Elect Officers of the Board for the 2006 calendar year.
DISCUSSION
Pursuant to Section 1.22 of your Rules of Procedure, you are required to elect new Board
Officers for the calendar year at your first regular meeting in January. The election will be by
signed ballot and counted by the District Clerk. After the election, the ballots will be available
for public inspection.
The Board's Rules of Procedure list the order of officers to be elected as follows: President,
Vice-President, Treasurer and Secretary. The Treasurer is an automatic member of the
Administration and Budget Committee.
Separate ballots will be used to elect each Board Office. Nominations are called for first. When
nominations are closed, election by ballot for that office will then proceed.

RESOLUTION OF THE BOARD OF DIRECTORS OF
MIDPENINSULA REGIONAL OPEN SPACE DISTRICT
ADOPTING A STATEMENT OF INVESTMENT POLICY
AND AUTHORIZING THE CONTROLLER TO INVEST
SURPLUS FUNDS ALLOWED BY GOVERNMENT CODE
WHEREAS, the District needs to maximize the yield on surplus temporarily idle funds in
order to help meet land acquisition objectives; and
WHEREAS, Chapter 4, Division 2 of Title 5 of the Government Code authorizes the
District to deposit and invest surplus funds in investments which, at times, yield interest rates
higher than achievable through the Santa Clara County Pooled Fund, or the California Pooled
Investment Authority; and
WHEREAS,the District can often improve its yield on surplus funds without sacrificing
financial safety and flexibility.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
Section One. The Board of Directors of the Midpeninsula Regional Open Space District
does hereby authorize the Controller to invest surplus or temporarily idle funds according to the
Investment Policy attached hereto as Exhibit"A" and by reference made a part hereof.
Section Two. Before any particular investments the Controller shall consult with the
General Manager, or a District employee authorized to act in his/her behalf, to determine
anticipated cash flow needs of the District.
Section Three. This Resolution supersedes Resolution No. 05-14, adopted May 11, 2005.
This Resolution shall no longer be in effect as of January 10, 2007, unless extended in time, and
inactive funds shall then be deposited in the Santa Clara County Pooled Investment Fund, with
the California Pooled Investment Authority, or invested through the District's commercial bank.

Authorization to Solicit Bids for Structural Repair of th istipg Deck at the Former Hayes
Residence in El Sereno Open Space Preserve
GENERAL MANAGER'S RECOMMENDAT1TI
Authorize staff to solicit construction bids for structural repair of the existing deck at the former
Hayes residence in El Sereno Open Space Preserve.
DISCUSSION
At your December 15, 2004 meeting, you approved the purchase of the 1.52-acre Hayes property
and approved up to $55,000 for additional costs including deck repairs (see Report R-04-132).
To insure that the project would be safe and compliant with current building codes, staff retained
Jakaby Engineering to evaluate the existing deck conditions, research applicable codes, design
the deck repair and railing and prepare cost estimates. Jakaby Engineering has completed the
plans and specifications and the cost estimate, which is detailed as follows:
Partial Demolition of the Deck, Railing and Canopy $ 9,800
Structural Repair to the Deck $16,500
New Decking $11,500
New Railing System $10,250
TOTAL $48,050
Staff requests Board approval to solicit bids for a construction contract for the Structural Repair
of the Deck Retrofit. Once bids are reviewed, staff will return to the Board for award of contract
in anticipation that the project could be completed during the spring of 2006. Although a ranger
has been in residence since June 2005 use of the deck has been prohibited until the proposed
repairs have been completed.
FUNDING
As part of the Fiscal Year 2005-2006 Budget, $50,000 was approved for the structural repair of
the deck at the former Hayes residence.

Appointment of Administration and Budget Committ"for2006
GENERAL MANAGER'S RECOMMENDATION
The new President of the Board of Directors should appoint the Administration and Budget
Committee members for the 2006 calendar year with the Board's consent.
DISCUSSION
Section 1.81 of the Rules of Procedure state that appointments to the Administration and Budget
Committee shall normally be made at the first regular meeting in January and that the Board
Treasurer shall be one of the three members of the Committee. The appointment of the
Administration and Budget Committee is placed near the end of the agenda in order to allow the
newly elected Board President some time to contemplate who shall fill the two open seats on the
Administration and Budget Committee. The Board Members will have elected the Treasurer for
2006 earlier this evening (see Report R-06-01).
Section 1.80 of the Rules of Procedure state that the Board President shall appoint the Committee
members with the consent of the Board.

