HomeMy Public PortalAboutOrd. 0121ORDINANCE NO. M AN ORDINANCE REGULATING THE SALE AND USE OF FIREWORKS AND OTHER EXPLOSIVES IN THE CITY OF LYNWOOD. WHEREAS, the unregulated sale and use other explosives in the Aity of Lynwood is dangerous to both person and property in t' NOW; THEREFORE, the Board of Trustees C C o f the City of Lynwood, does to-wit: of fireworks and exceedingly he City of Lynwood. (Now known as the ordain as follows. Seo-" 1. There is hereby established in and for the City of Lynwood the following rules and regulations relative to the sale and use of fireworks and other explosives in said City as follows: 1. SALE OF FIREWORKS. ( sale of fireworks shall be restricted to duly established places of business, doing business on a regular City License, or Patriotic Bodies and not subleased to outside parties for the purpose of selling fireworks. (b) All such regular established places of business selling fireworks shall be housed in a Class "C" building or better. All gasoline service stations, public garages, paint stores are hereby prohibited for sale O-F fireworks. All hay and grain stores Or other places of business listed as "hazardous business by the .National Board of Underwriters, are hereby 'pro- hibited for the sale of fireworks, unless they carry insurance to cover the property or adjacent property. 2. DISPLAY OF FIREWORKS. Fjrework_s be displayed in such regularly established places of business in a manner in which they will not become ignited through carelessness or w illful maliciousness. 3. PRECAUTIONARY MEASURES All such places of business selling fireworks shall take such ordinary precautions to pre fire as keeping counters and aisles clear of all paper and combustible material. They shall store all fireworks or other explosive or combustible stock or material in segregated rooms or structures, and keep in good order at least one (1) 22 ga. soda and acid type fire extinguisher in a place adjacent to and easily accessible to the fireworks display. 4. SIDEWALK AND OTHER STANDS PROHIBITED : EXCEPT SJ:d ewe lk'and other stan&F used for the display or sale of fireworks are hereby prohibited; except stands operated and maintained by recognized patriotic bodies of the City of Lynwood designated by the City Council. 5. LOCATION OF STANDS. All s7ich s an s shall be located in a place least likely to catch fire to surrounding property in case of fire, and no stand shall be nearer than one hundred (100) feet to any oil or gas station. Locations to be approved by the Board of Fire Com- missioners and the Fire Chief. 6. IRE.,CAUTICNARY MEASURSS. (aF ­ A_ll isp1a_ys - and stocks of fireworks shall be displayed or stored in such manner as to be difficult of access to the general public. (c) It shall be prohibited to light or cause to be lighted or permit to be lighted any firecracker or other combustible article within any such stand. or within ten (10) feet thereof. 7. LICEASE FEES. Ali sue h permits granted by the City Council to recognized patriotic bodies in the Oity of Lyn- wood shall pay to the City License Collector as a license fee the sum of $6.00 for such privilege. B. TIME LIMIT FOR THE SALE OF FIREWORKS. All pideps o f b us i ness or ii ensed patriotic bodies in the City of Lynwood for the display or sale at retail, of fireworks, are limited to at least five days previous toand one day after the fourth of July, of each year, and no fireworks or other similar explosives shall be allowed sold, exploded or used in said City on or during any days of the year other than those indicated in this Section, subdivision 8 thereof. from the days mentioned sun, day is excluded f above; and no sale of fireworks or other explosives shall be had in any building vi*fiere any person resides. Section 2. Any violation of this Ordinance shall be a mis- d.emeanor punishable by a fine of not exceeding three hundred dollars ( U - 00.00) or by-imprisonment in the County jail of Los Angeles county or in the City Jail of the City of Lynwood for a term of not exceeding ninety (90) days. A judgment imposing a fine may prov f its collection by imprisonment in either of said jails in the proportion of one day for each dollar of the fine until the fine be wholly satisfied. Section 3. This shall take effect immediately upon its final passage. Section 4. The reason why this Ordinance is made to take effect as in Section 3 khreof is because of the great danger to property in the City of Lynwood from the use of fireworks and such other explosives in Lynwood at this, the dry season of the year, just prior to the 4th of July, and this condition requires rules and U regulations as provided in the said Ordinance an the subject, to go into effect without delay so as to reduce such danger at once. Therefore an emergency is hereby declared and this Ordinance is taken out of the operation of the Referendum. Section 5. The Clark of the City of Lynwood it direct*& to cause this Ordinance, after its fi passage and appro4a.1 to be published for one time in the Lynwood Tribune, which newspaper is hereby designated for that purpose.
