HomeMy Public PortalAboutResolution 68-317 PCRESOLUTION NO. 68 -317PC A RESOLUTION OF THE PLANNING COMMISSION'OF THE CITY OF TEMPLE CITY GRANTING A VARIANCE IN ZONE VARIANCE CASE NO, 68 -269. The Planning Commission of the City of Temple City does resolve as follows: SECTION 1. That the Planning Commission does hereby find, determine and declare as follows: (a) That the owners of certain real property located in the City of Temple City, County of Los Angeles, State of California, located at 9661 Las Tunas Boulevard in said City, more particularly described as Lot 134, Tract Noe 6561, Book 72, pp. 34 -35 of Maps in the Office of the County Recorder, County of Los Angeles, State of California have heretofore filed an application for a zone variance to expand the second story without providing additional parking and expand to rear with reduced rear yard setback; and (b) That the Rlanning Commission conducted a duly noticed public hearing on such application, that said hearing was duly closed; and (c) That based upon the evidence adduced at said hearing, the Planning Commission files and applicable staff reports, and each member of the Commission being familiar with the proposed site, said Commission determines that the facts required by Section 9201 of the Temple City Zoning Ordinance were present and therefore the zone vari° II ance application should be granted. SECTION 2, That the zone variance application hereinabove described be and the same is hereby granted subject to the following conditions: (1) That the development of the subject property shall be substantially in'accord with the :plans marked Exhibits "A" and "B "; and (2) That the proposed addition shall be maintained as part of the principal commercial use located on the first floor; and (3) That the commercial sign on the rear of the structure shall comply with the regulation of the new sign ordinance as proposed and adopted; and (4) That the remaining portion of the rear yard area shall be maintained landscaped; and That covenant to run with the subject property shall be recorded as follows; If an additional special assess - ment 'district is hereafter proposed or formed to provide additional off - street parking facilities serving the subject property and adjacent properties, the then owners of the subject property shall participate in the cost of the district, provided that if the then owners of the subject property protest such district, this variance shall be automatically void and of no further effect and the use permitted hereunder shall immediately be terminated "; and (5) RESOLUTION 68-3 17 PC 'PAGE TWO. • (6) That the pair of exit doors be set back a minimum of 30" from the rear property line; and (7) That the applicant shall comply with all fire, building and applicable City regulations; and (8) That this variance shall expire and be of no effect unless exercised within a period of one year from and after the date of adoption of this resolution; and (9) That the applicant shall file, or cause to be filed, with the City Clerk a document which the City may re- cord, which shall acknowledge that . the owner of the Subject Property is aware of and accepts the conditions set forth in paragraphs (1) through (8) above, and that the Subject Property, regardless of any change in owner- ship, is bound by and subject to the provisions of this Resolution and the conditions contained herein. 1 • SECTION 3. The Secretary shall certify to the adoption ,of this Resolution. ADOPTED and APPROVED this 26th day of November, 1968.