Approval of Legislative Consulting Services Agreemen 'for 2006 with Pub 'c Policy Advocates
GENERAL MANAGER'S RECOMMENDATION
Authorize the General Manager to execute the Consulting Services Agreement with Public
Policy Advocates for legislative consulting services in Sacramento.
DISCUSSION
In January of each year, the Board considers approval of a legislative consulting agreement for
legislative services in Sacramento for the benefit of the District. For 17 years, these services
have been provided at a below-market cost by Ralph Heim of the firm Public Policy Advocates
("PPA"). The General Manager recommends that the District continue to contract with PPA
because of the high quality of Ralph Heim's services, his ongoing familiarity with the District's
programs, his involvement in projects expected to continue in 2006, and the special
circumstances of these services,
The Consulting Services Agreement with PPA is for a one-year term for legislative consulting
services in Sacramento. The terms and conditions of the proposed agreement remain generally
unchanged. The consulting fee of$1,100.00 per month, plus a monthly expense allowance of
$55.00 has not increased since 1989. The contracted services are to commence January 1, 2006
and continue through December 31, 2006.
Ralph Heim will continue to represent the District and will provide excellent service at a very
modest cost, especially considering the returns to the District. He has worked very effectively on
the District's behalf and has done an outstanding job of protecting the District's legislative
interests. We look forward to working with Mr. Heim to represent the District's interests in
Sacramento this coming year.

CONSULTING SERVICES AGREEMENT
THIS AGREEMENT, entered into this 1 st day of January, 2006, by and between
MIDPENINSULA REGIONAL OPEN SPACE DISTRICT, hereinafter called "District", and
PUBLIC POLICY ADVOCATES,LLC, hereinafter called "Legislative Consultant", or
"Consultant."
The parties hereto do mutually agree as follows:
1. ENGAGEMENT OF CONSULTANT
The District hereby agrees to engage Consultant, and Consultant agrees to perform the
services hereinafter set forth in this Agreement.
2. SCOPE OF SERVICES
Consultant shall do, perform and carry out in a satisfactory and proper manner, as
determined by District, the following services:
a. Become familiar with District's Legislative Program for 2006 and its special
legislative concerns.
b. Advocate legislation and amendments to legislation to Sacramento legislators and
administrators and their staffs which will enhance District's funding or result in other legislation
favorable to District, with an emphasis on District's Legislative Program for 2006 and related
matters, and other legislative or State administrative matters as may be assigned from time to
time.
C. Monitor and advise of status of pending legislation which may affect District.
d. Evaluate and advise District as to the political climate in Sacramento, the best
channels for influencing legislation affecting District, desirable kinds of legislation in light of
District's problems, purposes and goals, and the best strategies for achieving legislation favorable
to District.

e. Maintain and improve liaison between District and members of the Legislature
and the State Administration.
f. Attend legislative hearings and other legislative meetings on behalf of District
when a District representative is unable to be there or as otherwise appropriate.
9- When beneficial to District, coordinate District efforts with advocates of other
regional park or open space districts, special district associations, park and recreation
associations, and other appropriate organizations.
3. RESPONSIBILITIES OF DISTRICT
District shall cooperate with and furnish necessary data to Consultant in every reasonable
way to assist Consultant in carrying out its services under this Contract. Consultant's principal
contact with District shall be District's General Manager or designee.
4. PERSONNEL
a. Consultant represents that it has, or will secure at its own expense, all personnel
required in performing the service under this Contract. Such personnel shall not be employees of
or have any contractual relationship with District.
5. TIME OF PERFORMANCE
The services of Consultant are to commence January 1, 2006, and continue through
December 31, 2006.
6. COMPENSATION
The District agrees to pay the Consultant at a fixed monthly rate of$1,100.00 plus a
monthly expense allowance of$55.00. The expense allowance shall cover costs of telephone,
postage, photocopying, bill service and other out-of-pocket expenses. If cumulative expenses
have significantly exceeded cumulative expense allowances and it appears this situation will
continue, consultant may request an increase in the allowance that shall be considered by the
General Manager. Compensation for travel expenses, such as those to the District, which may
cause the cumulative expense allowance to be exceeded, must be authorized in advance by the
General Manager. Said payments shall be prorated for any fractional month at the beginning and
end of the contract period. Such compensation shall constitute the total amount payable by

