AN ORDINANCE OF THE CITY OF LYNWOOD DEFINING NUISANCES AND PROHIBITING THEIR MAINTENANCE, AND FIXING A PENALTY THEREFOR - - -- 000 - - - The City Council of the City-of Lynwood do ordain as follows: SECTION 1- SLAUGHTER HOUSES, TANNERIES AND FERTILIZER WORKS: It is hereby declared to be a nuisance and it shall.be unlawful for any person, firm or corporation to maintail conduct or carry on, or assist in maintaining, conducting or carry- ing on in the City of.Lynwood any slaughter house or establishment or place of business for tanning, scouring or dressing hides or leather, or-any fertilizer works, within 225 feet ..of_..any_- dwelling- house other than that occupied by him or it.. SECTION 2- BURNING OFFAL, ETC. It is,hereby de- clared to be a nuisance, and it shall be unlawful for any person, firm or corporation to burn or suffer or,permit to beburned. upon. any premises owned, occupied or ;oontro3led by him or it, in the City of Lynwood, any bone, feathers, offal, flesh, hair or other substan in such manner as to cause odors or gas therefrom to taint the air and render it unwholesome or injurious to the health, or offensive 'to the senses of the inhabitants of said City, or any number thereof. SECTION 3 FILTHY STABLES AND YARDS: (a) It is hereby declared to be a nuisance, and it shall be unlawful.for any person, firm or corporation to keep or suffer or permit to be kept at or M 1. l upon any premises owned, controiled or occupied by him or, it in k 2 the City of Eynwood, any chicken coop, yard, .cow house, stable, cellar, vault, drain, pool sewer•or'sink, in a foul,.offensive, 4 noxious. or filthy condition.. 5 ' (b) It _shall be unlawful for any person, 6 4firm'or corporationskeeping five (5) more head of horses, 7 cattle, goats,.sheep or mules, to fail, refuse neglect to 8 cause the manure therefrom either to be completely removed from' y the premises' where such stock is kept,'or covered with earth so 10 as to be free from noxious odors and inaccessible to flies at least once every tvrenty —four (24) Hours. II 12 (c) It shall; be unlawful for any person, 13 firm,or corporation keeping less than five (5) head of horses, 14 cattle,, goats, sheep or mules, to fail, refuse.or neglect to 15 cause the manure therefrom either to be completely removed from X16 _.,.> stock is kept or covered .with,_earth_.so the ° -premises such- , -- 17 as. to be, free from no odors and inaccessible to the flies 18'. .' at least once in every forty —eight (48) hours. 19 20 SECTION 4- LAUNDRIES TO BE CONNECTED WITH SEWERS 21' It is hereby declared to be a- nuisance, and it shall be unlawful 22 I' for 'any person, firm-or corporation to use or suffer or permit .23, to be used in the City of Lynwood for the nurpose.of a' laundry . 24 or wash house any building or premises unless the same 'shall be 25 connected with a public sewer of.the City, or to convey orsuffer 26'' or permit to be conveyed any slops, wash water, or refuse sub- 27 stance from any laundry or wash house within said City into any 28 sink, cesspool, pit-or on the ground, or in any manner disposing 29 of the same except by`conducting the same into a public sewer of 30 said City. 32,� SECTION 5. SECTION 6— PRIVIES: It is hereby declared to be a nuisance, and it shall be unlawful for any person, firm or corporation to keep "or maintain, or suffer or permit to be kept or maintained at or upon any.premises in the City of Lynwood,) owned, occupied or. controlled by him or it, any privy or dry closet for•the reception.of human excrement, or fecal matter. i SECTION.7 -- DEPOSIT O RUBBISH, ETC. ON THE STREETS It is hereby declared to be a nuisance and it shall. be firm�or. . unlawful, for any_.person4to throw, deposit, or place_ in ,or,_upon Y ) any street.or alley in.the City of Lynwood, any tin, sheet•iron,' �^ broken glass, thorny or branches, leaves, clothing, bottles,.paper, night soil, rubbish, rind, skin or peel, or any fruit or vegetables or.ice, soap, salt, chemicals or any water containing chemicals in solution in any unusual or injurious amount, or.any foul or noisome substance, or to.throw or deposit any paper upon any unenclosed 'space, either public or private, from which such paper may be blown upon any street or sidewalk,:: except such newspapers and periodicals as are usually or regu— larly . placed or deposited upon private property, or any gravel, sand, building materials, buildings,board, lumber, boxes or other structures except as may be permitted by Ordinance No. 141 (Building Code) of the City of Lynwood., 1 2 3 4 5 6' 7 8 9 1.0 11 12 13 14 15 1 -6 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ATTORNEY Roscoe R E Hess LOS motor vehicle to remain stationary upon any private property without the consent of the owner or occupant thereof. SECTION 9- EXPECTORATION: It is hereby declared to be a nuisance, and it shall be unlawful for any person to expect- orate upon the floor of any public building, hall stairway, street car, or other public conveyance, or