AY ORDIP ?AT "Cr OF THE CITY OF hY' < " RErULATIPIG THE SALE AP D USE OF FIR7,V'ORH1 S AI:D OTHER EXPLOSIVES IN THE CITY OF LYN?"OOD,CALIFORFIA, REPEALING ORD- INPPiCES Fos. 121 AND 172 0 - - - - The City Council of the City of Lynwood, California, does ordain as follows: `i';CTION 1.: There is hereby established in and for the City of Lynwood the following rules and regulations relative to the sale and use of fireworks in said City as follows. (A) License to sell fireworks in established places of business or from sidewalk stands, may be granted to residents of the City of Lynwood as hereinafter provided. The term "residents" shall include recognized patriotic organizations of the City, and those conducting an established business within the City. Licenses or rights thereunder shall not be transfer - ed or assigned. (B) Permits to sell fireworks in a regularly established place of business may be zranted provided such place of business is a Type 1,3 or 4 building, and further provided such building is not used for the storage or sale of gas, oils, paints, hay or straw, or as a public garage, or for any business defined as "hazardous" by the Lational Board of Fire Underwriters. (1) Regularly established places of business shall display fireworks on a counter covered on all sides and top with wire mesh not to exceed in size, or inside a cage covered on all sides and top with mesh not to exceed " in size. (C) Sidewalk stands shall be constructed as follows: (1) The entire upper portion of such stands shall be sheet- ed solid, or covered with wire mesh not over one inch in size, and the roof and lower portion of the stand shall be covered solid with boards or metal. (2) Sidewalk stands shall be located at least ten feet from a residence or place of business, other than a gas station, and at least one hundred feet from a gas station. (3) The premises on which a sidewalk stand is located, shall be entirely cleared of al._ combustible material, other than sire - works and containers, for at least twenty -five feet on all sides of such stand. (D) Pr ecautiona r y Measures. (1) All extra stocks of fireworks shall be stored in segregated rooms or structures. (2) It shall be unlawful for any one to light, or cause to be lighted any fireworks, or other combustible material with- in any such stand, or store, or within ten feet thereof. (3) Each stand shall be equipped Tor each and every fift- een feet of counter space or portion thereof, with at least one 2*- gallon soda and acid type fire extingusi;er in good condition. F` (E) LI ^ENSE FEES. (1) A person desiring to sell fireworks shall obtain an application blank from the Building Inspector, and after com- pletion of stand or counter, the Fire ^hief of the City of Lyn- wood, shall examine the fire extinguisher, and locate same, and approve the application blank,a£ ter which it shall be returned to the Building Inspector for inspection of building and busi- ness license. (2) All persons granted such permits shall pay to the Linense Collector of the City of Lynwood as a license fee the sum of Six (t'6.00) dollars for such privilege, provided, however, recognized patriotic bodies of the City of Lynwood may operate not to exceed six stands for the one fee. (1) Licenses granted hereunder shall be limited to five days ur.eceding the Fourth of July, and the Fourth of July, except when the Fourth of July falls on a Sunday, in which event licenses may be granted for one additional day. SECTION 2. l-o firework or explosives of any kind shall be displayed, offered for sale or sold, in said City on any day of the year, other than those days hereinbefore specified, nor shall any fireworks be exploded or used in said City other than on July 4th or on the day on which July 4th is celebrated. SECTION 3. Any violation of this Ordinance shall be a mis- demeanor, punishable by a fine of not exceeding 4hree .iund.red 0300.00) Dollars, or by imprisonr;ent in the County Jail of Los Angeles County, or in the City Jail of the City of Lynwood, for a term of not to exceed Ninety (90) days, or by both such fine and imprisonrent. SECTION 4. This Ordinance shall take effect immediately upon its' passage. SECTIOIT 5. This Ordinance is made to take effect as is provided in Section 4. hereof, because of the great dan -rer to property in t -_e City of Lynwood from the use of fireworks and other explosives at this time of the year, namely: the dry sea- son, just prior to the Fourth of July, and this condition requi- res the rules and regulations as provided in this said Ordinance. Therefore an emergency is hereby declared. SECTION 6: Ordinances Yos. 121 and 172 are hereby repealed. SECTION 7: That the City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published once in the Lynwood Tribune , a weekly newspaper of general circulation printed, published and circulated within said City of Lynwood.