District under this agreement and shall include all costs and expenses of Consultant. Consultant
shall bill District at the end of each calendar month, and the District shall remit within 30 days of
said billings.
7. TERMINATION
District shall have the right to terminate this agreement by five (5) days written notice at
any time, with or without cause. Consultant shall be entitled to compensation for all services
rendered up to the date of termination. Consultant also shall have the right to terminate this
agreement by fifteen (15) days written notice at any time,with or without cause.
8. EQUAL EMPLOYMENT OPPORTUNITY
The Consultant shall not willfully discriminate against any employee or applicant for
employment because of race, color, sex, religion, ancestry, or national origin. Consultant shall
take affirmative action to ensure that applicants are employed without regard to their race, color,
sex, religion, ancestry, or national origin. Such action shall include, but not be limited to, the
following: employment, upgrading, demotion or transfer, recruitment or recruitment advertising,
layoff or termination, rates of pay or other forms of compensation, and selection for training,
including apprenticeship.
9. ASSIGNABILITY
The Consultant shall not assign any interest in this agreement, and shall not transfer any
interest in the same, or any payments to be received hereunder,without the prior written consent
of District.
10. INTEREST OF CONSULTANT
Consultant covenants that it presently has no interest, and shall not have any interest,
direct or indirect, which would conflict in any manner with the performance of services required
to be performed under this agreement.
Consultant shall from time to time advise General Manager of the District as to the names
of other persons and/or organizations that Consultant represents in legislative matters.

11. FINDINGS
Any reports, information, data, etc. given to or prepared or assembled by Consultant
under this contract which District requests to be kept as confidential shall not be made available
to any individual or organization by Consultant without the prior written approval of District.
12. USE OF FUNDS
Consultant shall not expend any of the funds received as compensation hereunder in
support of or in opposition to any candidate for any political office or in support of or in
opposition to any ballot measure. Compensation is limited to the cost of services actually
rendered and expenses, and specifically does not include political contributions of any type
whatsoever.
13. COMPLIANCE WITH APPLICABLE LAWS
District acknowledges that in order for Consultant to cause the preparation, execution,
and filing of reports on behalf of District pursuant to the Political Reform Act of 1974, as
amended, it is essential that District provide on a timely basis each quarter to Consultant's
designee all information required for such purposes. The information which District so agrees to
furnish is set forth in the form of a memorandum attached hereto as "Attachment A," which is
hereby incorporated herein by reference.
Consultant shall cause a memorandum substantially in the form of"Attachment A" to be
forwarded each quarter to the person whom District designates as its liaison with Consultant for
the purpose of collecting and forwarding such information. District agrees that within thirty(30)
days of the execution of this Agreement it shall designate in writing the individual who will be
that liaison.
Consultant will comply with all applicable lobbying laws including the requirements of
the Political Reform Act of 1974, as amended. District takes sole responsibility for returning, in
a timely manner, signed reporting forms prepared for District by Consultant or its political
reform consultant.

