HomeMy Public PortalAboutOrd. 0117ORDINANCE No. // 7 AN ORDINANCE OF THE BOARD OF TRUSTEES ( NOW KNOWN AS TIE CITY COUNCIL ) OF THE CITY OF,LYNWOOD CALIFORNIA,CREATING A WATER DEPARTMENT FOR THE SAID CITY AND ESTABLISHING WATER RATES REGULATIONS FOR THE USE OF WATER THEREIN,FIxING A PENALTY FOR THE IOLATION THEREOF,AND P.?;PEAL- ING ALL ORDINANCES � ON THE SUBJECT OF `rHTS ORDINANCE INCLUDING ORDINANCES No.5 AND 77 THE Board of Trustees (now IM as the City Council) of the City of Lynwood do ordain as follows: Section l A Water Department of the City of Lynwood in hereby created which shall have charge of the operation,mainten- ance and repairs of the Water System of said City subject to the control of the Board of Trustees of said City. Section 2, There shall be a superintendent of the Water Department and also a Clerk of said department to be appointed by Resolution duly passed by the said Board of Trustees,and which Resolution shall also fix the salary or compensation to be paid the appointees therein named, and such appointees shall hold office during the pleasure of said Board. Section 3, The duties of such Water Superintendent shall be to conduct such Water Department subject to the control of said Board of Trustees and to enforce the provisions of this ordinance and generally do and perform such duties as the Board of Trustees shall direct, The Clerk of said Water Department shall keep all the accounts, books, minuets and records of said Department and shall render and collect all bills thereof under the supervision of the Water Superintendent, He or She shall promptly pay into the treasury of said City the proceeds of all collections made by him or her at intervals of not more than one (1) week and shall report the amount of such collections and deposits to the board of Trustees at the first regular meeting of said Board in each month and accompany the same with duplicate receipts from the City Treasure showing the deposit of all collections made for the previous month, together with a list of all deliquents. Section 4. All moneys recieved by the City Treasure from the Water Department shall be credited to a Water Fund, all money shall be paid out of such fund upon warrants duly drawn thereon in the manner provided be law. Section 5. The Water Rates for all Water furnished from the municipal Water System of the City of Lynwood are hereby fixed and established for Water used each month as follows For each private dewelling house occupied by onhy one (1)family and including water for all ordinary d omestic purposes, and for use on one (1) lot not to exceed 15 square feet in area ------------- - - - - -- -01,50 For each additional residence upon the same lot, under the same ownership,where service is furn- ished upon application and owner pays all bills--------- - - - - -$ .75 For any group of residences on one or more lots, adjoining and owned by one person or firm and commonly called a court, the Water Rate shall be as follows. For the first such house shall be charged for eachmonth ------------------------------------------------- -$1,S0 The next two (2) or more such houses shall be charged for each month, each ---------------------------- - - - - -$ ,50 f (1) The above rates for courts shall be charged y each month without regard as to whether such houses are occupied or not. For each stores hop and separate place of business, equipped with plumbing and facilities for the use of water,other than a public garage where such cleaning is done bywash' rack or otherwise ---------- --- -- - - - - -- -- Where cleaning is done either be wash rack or otherwise an extra charge will be added tothe amount of --------------------------------- - - - - -$ 975 For every public school or the irregation of grounds adjacent thereto,the charge shall be at the rate of 12 cents per student per month the same to be computed to the nearest 50 students in number.This computation to be made beginning of each school semester. Section 6, The following is the flat rate to be charged for water used by contractors, as follows. For cement curbs,for each 100 lineal feet -------------- $ .30 For cement walks,for each 100 square feet ------------ -- ,15 For all other purposes,per barrel of cement,----- - - - - -- .05 For mixing and wetting concrete used in street paving per each 100 square feet,---------- - - - - -- ,15 For setteling storm drain,sewer,gas and other trenches not to exceed three(3) feet in width per lineal foot of trench, ------------------------ - - - - - , 01 For setteling trenches over three feet in width per lineal foot of trench ,----------------------- - - - - -- 601W For setteling graded streets or alleys regardless of width per 100 lineal feet. -------------------- - - - - -- - 1.00 For testing pipe lines,Multiply the diameter of the pipe by the length of the line then divide by 100 and multiply by 10 the answer being the ammount to be charged. Section 6.A. In the case of any of the construction work as listed above being done under the supervision of the City Engineer,he shall furnish the Water Department with a statement of the total quantities of cu rb,sidewalk,lineal feet of trench, square feet of street paving barrels of cement and number of feet of pipe line as to enable the eater Department to make the proper charges for such construction work. Section 6,B, For water cerved through meter the charges are as follows. For the first 1000 cubic feet or fraction thereof - - - - -- $1.75 For the next 4000 