upon any sidewalk in the City of Lynwood. SECTION 10- OBSTRUCTIONS IN THE STREETS: It is hereby declared to be a nuisance, and it shall be unlawful for any person, firm or corporation to_erect, construct or maintain in the City of Lynwood, any building, fence, porch, steps, posts, poles, tracks, wires, pipes, conduits or other obstruction, in whole or in part, upon or in-any street or alley of said City, without ex- press. authority.therefor, and without having complied with all ordinances of the City of Lynwood relating thereto. SECTION 11 EXCAVATIONS IN THE STREET It is hereby declared to be a nuisance, and it shall be unlawful for any person, firm or corporation to dig in, excavate, tear up or injure any street or alley in the City of Lynwood, without express au- thority therefor, and without having complied with all the ordinan- ces of the City of Lynwood relating thereto. SECTION 12- FO71LS and RABBITS: (a) It is.hereby_ declared to he a nuisance for any person, firm or corporation to suffer or permit any chickens, geese, ducks, turkeys, pigeons, doves, squabs, or similar fowl, or any hare or hares, or rabbit or rabbits, owned or controlled by him or it to runat large or go , upon the premises of any other person in the City of Lynwood, or to keep any chickens, geese, ducks, turkeys, pigeons, doves, - squabs or 4 . 1 similar fowl within 30 feet of any dwelling house or structure 2 used as a dwelling house unless such house or - structure be 3 occupied by him or it, or to keep any chickens, geese, ducks, 4 turkeys, pigeons, doves, squabs or similar fowl or any hare or 5 hares or rabbit or rabbits, closer than 10 feet to any street 6 line, or to keep any hare or hares,.or rabbit or rabbits within 7 30 feet of any dwelling house or structure used as a dwelling 8 house unless such house or structure shall be occupied by him 9 or it, or to keep any rooster over four (4) months old within 1.0 30 feet of any dwelling house or structure used as a dwelling, ?� unless such house or structure shall be occupied by him or it. 12 13 SECTION 13 - (a) - CATTLE: It is-hereby declared 14, to be a nuisance, and it shall be unlawful for any person, firm 15 or corporation to keep or maintain in the City of Lynwood, more 16 than 5 head of cattle at or upon any premises owned, occupied 17 or controlled by him or it in said City, within 300 feet of any 18 dwelling house other than that occupied by him or it, or within 19 one - fourth ( +) of a mile of any public school; or to keep or 20 maintain more than 2 head of cattle within 150 feet of any 21 dwelling.house other than that occupied by him or it or any 22 cattle within 75 feet of any dwelling house whatsoever. 23 (b) - HORSES It is hereby declared to 24 be a nuisance and it shall be unlawful for any person, firm or 25 corporation to stable any horse or horses or mule within 75 feet 26 of any dwelling house other than that occupied by him or it, or 27 to stable more than 5 horses or mules within 150 feet of any 28 dwelling house other than that occupied by him or it. 29 (bb) - It shall be unlawful for any 30 person, firm or corporation to keep or stable any burro or 31 burros, or.donkey or donkeys, within 200 feet of any dwelling 32 house other than that occupied by him or it. Hess ,,TORN.,,,, o..NaE Ea 5. 1 (c) GOATS It is hereby declared to be a nuisance 2 and it shall,be unlawful for any person, firm or corporation to 3 keep or maintain any goat within 50 feet of any dwelling house 4 other than that occupied by him or it, of more than two goats 5 within 75 feet of any dwelling house, other than that occupied by 6 him or it, or more than 4 goats within 100 feet of any dwelling 7 house other than that occupied by him or it, or more than five (5) 8 goats within 125 feet of any dwelling house other than that occu- 9 pied by him or it. 1.0 (cc) It shall be unlawful to keep or maintain any male 11 goat exceeding the age of six months within the limits of the City -1.2 of Lynwood. 13 (d) _ DOGS, CATS, KENNELS AND BREEDING PLACES: It 14 shall be unlawful for any person, firm or corporation to keep or 15 maintain or to suffer or permit to be kept or maintained upon any occ ied 16 premises owned. r controlled by him or it, any dog, or cat, male or 17 female,.kept mainly for breeding purposes within 25 feet of any .18 dwelling house other than that of the owner or person in control of 19 such dog or cat. 20 In any portion of the City of Lynwood it shall 21 be unlawful for any person, firm or corporation to establish, keep tit or maintain, or suffer or permit to be established, kept or main - 23 tained, upon premises owned or controlled by him or it, in the City 24 of Lynwood, any dog kennel or.cat kennel, any portion of which is 25 situated within 50 feet of any dwelling house other than the dwell - 26 ing house of the owner or person in control of such kennel, unless 27 such kennel be in a sound proof building. I 28 (dd) The term "dog kennel" as used in this 29 section is defined to be any place where 5 or more canine animals I 30 are kept or permitted to remain. The term "cat kennel" as used in 31 this section is defined to be any place where 5 or more feline 32 animals are kept or permitted to remain. Roscoe R. Hess ATTORNEY,. LAW g, R 1 (e) HOGS It is hereby declared to be a nuisance, and it 2 shall be unlawful for any person, firm or corporation to keep'or 3 maintain any hog or hogs within the City of Lynwood. 