This letter provides required documentation in compliance with the agreement between La Honda-Pescadero Unified
School District and Mid-Peninsula Regional Open Space District to annually report on"the nature, scope and costs of
the environmental education services LHPUSD has provided during its prior fiscal year."This report encompasses
services provided in the 2003-04 and 2004-05 school years that were designed to promote environmental education in
furtherance of the missions of both MROSD and LHPUSD.
In collaboration with Adopt-A-Watershed and Pescaderc,Conservation Alliance,the 8t"grade class at Pescadero
Middle School surveyed local community members to identify a key environmental problem currently facing
Pescadero. Following the guidance of local experts identified by the students and their families,the 8 1h grade students
wrote a proposal to realize an invasive plant eradication program in the Pescadero Marsh. Ultimately, many classes in
Pescadero Elementary and Middle Schools participated in the activities designed by the 8th grade class.
The Adopt-the-Marsh program expanded to involve a pre-project classroom component, and a more educational and meaningful approach to the actual restoration work. Teachers worked with local environmental educators to engage 81h
grade students in learning about the marsh.This led to expanding the leadership of this program to include elementary
students at Pescadero as well as La Honda Elementary School. The science teacher invited the second grade class to
help redesign the marsh activities to make them more suitable for younger students. Thus the tad

were collaborating with teachers to reflect on last year's program and restructure it.

grade students also participated in a 3-day trip to San Mateo Outdoor Ed at Jones Gulch, with advanced studies of
local plant and animal adaptations that help them survive in the local habitat.
2004-05 was the first year that the organic garden at Pescadero was used as an"outdoor classroom and science
laboratory" for students in grades K-8.
Teacher in grades 3-5 at La Honda Elementary School worked with Adopt-A-Watershed to develop and implement an
integrated curriculum revolving around Reflection Lake, a pond in the community where the students live. Students
were organized in groups to study four aspects of the pond: the social history,natural history,plants and animals,and
environmental concerns.
The students researched their topics, making maps, taking water samples and depth measurements,creating
inventories, sending letters and interviewing people to gather first hand information about the lake. They
also researched native and invasive species, water quality and pond progression as well as the local history of La
Honda.These activities were supported by the Pescadero Conservation Alliance, San Mateo County of Department
Water Resources and local community members.
The project culminated with individual student reports, a Pond Day for the pre-school through 2 nd grade classes at La
Honda, and a presentation of their findings to an audience of about 120 local community members.
Another project undertaken at La Honda Elementary with the support of the Pescadero Conservation Alliance was a
follow up on the previous year's erosion mitigation in an erosion gully behind the Daycare building caused
by rainwater runoff from the adjacent cattle ranch.
Finally, in 2005 Pescadero High School completed its Oh year as the lead in Region 7 of the National Marine Debris
Monitoring Program. The Environmental Protection Agency(EPA)created this program in conjunction with the Ocean
Conservancy to monitor trends in pollution. Students surveyed, recorded and collected all items contained on a
particular stretch of beach in Pescadero, one of 108 sites selected by the EPA for survey. The data was collected every
30 days and then sent to EPA headquarters.

The District received your letter dated November 29, 2005, requesting detailed financial
information associated with our efforts to reduce sedimentation and curb illegal mountain
bicycling use at El Corte de Madera Creek Open Space Preserve. As you know, the District
takes these issues very seriously and is in the process of implementing the comprehensive El
Corte de Madera Creek Watershed Protection Program. This multi-year effort is designed
specifically to reduce the potential for sedimentation into the watershed through road and trail
design upgrades and enhanced management and maintenance practices. The program also
includes monitoring, closure, and restoration of former logging roads and skid trails that show
signs of illegal off-trail use by mountain bicyclists. The cost of this three-to-five year effort is
anticipated to range between $750,000 and $1,000,0000.
The District has not tracked the individual costs associated with this project in the format and
time increments that you have requested and therefore there is no corresponding list we can
provide you. Rather, staff time has been spent in implementing the program. Approximate
costs-to-date for consultants, contractors, and project-related materials are broken down as

