ORDINANCE NO.222
AN ORDINANCE CREATING Ai
MORATORIUM ON DEVELOPMENT,
IN THE AREA. OF THE CITY
NORTHWEST OF THE INTERSEC-
TION OF HIGHWAYS SS AND 101
The City Council of the City of Medina
ordains as follows:
Section I. The city council of the city
of Medina finds as follows:
Subd: 1. The city is concerned with
the proper and economic use, develop-
ment and redevelopment of the area of
the city north of Highway 55, west of
Highway 101, south of Evergreen Road
and east of the Medina Ballrom. The
formation of a land use plan for the area
could bring about significant savings In
both private and public expenditures,
enable public and private agencies to
plan activities in harmony with the land
use plan to be formulated, assist in -
developing land more wisely and effec-
tively, make the provision of public ser-
vices less costly and achieve a more
secure tax base.
Subd. 2. During the period this iterim
ordinance is In effect, no property .
within the area described in subdivision
1 shall be developed or redeveloped nor
• shall any licenses or permits, rezon-
ings, plattings or land divisions be
issued by the city for any such develop-
ment or redevelopment except as
provided in subdivision 3 hereof and ex-
cept as may be required to protect the
public health, safety and welfare.
Subd. 3. Notwithstanding the limita-
tions, restrictions and prohibitions con-
tained in subdivision 2, the city council
may authorize the necessary permits
and approvals to allow the temporary
use (not to exceed one year of the term
of this moratorium, whichever is
longer) of the vacant office%consession
stand on the drive-in theater property
as an office, including the Issuance of
permits for necessary repairs or altera-
tions to the structure. The city council
finds that the temporary use, repair or
alteration of said structure will not be
detrimental to the development of a
land use plan for the area and will not
Impede the development or redevelop-
ment of that portion of the city.
Subd. 4 This ordinance shall remain
in effect for a period of one year from
its effective date, provided that in the
event the planning process has not been
completed within that period, its effec-
tiveness may be extended for such ad-
ditional periods as the city council may
by • resolution determine to be ap-
propraite, not exceeding a total ad-
ditional period of 18 months.
Section 11. This ordinance shall
become effective upon its adoption and
publication.