4 5 SECTION 14- CARCASSES OF ANIMALS: It is hereby 6 declared to be a nuisance and it shall be unlawful for any 7 person, firm or corporation to cause, suffer or permit the carte. 8 cass of any cow, horse, mule, donkey or.pony to remain upon any J lot, premises or place owned, controlled or occupied by him or 2.0 it for a period of more than twenty -four hours after the death 11 of such animal or to bury the carcass of any animal upon the 12 premises owned, controlled or occupied by him or it, or any pre - 13 mises, in said City unless the same be buried not less than three 14 feet below the surface of the ground and unless the same is disin- 15 fected with quick lime in an amount,-sufficient to prevent any 16 unsanitary condition. 17 18 SECTION 15- REMOVAL OF FILTH It is hereby declared 19 to be a nuisance and it shall be unlawful for any person, firm 20 or corporation to cause, suffer or permit any animal or vege- 21 table matter, garbage, filth, night soil, slops, swill, suds, 22 stagnant water or other offensive water liable to become putrid, 23 to collect or to be deposited or to remain upon any lot, premises 24 or place owned, controlled or occupied by him or it. 09 26I SECTION 16 DUMPING ON PRIVATE PROPERTY (a) It shall 27 be unlawful for any person to tresspass or go upon the land or 28 property of any other person for the purpose of dumping, or to 29 dump upon the land orproperty of any other person, any garbage, 30 refuse, junk or.any waste discarded matter of any kind. 31 SECTION 17 - D ESTRUCTION OF PLATER DEPARTMENT EQUIPMEN 32 It shall be unlawful for any person, firm or corporation to cause Roscoe R. Hess suffer or permit to be dumped or placed.upon any premises within the City of Lynwood, ora over or upon any water meter or gate valve on any water line, any rubbish, dirt, building material or other obstruction of any kind or nature whatsoever. SEC 18 REMOVAL OF GARBAG It is hereby declared to be a nuisance, and it shall be unlawful for any person, firm or corporation to haul, remove or carry any garbage through, upon or along any street in the City of Lynwood, unless such garbage is contained in a strong, water- tight, or metal compartment or recept- acle having a tight fitting wooden or metal cover or covers, and so, constructed as to prevent any garbage from falling, leaking or spilling, or odor escaping therefrom; and unless such compartment or receptacles and the wagon or truck carrying the same, used for carrying or hauling garbage, has been thoroughly cleansed within 24 hours before being used; or to fail or neglect to thoroughly cleanse such compartment or receptacles and the wagon or truck carrying the same within 24 hours after carrying or hauling any garbage. SECTION 19- MAINTENANCE AND CLEANING OF CESSPOOLS It is hereby declared to be a nuisance and it shall be unlawful for any person, firm or corporation to maintain or operate any septic tank or cesspool in the City of Lynwood, unless the same shall be kept free from odor and in a sanitary condition at all times and it shall be unlawful for any person, firm or corporation upon the abandonment of any cesspool, to fail to.disinfect the same by depositing therein not less than forty pounds of caustic soda and fill in the same with fresh earth and it shall be unlawful for any person, firm or corporation to move the contents of any cesspool, privy or vault in said City except between the hours of midnight and 6 A.M.., or to carry or transport the contents of any such a 1 cesspool, privy or vault along any street in said City unless the 2 same be in hermetically sealed containers. 3 SECTION 20- USE OF CESSPOOLS WHEN SEWER AVAILABLE 5 It is hereby declared to be a nuisance and it shall be unlawful 6 for any person, firm or corporation to use, maintain or suffer, 7 or permit to be used or maintained, upon any premises owned, con - 8 trolled or occupied by him or it, any cesspool that overflowd or 9 backs up into drainage system when there is available to such 1.0 premises a public sewer, which said cesspool shall be disinfected 11 as provided by Ordinance No. 113 of the City of Lynwood. 32 13 SECTION 21- CONN WITH SEWERS: It is.hereby. 14 declared to be a nuisance and it shall be unlawful for any person, 15 firm or corporation to connect up any new structure in the City of 16 Lynwood to any cesspool or any septic tank, when there is avail - 17 able to such premises a public sewer. 