DISTRICT ADDS 90-ACRE PROPERTY TO
MONTE BELLO AND SARATOGA GAP PRESERVES
LOS ALTOS, CA [December 15, 2005] —The Midpeninsula Regional Open Space District's Board of
Directors last night unanimously voted to purchase the 93.55-acre Hall property, located in Stevens Creek
Canyon in Santa Clara County. A 53.9-acre portion of the property was named as an addition to the Monte
Bello Open Space Preserve and a 41.5-acre portion as an addition to Saratoga Gap Open Space Preserve.
Peninsula Open Space Trust's Stevens Canyon Ranch and Santa Clara's Stevens Creek County Park also
surround the land.
"This land provides valuable trail opportunities and protects important watershed land, wildlife habitat, and a
scenic creek and ridgetop," said the District's General Manager Craig Britton.
Highly visible from areas within Saratoga Gap and Monte Bello Open Space Preserves, the Hall property
includes gently sloping creekside terraces that transition abruptly to rugged and steep hillside slopes on both the
north and south side of the property. The diverse landscape ranges from a densely wooded riparian corridor to
an open chaparral landscape along the steep upper slopes and ridgetop to the north and oak woodland to the
south. Stevens Creek, a beautiful tree-covered stream that flows year-round, passes through the property and is
a key attraction.
The land will be permanently preserved as open space and maintained in a natural condition. Public access will
be provided once the property has been included in the Comprehensive Use and Management Plans for the
Monte Bello and Saratoga Gap Open Space Preserves.
As a result of the $1,100,000 purchase the District and Santa Clara County are one step closer to their plan of
building the Stevens Creek Trail on the slope north of Stevens Canyon Road. The trail is planned in the vicinity
of the property and would connect Stevens Creek County Park to Upper Stevens Creek County Park and Monte
Bello Open Space Preserve.

On behalf of Midpeninsula Regional Open Space District(District), I am forwarding the fire
services fee payment to you as a result of the District's property purchases within San Mateo
County (County)in the Coastside Protection Area,as outlined in our March 2004 Agreement.
The District and County entered into the contractual Agreement for the provision of fire-related
services to District lands in the Coastside Protection Area that are not currently provided within
the State Responsibility Area by the California Department of Forestry and Fire Protection
(CDF). According to the Agreement,the District will, in exchange for the County's fire services,
compensate the County by means of a fire services fee.
The Agreement requires the District to make fire services fee payments to the County in two
semi-annual installments for any land purchases completed by the District within the Coastside
Protection Area during the prior twelve months between July I and June 30. Accordingly,please
find enclosed the District's first installment of$443.89 for the 556-acre Miramontes Ridge
property purchased August 30, 2005.
The Miramontes property includes three 160-acre parcels and one 75.73-acre parcel. The District
consulted with the County Controller's office to determine the pro rata share of property tax that
the County Fire Department would otherwise have received from the tax levied upon these
parcels.The pro rata share going to County Fire was determined to be 7.75 percent of the General
Tax Rate. As such, the total payment of$887.78 was calculated as follows:

Dear Mr. Panton:
I received your letter dated November 3, 2005, requesting the District's aid to help maintain the USGS
stream gage on San Gregorio Creek. We were sorry to learn that the USGS intends to discontinue
operation of the gage due to funding shortages. The District appreciates the value of the stream gage and
the benefits of collecting baseline environmental data. As you know,the District is collecting water
quality data in El Corte de Madera and La Honda Creeks, both tributary to San Gregorio Creek. The
specific purpose of this data collection effort is to prepare a sediment budget for El Corte de Madera
Creek Open Space Preserve and to monitor the effects of our program to reduce road and trail-related
erosion.
Unfortunately, due to its high annual operational cost and the distance from our nearest field office, it is
not feasible for the District to take over operation of the gage from the USGS. We would entertain a
proposal for the District to participate in a program to share the cost among a number of agencies and
organizations until a long-term solution is found, however. Toward that end, we encourage you to
explore the idea of reducing the long-term costs of the stream gage by replacing the equipment with a data
logger and through use of volunteers to load the data to a website. Given our recent experience with a
new stream gage and data logging equipment along El Corte de Madera Creek,the District could provide
support by training volunteers in the use of data loggers and other equipment. In addition,we could
provide training in other techniques to monitor sediment, such as the V* method that we are employing.
For more information about the District's water quality monitoring program and to discuss options for
collaboration on the San Gregorio stream gage, please contact the District's Resource Planner,Kirk
Lenington, at(650)691-1200. On behalf of the District I want to thank you and the volunteers from the

