HomeMy Public PortalAbout217 aCITY OF MEDINA ORDINANCE NO. c77 / t7 AN ORDINANCE AMENDING CHAPTER 8 OF THE MEDINA ITY CODE REGARDING SHORELAND ZONING DISTRICT REGULATIONS The City Council of the City Medina ordains as follows: Section I: The Medina City Code is amended by deleting the str eken materials and adding the underlined materials as fol- lows: 1. 825.05, Subd. 8. Boathouse - A one (1) story structure not to exceed 15 feet in height used or intended for use for the storage of boats and accessories;-the-tep-ef-whfeh-map-be-used-as an-eneIesed-leek-w+th-safety-ra+I ng. 2. 825.21, Subd. 6. Where adjoining structures existing on the effective date of this Chapter have a different setback from that required, the front setback of a new structure shall conform to the average prevailing setback in the immediate vicinity. On undeveloped lots in the Shoreland District which have two (2) adjacent lots with existing principal structures on both such adjacent lots any new principal structure may be set back the average setback of the adjacent structures from the ordinary high water mark or fifty (50) feet, whichever is great- er, provided all dimensional and sanitary provisions of this ordinance are met. 3. 825.21, Subd. 8. No structure, except boat houses, piers, and docks, shall be placed at an elevation such that the lowest floor, including basement floors, is less than three feet above the highest known water level. 4. 827.03. Water Bodies Included in the Shoreland Dis- trict. The regulations of the Shoreland Zoning District in the City of Medina will shall apply to all lands within 1000 feet of the ordinary high water mark of the following lakes: Mooney RD Peter RD Winterhalter NE Spurzem NE Unnamed NE School NE Half Moon NE Ardmore RD Katrina NE Unnamed NE Thies RD Wolsfeld NE Holy Name RD Independence RD NE - Natural Environmental Lake RD - Recreational Development Lake 5. 827.05. Permitted and Conditional Uses. Within the Shoreland Overlay District, no structure or land shall be used except for one or more of the uses established in the underlying zoning district. Boathouses may be allowed up to the ordinary high water mark as conditional uses provided they are not de- signed or used for human habitation and do not contain sanitary facilities. 6. 827.07. Lot Area, Height, Lot Width, and Yard Require- ments. Structures utilizing a soil absorption sewage disposal system shall be set back 150 feet from the mean high water mark of all lakes designated in section 827.03 of this ordinance. Subd. 2. Land Height (above high water line at building) -4 feet. Subd. 3. The maximum lot area covered by impervious sur- faces shall not exceed thirty (30) percent. 7. 827.08. Roads and Parking Areas. Roads and parking areas shall be located to retard the runoff of surface waters and nutrients in accordance with the following criteria: a) Where feasible, all roads and parking areas shall meet the building setback requirements of this ordinance. b) In no instance shall a road or parking area be placed closer than 50 feet from the ordinary high water mark. c) Natural vegetation or other natural materials shall be used to screen roads and parking areas when viewed from the water. Section II: This ordinance shall become effective upon its adoption and publication. Adopted by the City Council of the City of Medina this 19th day of February, 1985. (3) Said newspaper, in at least half of its issues each year, has no more than 75 percent of its printed space comprised of advertising material and paid legal notices: and in all of its issues each year, has at least 50 percent of its news columns devoted to news of local interest to the community which it purports to serve, and not more than 25 percent of its total nonadvertising column inches in any issue wholly duplicates any other publica- tion unless the duplicated material is from recognized general news services; (4) Said newspaper is circulated in and near the municipality which it purports to serve, and has at least 500 copies regularly delivered to paying subscribers, and has entry as second-class matter in its local post of- fice; (5) Said newspaper purports to serve the Cities of Rockford, Greenfield, Corcoran, Loretto, Medina, Independence, Hanover, and Rockford Township in the County of Hennepin and the County of Wright and it has its known office of issue in the City of Rockford in said Hennepin County and Wright County, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and is maintained by the managing officer of said newspaper or persons in its employ and is subject to his directions and control during all such regular hours and at which time said newspaper is printed. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper is made available at single or subscription prices to any person, corporation, partnership or other unincorporated association requesting the newspaper and making applicable payment. (8) Said newspaper has complied with all the foregoing conditions for at least one year preceding the day or dates of publication mentioned below. (9) Said newspaper annually publishes and submits to the secretary of state a sworn United States Post Office second-class statement of ownership and circulation.
