Re: Oleander Hedge between Windy Hill Open Space Preserve and The Sequoias—Portola Valley
Dear Mr. Carpenter:
Thank you for expressing your concerns about the oleander hedge along the property boundary between
Windy Hill Open Space Preserve and The Sequoias— Portola Valley (SPV). It is through the input of
preserve users and neighbors, such as yourself, that we often learn of issues on or adjacent to our land that
require our attention.
In 2001, as part of the design review process for SPV's proposed expansion project, the Town of Portola
Valley's Architectural and Site Control Committee(ASCC) required that SPV plant native vegetation on
District land and remove the oleander hedge, in conformity with the Town's Design Guidelines. These
guidelines call for replacing linear landscaping screens with more natural vegetation groupings, as well as
requiring the use of vegetation native to the Portola Valley ecosystem, rather than non-native trees and
shrubs. In August 2001,the District entered into a License Agreement with SPV to allow them to plant
and maintain native vegetation screening on District property. The agreement did not address the
oleanders, because they are not on District lands and their removal was a requirement of the Town of
Portola Valley. Therefore, we encourage you to address your concerns to the Town of Portola Valley, as
the agency that required the removal of the oleander hedge. We have contacted the Town of Portola
Valley to let them know of your concern and that you may be contacting them shortly.

Accept Informational Presentation on District's Video Conferencing System
SUMMARY
Video Conferencing systems have been installed at the Administration, Skyline and Foothill
offices of the District. This technology allows staff members at the various District office
locations and outside parties that have similar systems to engage the District via video
communications as well as give remote presentations. The system will reduce the time and
resources needed to travel to some meetings.
FISCAL IMPACT
There is no fiscal impact associated with this presentation. The District budgeted $40,000 to
implement a video conferencing system in FY2009-10. This project was completed under budget
for FY2009-10. No expenses are anticipated for FY2010-11. Future vendor support beyond
FY2010-11 may be purchased at renewable annual rate of approximately $3,500.

Authorization to Contract with the Association of Bay Area Governments to Accept $285,000 in
Grant Funding from the State Water Resources Control Board to Address Mercury
Contamination at Hicks Flat Located Within Sierra Azul Open Space Preserve.
GENERAL MANAGER'S RECOMMENDATION
Authorize the General Manager to enter into a contract with the Association of Bay Area
Governments to accept $285,000 in grant funding from the State Water Resources Control Board
to address mercury contamination at the District's Hicks Flat site located within Sierra Azul
Open Space Preserve.
SUMMARY
Partnering with the Association of Bay Area Governments (ABAG), the District has requested
and been awarded $315,000 in grant funds from the State Water Resources Control Board under
the Federal Clean Water Act Section 319(h)—Nonpoint Source Implementation Grant Program
for the cleanup and abatement of the mercury mining waste rock at Hicks Flat. These funds will
be used by ABAG ($30,000) for grant administration and the District ($285,000) to complete
project design, CEQA review, permitting, project implementation, and project monitoring.
DISCUSSION
The District is proposing to remediate an estimated 2,700 cubic yards of mercury mining waste
rock at Hicks Flat located in the Rancho de Guadalupe area of Sierra Azul Open Space Preserve.
The District acquired the Rancho de Guadalupe property in 1995. This particular property lies
within the New Almaden Mercury Mining District and was historically used as a waste rock
disposal area for the Guadalupe Mines.
The site falls within the Guadalupe River Watershed, and is abutted on the southeast by Cherry
Springs Creek and Hicks Creek, both intermittent streams and tributaries to nearby Guadalupe
Creek. Guadalupe Creek is identified as one of the waterways within the watershed impaired by
mercury under Section 303(d) of the Clean Water Act and a component of the Guadalupe River
Watershed Mercury Total Maximum Daily Load (TMDL) regulatory program.

During several studies conducted between 1990 and 1995, a total of 30 surface soil samples from
the site and six sediment samples from Cherry Springs Creek were collected. Results from these
studies indicate that the mining .waste rock at the site contains elevated levels of total mercury.
The creek sediment sampling results indicate that some of the waste rock has spilled into Cherry

Springs Creek from a steep embankment in the southeast portion of the site. The primary risk
from this site to the Guadalupe River watershed is from erosion of these materials into Cherry
Springs Creek. Since Cherry Springs Creek is a tributary to Guadalupe Creek, which is under a
potential threat from the mercury mining waste rock at Hicks Flat, the District, as the owner of
the property, is taking a proactive approach in remediating the known mercury source.