18 For the purpose of this section a sewer 19 shall be deemed available to any premises if it shall lie in the 20 street on which such premises front, or in the alley of such pre - 21 mises. In the application of this section, any rear portion of 22 any lot, regardless of the matter of ownership, shall be deemed to 23 be a part of the premises included with the lot as shown by the re- 24 corded subdivision of which it is a part. 25 26 SECTION 22 HAULING DIRT, ETC. It shall be unlawful 27 for any person firm or � corporation to P haul an dirt sand Y , , gravel 28 or similar. material upon or along any paved, oiled or macadamized 29 street in the City of Lynwood, unless contained in a box or recept- 30 acle sufficiently tight to prevent the same from sifting or droppin 31 upon such street. 32 Roscoe R. Bess 9 ATTaRNEY AT LAW L .r.tLE L 1 SECTION 23- DUMP GROUNDS It is hereby declared to 2 be a nuisance, and it shall be unlawful for any person, firm or corporation to use or suffer or permit to be used any premises ` owned, occupied or controlled by him or it, in the City.of Lynwood, 5 for the throwing, dumping or depositing of table refuse, offal, 6 swill, accumulation of animal, vegetable or other matter that 7 attends the preparation, consumption, decay or dealing in, or stor- 8 age of meats, fish, fowl, fruits or vegetables, or animals, or any 9 garbage, or offal, ashes, tin cans or rubbish. Provided, however, 10 that the City Council may from time to time by order and with the 11 consent of the owner thereof, designate certain lots or parcels of 12 land whereon it shall be lawful to dump non - putrefactive rubbish. 13 under the supervision and control of municipal officers. 14 This section shall not be construed to 15 prohibit 16 premises 17 provided 18 19 clared t the burying of ash occupied. by it,aor I by law. SECTION 2 be a nuisance and ss,accumulated by any family upon the °burni 6 - f wee da- in-tL4"manner- POLLUTION OF WATER It is hereby-de- it shall be unlawful for any person, 20f firm or corporation in the City of Lynwood to corrupt, pollute or 21 render unwholesome or impure the water of any drinking fountain, 22 hydrant or place within said City. 23 24, SECTION 25- MUSICAL INSTRUMENTS: It is hereby de- 25 clared to be a nuisance and it shall be unlawful for any person, 26 firm or corporation, vending, advertising or soliciting the sale 27 o£, or assisting in vending, advertising or soliciting the sale of 28 any kind of notions, merchandise or medicines, in the City of Lyn - 29 wood, to use a musical instrument or, device, or to sing or call out 30 or to make any noise or noises to attract persons for the purpose J of vending, advertising or soliciting the sale of notions, medicines 32 or merchandise. I SECTION 26- (a) NOISY ANIMAL It is hereby de- 1 clared.to be a nuisance, and it shall be unlawful for any person, . firm or corporation to keep, maintain or permit upon any lot or 4 parcel of land within the City of Lynwood., under his or its con - 5 trol, any animal or animals, including any fowl or fowls, which 6 by any sound or cry shall disturb the peace and comfort of any 7 neighborhood. 8 9 SECTION 27 SEPARATE OFFENSES: Each day during 1.0 which a nuisance as stated in this ordinance is maintained, 11 continued or'suffered or permitted to be maintained, continued i or to exist, shall constitute a distinct and separate offense. 13 _4 SECTION 28 - PENALTIES: Any person, firm or corpor- 15 ation, as principal, officer, agent, clerk or employee, whether 16 acting for himself or itself or for another person, firm or cor- 17 poration, who or which shall violate any provision of this 18 Ordinance, shall be guilty of a misdemeanor, and upon conviction 19 thereof shall be punished by a fine not exceeding one hundred 7 0 dollars ($100.00), or by imprisonment in the City or County 21 Jail not exceeding thirty days, or by both such fine and imprison - 22 ment. 23 0 24 SECTION 29- REPEALS: Ordinance Number 32 and all 25 Ordinances or parts of ordinances in conflict herewith, are hereby 26 repealed. Provided that any such repeal shall not affect or pre - 27 vent the prosecution and shment of any y person, firm or cor- 28 poration for any act heretofore done or permitted in violation of 29 any ordinance which may be repealed by this ordinance, and shall 30 not affect any prosecution or action which may be pending in any 31 court for the violation of any ordinance repealed by this 32 ordinance. SECTION 30- In the event that any Section or Subsection of this Ordinance shall be held unconstitutional or invalid by any Court, the same shall not affect the validity of any other Section or Subsection of this Ordinance, and the City Council hereby declares its intention to adopt all other Sections and Subsection of this Ordinance irrespective of the invalidity or unconstitutionally of any particular section or subsection. SECTION 31- The City Clerk shall certify to the adoption of this Ordinance and case the same to be published once after its finallpassage in the LYNWOOD TRIBUNE, a weekly newspaper published and circulated in said City.
