninjured but slightly hypothermic. They had built a small fire to keep themselves
warm.The temperature had dropped into the 30's and all the cyclists were in short sleeve bike shirts and
shorts.

Feb 13 A District ranger observed a car parked on Hwy. 35 at Saratoga Gap OSP. Two people were observed Rangers: 2
IR 11S037 partially nude about 20'off the Achistaca Trail. Upon approaching the couple,the male pulled up his Police: 1
shorts and charged the ranger questioning his authority to make contact with them. The suspect then
told the female with him to get into their truck,while continuing to ignore orders by the ranger to stop.
They fled south on Hwy 9 in their vehicle. A Santa Clara County Sheriff Deputy responded while the
ranger followed the couple down Hwy. 9 toward the town of Saratoga,where deputies pulled them over.
The male was cited for nudity and resisting a peace officer in the performance of his/her duty. The
female was cited for nudity. Both subjects were released.

Feb 20 While on patrol, a ranger received a report of three lost hikers, off trail in the preserve. District Rangers Rangers:##
IR 11F041 and Mutual Aid Agencies coordinated the search and rescue of the lost hikers. Approximately 4&1/2 Police: 5
hours later a California Highway Patrol Helicopter reported seeing lights in the brush and the subjects
waving their arms. The individuals were then able to make their way slowly toward District Rangers who
had staged nearby using their lights and PA system as a beacon for the lost hikers. All three individuals
were uninjured and reunited with their family at the Incident Command Center a short time later.

IR 11F043 had ridden to the intersection of Loma Prieta Road where he was photographing his bike. The subject
was also warned for having an expired driver's license and no proof of insurance.

NOTES
1. Blanket permits are given to organizations and instructors; permits cover many
events on multiple preserves.(Hikes, bicycle,dog training astronomy, running
groups, painting,educational class hikes.
2008-no longer issuing multi-preserve"blanket"permits.
2. Request hikes/rides to the docent program were believed to be accounted for in
docent statistics,and were not included until 2010.
3. Run practices/Workouts are for multiple events,frequently on one preserve,for a
few months. Most are high school teams.A few are clubs.
4. Resource management permits that cover ongoing research by a scientist,
graduate student or environmental organization.
5. Permit to Enter closed area or for purpose outside of normal usage. Neighbors
were in this group until 2008.Other neighbors include: Miramontes Ridge, Stevens
Creek Canyon, Rapley Ranch.
6. Other=Orienteering events,scattering of ashes, radio contest, information station,
llama walking, permission to drive or park on preserve for a specified purpose, use of
parking lots for off-site event, fireworks,flyers/petitions,voter info, Easter service,

I am not aware of any use and management concerns that were not addressed in the staff report to the
Board. In accordance with the Public Notification Policy, neighbors to the property were notified of this

purchase. As there were no comments made by any of the neighbors or members of the public that might
require amendments, close of escrow marks the final adoption of the Preliminary Use and Management
Plan, approved by the Board of Directors at its meeting of March 9, 2011.