cubic feet - Per - 1846- "bSe- feet - - - - -- 1,00 For the next 10000 cubic feet per 1000 cubic feet - - - - -- ,80 For the next 10000 cubic feet up to 75,000 cubic feet- - per cubic feet------------------------------ - - - - -- ,70 All over and above 75,000 cubic feet per 1000 cubic f - - - - -- * 50 A charge of $1.00 to be added to the bill for instalation of meter together with any special fittings needed. Section,7,The Board of Trustees br the eater Superintendent may cause a meter to be installed at thete discretion on any Water Service,and it shall be their duty to do so the Board of Trustees or the dater Superintendent have reasonable cause to belive excessive,wast.full or unreasonable us a of water is being made from any such water service;and thereupon meter rates shall be charged for all water used per month from such water service as steforth in section six (6B) B of this ordinance -2- Section 12A In the matter of subdivision of lots or tracts the owner or owners of such lots or tracts must deliver to the Water Superintendent at least two(2) copies of the map of such lots or tracts to be subdiJided.The Water Superintendent or the City Engineer which ever the Board of Trustees shall appoint shall lay out the water mains and fire connections on such maps of such lots or tracts and present the same to the Board of Trustees for recomendation and passing on same. One copy of the map of such lots or tracts shall remain with the Water Department for filing and the other to go to the subdivider. Section 12B All persons,firms or corerstions subdividing lots or tracts must install all cast iron pipe and fittings as specified below,and all pipe must have a thirty (30) inch cover of earth.All valves must have either a concrete or redwood box over them.Fire hydrants to be installed as specified by the Fire Chief or the City Engineer. Section 12C Specifactions for cast iron pipe and fittings. All cast iron pipe shall be first grade,sand cast pipe,and may be cast with solid core or by the centrifugal process,and shall be subjected to a factory test hydrostatic pressure test of therr hundred (300) pounds per square inch,and shall have a thickness of wall not less than that specified in the following table. Nominal inside diameter Minimum thickness of of pipe in inches. wall in inches 6 -------------------------------------- - - - - -- . 8 -------------------------------------- - - - - -- . 10 -------------------------------------------- ..47 12 -------------------------------------- - - - - -- 1 51 All pipes shall be uniform in thickness and diameter and shall be coated inside and out with coal tar,pitch or varnish,which shall be tough and tenacious when cold and not beittle nor with tendency to scale off. Every pipe shall have distincaly cast upon it the initals of makers name and the weight and class letter of the pipe shall be conspicuously painted in white on the inside of each pipe after the coating has become hard. All pipes shall be of the socket and spigot type and must have bead on spigot end,and the design of siad sockets and spigots shall be such as to allow a proper space between for caulking material. All pipe shall be given a hydrostatic pressure test of 150 pounds per square inch after laying as herein provided. All fittings shall be class (D) tested to 175 pounds working water pressure. All valves unless otherwise specified on plan shall be standard iron body,bronz mounted,hub end,solid wedge gate valves,to open counter clockwise for opperation on 175 pounds working water pressure have a factory test of 300 pounds. 175 marked on casting and shall be Pratt & Cady or equeal. Section 13 It shall be unlawful for any consumer without the written consent of the Water Superintendent,to supply water to any pers on,firm or corporation other than the occupant or occupants of the of z such consumer,or to permit any unautherized use of water through any water service installed for the use of such consumer. Section 14 It shall be unlawful for any person to open any fire hydrant,stop cock,gate valve or meddle with any street service water connection,or any water meter attached to any service pipe con- nected with the water mains or water pipes of the said City,or to turn on or off water in any water main or water pipe of siad City ;or to tap break or injure any water main or water pipe of said City laid in any atreet,avenue or alley or other public place, or any reservoir of said City or to tap any water service pipe between the point of connection with the said main or the water pipe on private property ;air to take or draw water from any water main,pipe or fire hydrant of said City in any manner not autherized by this ordinance; And the Water Supeeint- endent may shut off the water and discontinue water service to any person violating any of the provisions of this section. Section 15.All water outlets and all continous streams of water in use must be shut off promptly upon an alarm of fire being given shall not be turned on again untill the fire occasioning such alarm shall be extinguished. «1 All meters except those set up for contractors shall be read monthly,and all bills for water supplied through a meter shall become due and payable at the City Hall at the time of reading. If the above mentioned bills are paid on or befor the twentyth of the month following the reading a discount of twenty five (25) cents shall be allowed,If these bills are not paid on or befor the twentyth of the month following the