The District has proposed to remediate this site consistent with the general approach for source
and erosion control measures presented by the Regional Water Quality Control Board (RWQCB)
i in their TMDL study, and has secured grant funding from the RWQCB to implement the project.
A specific design plan for the remediation of this site will be developed as part of the
environmental review process. Subject to the conclusions reached as a result of environmental
review, it is anticipated that the main elements of the cleanup and abatement proposed for this
Site may include:
■ Removing fill materials located directly adjacent to Cherry Springs Creek

• Re-grading fill slopes and waste rock to prevent future erosion and establish stable drainage
• Capping waste rock with suitable soils, if necessary, to support adequate re-vegetation
• Install erosion control measures
• Re-vegetating the site with native plant species
In partnership with the Association of Bay Area Governments (ABAG), the District has
requested and been awarded $315,000 in grant funds from the State Water Resources Control

FISCAL IMPACT
District acceptance of grant funds in the amount of$285,000 will fund approximately three-
fourths of the required project. The District is required to provide a 25% match of an additional
$105,000. This match funding will include staff time for project administration. Total project
cost is estimated at $390,000.

Notice has been provided as required by the Brown Act. No additional notice is required.
CEQA COMPLIANCE
CEQA Guidelines Section 15378 provides that a governmental fiscal activity, which does not
involve any commitment to any specific project, is not considered a project subject to review
under CEQA. Because the grant funding will be used to undertake project design and future
implementation, a specific project has not yet been developed for the Hicks Flat site.

Future implementation of a Hicks Flat remediation project will be subject to prior required
CEQA review which will also inform project design in the event the Board determines to
proceed with the project. No physical disturbance of the site will occur as a result of securing
this funding source and none can or will occur prior to completion of CEQA review and the
associated public input process at a future Board of Directors' meeting.
NEXT STEPS
Upon Board authorization, the General Manager will execute a contract with ABAG for the
District to prepare remedial design documents, complete CEQA review, secure permits, and
complete construction, monitoring, and maintenance for the recommended project. Staff will
work closely with ABAG to ensure that grant funds are used efficiently to complete the
remediation actions necessary to enable the District to meet its obligations under the Guadalupe
River Watershed Mercury TMDL.

Los Altos, California [July 19, 20101 —Today marks the beginning of California Invasive Weed
Awareness Week. To celebrate, the Midpeninsula Regional Open Space District, with the help of the
California Conservation Corps and community volunteers, is busy removing non-native thistles and
grasses from its Open Space Preserves in the Woodside, Skyline and La Honda areas.
Slender false brome is an invasive grass spreading through the redwood forests in the Woodside area;the
only know location of this harmful weed in California. Slender false brome forms dense stands that can
inhibit the growth of native trees and plants, potentially changing the redwood forest ecosystem. This
week,the Open Space District and the California Conservation Corps are removing slender false brome in
the La Honda Creek Open Space Preserve and Thornewood Open Space Preserve.
Woodside area residents can help stop the spread of slender false brome by participating in the Open
Space District's grant-funded reimbursement program which helps homeowners identify and safely
remove the weed from their land. Over fifty acres of private property were treated for slender false brome
through the reimbursement program last year, and the Open Space District and Woodside community are
working together again this year to try and treat another 50 acres. To learn more visit

Invasive weeds in California interfere with plant, wildlife and habitat conservation, and can negatively
affect agriculture and recreation and be costly to control. Removing these weeds before they become
uncontrollable protects biodiversity—the complex web of native plants and wildlife that make up the
places we live in and visit—and preserves a healthy and beautiful natural environment for the benefit of
all.
The Midpeninsula Regional Open Space District has several opportunities this week for media to cover

It is my pleasure to have this opportunity to commemorate the Mt.
Umunhum Restoration Project Ceremonial Kickoff Event. I am sorry that
my Senate calendar does not permit me to join you today.
The clean-up of Mt. Umunhum is an important project because toxic
materials on the site pose significant threats to water quality, as well as
endangered plants and wildlife. As a member of the Defense Subcommittee
of the Senate Appropriations Committee, I'm working hard to secure
additional resources to ensure that the cleanup of the site is completed. I
recently submitted the project for further review by the committee. Once the
clean-up and restoration of this mountaintop has been completed, it will
become a recreational destination for individuals and families from all over
the Bay Area, and will provide astonishing 360-degree views, with
Monterey Bay and the Pacific Ocean to the south and west, the Sierra
Nevada Mountains to the east and San Francisco to the north.
As a United States Senator representing the people of California , I
would like to commend the Midpeninsula Regional Open Space District,
Representatives Mike Honda and Zoe Lofgren, and the U.S. Army Corps of
Engineers for all their hard work on the Mt. Umunhum Restoration Project.
