ORDINANCE NO.
AN ORDINANCE AMENDING SECTION 827
OF THE MEDINA CITY CODE TO PROVIDE
FOR THE COLLECTION OF A FEE FROM
OPERATORS OF SANITARY LANDFILLS
The City Council of the City of Medina ordains as follows:
Section I. Section 827 of the Medina City Code is amended by the
addition of the following:
827.20 Fees. Pursuant to Minn. Stat., Section
115A.921, the permit holder shall pay quarterly to the
city a fee of fifteen (15) cents per cubic yard or
equivalent weight of solid waste accepted and disposed
of on the landfill site. The revenue derived from the
fee shall be placed in the general fund for purposes of
mitigating and compensating the city for the risks,
costs, and other adverse affects of the sanitary
landfill. Waste residue from energy and resource
recovery facilities at which solid waste is processed
for the purpose of extracting, reducing, converting to
energy, or otherwise separating and preparing solid
waste for reuse shall be exempt from one-half of the
fee if there is at least an 85 percent volume reduction
in the solid waste processed. Before any fee is
reduced the verification procedures of Minn. Stat.,
Section 473.843, Subdivision 1, paragraph (c) must be
followed and submitted to the Zoning Administrator.
For the purposes of this section, six hundred (600)
pounds of solid waste shall be considered the
equivalent of one cubic yard.
Section II. This ordinance becomes effective upon its adoption
and publication or on April 1, 1985, whichever is later. Adopted
by the. City Council of the City of Medina this c2 day of