reading it shall be the duty of the Water Superintendent 66 to discontinue such service and not turn same on untill all necessary payments are paid * Where water service is discontinued for failure to pay within the time limit as stated above a charge of one ($1 to be added to the unpaid bill,for expence of turning water off and on. The Water Superintendent may,in his discertion,cause,a meter reading to be made at any time and thereupon the bill for water used since peevious reading shall become immediately due and payable, Section 8 All bill for water except meter rates. shall become due and payable in advance at the City Hall on the first day of each month and if paid on or befor the twentyth (20TH) of the month for which the bill is rendered a twenty five (25) cent discount shall be allowed on all bills exceeding one ($1,00) dollar.No discount shall be allowed on any bill less than one dollar ($1.25) and twenty five cents, Section 9 A consumer,in the meaning of thhs ordinance is one who has the privilegeor opportunity to use water from a pipe my or service on the premises occupied by him or (by permission from the Water Superintendent) from some line or tap on property near him, And in all cases the City will assume that water has been used where any person or persons or tenants in common have had the opportunity to use the same,and even though such person or persons may not have used any water during any month,they will not entitled to any rebate from the regular rate provided in such cases unless they have notified the Water Superintendent in writing to cut off such service, and where it is not practical to turn off said service er- -person,either owner or occupant must provide a line on the street or alley with service cocks so that such service may be cut off,otherwise water will be charged to all said tenants in common or persons untill the whole service is cut off, Section 10 All water rates shall be charged against the property on which it is furnished and against the owner thereof and if for any cause any sums owing therefor become delinquent the water shall be shut off and in no case shall it be turned on to the same property untill all such delinquents shall have been paid in frill, On failure to comply with the rules and regulations established as a condition to the use of water or to pay rates or any charge or penalty imposed under the terms of this podinance the water shall be shut off untill payment of the amount due is made,with one ($1,00) dollar in addition for expence of turning water off and on, Section 11 The Water Department shall have the right in its discertion to require a deposit in advance as a condition precedent to furnishing water service in an amount not exceeding the estimated charge for water to be furnished for two (2) months use,but not less in any case than three ($3.00) dollarg,which shall be held by the Water Department for a peroid of one (1) year from date of receiving the same and shall be returned to the person or persons paying the same with Interest at the rate of a % providing that all bills are paid,in the case of any person or persons made a deposit and have moved and have left one or more months water bill unpaid the deposit shall be kept as payment for said bills,any consumer having made a deposit with the water department shall not be allowed to become delinquent longer than two (2) months and the water must be shut off at the expiration of two (2) months. Section 12 No person shall be entitled to water connection or to water service untill the owner of the premises or his duly author- ized agent shall make application for water service on a form provided by the Water Department for same,Applications Cor service must be accom- panied by a service connection charge of ten ($16.00) dollars or more according to the size of service required. -3- th i ed employee of the Section 16 in case any au er - ylater Department.be refused admittance to any premises during rea- sonable hours,or being admited shall be hindered or prevented from making an examination of the water fittings or ebnnections the Water Superintendent may cause the water to be shut off fron said premises after giving twenty four (24) hours written notice to the owner or o ccu p ant ontinuedire�.isalsor interference* so to do in the event of s uch Section 17 In case of emergency the Water Department shall have the power to turn off wester from mains and pipes of the s with out notice -In all other cases the Superintendent shall give reasonable notice of such turning off to consumers likely yo be effected. Section 18 All of ordinance No, 5 is hereby repealed. Section 19 All of ordinance No.77 is hereby repealed Section 20.11ny violation of this ordinance is - hereby deemed a misdemeanor punishable by fine of not exceeding three hundred ($300000) dollars,or by imprisonment in the City jail of the City of Lynwood,or in the County jail of the County both such Los Angeles s for a term not exceeding ninty (90) days, fine and imprisonment.A judgment imposing such fine shall provide for its collection by imprisionment in either of said ails in the proportion �fine untill be wholly one ( 1.00) dollar of , Seetion 21,This ordinance is to take effect thirty (30) days after its final passage and approval the clerk of the City of Lynwood is directed to cause this ordinance to be published for one (1) time after its final passage in the Lynwood Tribune which newspaper is hereby designated for that purpose.
