HomeMy Public PortalAboutOrd. 0167Jv� ORDINANCE N0. 167 AN ORDINANCE OF THE CITY OF LYNWOOD, LICENSING -AND REQULATIIvG THE DISTRIBUTION OF ADVERTISING IN SAID CITY. The City Council of the City of Lynwood.do ordain as follows• SECTION 1. Every person, firm or forporation that distri- butes advertisements in the City of Lynwood shall pay a license fee of Ten Dollars ($10.00) per day, for each different paper, pamphlet or document.so distributed, for each day -on which such advertise- ments are distributed. The intent hereof is that if advertisements of more than one person, firm or corporation are combined by print- ing in one paper, pamphlet or document, only one'license for the day shall be payable for such paper, pamplet or document and that sep- arate papers, pamphlets or documents, containing the same subject _matter as other papers, pamphlets.-or documents,.- shall,not be_ con- ,• strued as different papers, pamphlets or documents. The term "advertisement" as used herein:shall be deemed to mean any literature, sign, bill, poster, picture, plat, map, sample, or device, calling or directing public attention to any real or personal property, whether offered for sale or not, or any amusement, route of travel, or other enterprise, when the object thereof is to derive profit or gain therefrom, either directly or indirectly. This section shall not be deeemed to require a license for the distribution of the United States Mail, or for the distribution of any - -- newspaper- or periodiee.l that- is capable of being entered as second class matter under the provisions of the United States Post Office Regulations of March 3,1879 or other United States Statutes or reg- ulations or the advertisements of any political party or association or any individual seeking public office, when such advertisements shall /�be confined to political or public matters. SECTION 2. It shall be unlawful for any person, firm or cor- poration, whether licensed hereunder or not, or whether exempt from P license hereunder or not, to distribute any advertisement to or among pedestrians along or upon any public street, alley, park, or public place in the City of Lynwood, or to place or distribute any advertisement in any automobile or other vehicle parked on or traveling upon any public street, alley, park or public place in said City. ' SECTION 3. It shall be unlawful- for _ any.p- erson, firm or corporation, whether licensed hereunder or not, or.whether exempt from license hereunder or not, to distribute or throw any advertise- ment upon any public street, alley, park or public place, or upon any private yard, lawn, driveway or sidewalk. SECTION 4. The license herein provided for shall be ap- plied for to the Chief of Police of said City and the fee therefor payable to such officer. SECTION 5. It shall be�Tawful for any person, firm or corporation to whom a license is herein required, to distribute any advertisement without a license, and any diolation of this` or- dinance is hereby declared to be a misdemeanor and shall be pun- ishable by a fine not to exceed Fifty Dollars (50.00) or by im- prisonment in the City or County Jail for a period not to exceed thirty (30) days, or by both such fine and ixpprisonment, and each violation of this ordinance upon a different day shall be considered a separate offense. SECTION 6. If any section or part of section of this or- dinance shall be held to be invalid or unconstitutional, it shall not affect the remainder of this ordinance. y SECTION 7. The City Clerk of the city of Lynwood is di- rected to certify to the adoption of this Ordinance and to cause the same to be published, after its final passage and approval, onee;in the Lynwood Tribune, which newspaper is hereby designated for that purpose.