We are writing to ask you to designate an elected member of your organization
and a senior administrative officer responsible for employee health benefit plans
to participate in the founding meeting of the Santa Clara County Health Benefits
Coalition. The meeting is from 212m to 4 pm on Friday, 1anuary, 6, 2006 on the
campus of De Anza College in Cupertino. We will be meeting in Room 115 of
the Kirsch Center. Our host is De Anza College President Brian Murphy.
The need for a county-wide health benefits coalition was identified at the recent
Health Benefits Forum held at Foothill College, which included health care
industry experts, and participants from roughly a dozen different local
government jurisdictions, including cities, school boards, the county, and labor
unions. The initial goal of this coalition is to combine the buying power and
clout of our public agencies to achieve positive reforms in health care purchasing
for our employees that improve quality and lower cost.
This "coalition of local buyers" strategy has already proven successful in other
regions. The objectives of this new local coalition should include:
• Ensuring greater transparency in pricing, including requiring health care
providers to post prices for common health care procedures on their
websites in a common format. This practice has helped drive down
average health care costs in regions where it has been implemented.
• Development of better options for the coverage of part-time employees.

• Exploring the ability to combine the purchasing power of different local
agencies to achieve efficiencies of scale and to better monitor issues of
quality.
• Exploring the possibility of combining our local coalition with a similar
coalition currently forming at the state level.
The results of this effort will be determined by the degree of participation by
local governmental agencies in our area. Like many other efforts, regional
collaboration is the key. In this case, regional collaboration may be the only way
our local government agencies can hope to maintain current health care benefits
within the budgets we have available.

POST Surpasses Saving the Endangered Coast$200 Million Goal and Assures Protection of
San Mateo Coast
The Peninsula Open Space Trust(POST)announced today that its Saving the Endangered Coast
campaign has surpassed its$200 million goal. As of today, the campaign total stands at
$200,783,407. The campaign funds will be directly leveraged to protect thousands of acres of
open space on the San Mateo Coast from development.
"This is, by all accounts,the most successful fund-raising campaign on behalf of regional land
conservation," said POST Campaign Chair Karie Thomson. "This record-breaking fund-raising
accomplishment will result in thousands of acres of pristine beaches, hiking trails, majestic
redwoods, fertile farmland, and breathtaking vistas protected for generations to come."
POST launched the Saving the Endangered Coast campaign in 2001. The goals of the campaign
were to raise $200 million and protect 20,000 acres of coastal open space from development
along the San Mateo Coast. POST has already protected 14,259 acres during the campaign. The
campaign's success will enable POST to protect coastal land from San Francisco to Santa Cruz.
All of us at POST are profoundly grateful to everyone who came forward so generously to help
us attain this ambitious goal," said POST President Audrey Rust. "It's remarkable. Through this
campaign we are saving a unique and diverse area nearly 20 times the size of Golden Gate Park."
Over the course of the campaign, many individuals—including members of POST's Board of
Directors, Coastal Campaign Advisory Council and Skyline Society Committee—stepped up with
major gifts. Many of these donors made repeat gifts to put POST's campaign over the top. More
than 10,000 donors made gifts and pledges to POST during the campaign.
"This success is the result of POST's mission-driven, measurable approach to land conservation,"
said Board Chair Susan Ford Dorsey. "Combined with bold vision and a track record as an
effective organization,this approach has consistently motivated the community to support
POST's land-saving work."
Foundations played a pivotal role in POST's success. At the outset of the campaign,the Gordon
and Betty Moore Foundation and the David and Lucile Packard Foundation made grants of$50
million each to Saving the Endangered Coast. Those gifts raised the bar for the campaign and
inspired others to follow their example. The Kresge Foundation made available a$1.75 million
challenge grant that topped off the campaign when POST reached 99 percent of its goal.
"Protecting the San Mateo Coast is so important," said Thomson. "POST's success just goes to
show that amazing things are possible when individuals band together behind a common cause.
This is a phenomenal legacy we are leaving for the future,and everyone who contributed to the
campaign can be proud of this historic achievement."
