ORDINANCE NO.
AN ORDINANCE CREATING A MORATORIUM
ON DEVELOPMENT IN THE AREA OF THE
CITY NORTHWEST OF THE INTERSECTION
OF HIGHWAYS 55 AND 101
The City Council of the City of Medina ordains as follows:
Section I. The city council of the city of Medina finds as
follows:
Subd. 1. The city is concerned with the proper and economic
use, development and redevelopment of the area of the city
north of Highway 55, west of Highway 101, south of Evergreen
Road and east of the Medina ballroom. The formation of a
land use plan for the area could bring about significant
savings in both private and public expenditures, enable
public and private agencies to plan activities in harmony
with the land use plan to be formulated, assist in develop-
ing land more wisely and effectively, make the provision of
public services less costly and achieve a more secure tax
base.
Subd. 2. During the period this interim ordinance is in
effect, no property within the area described in subdivi-
sion 1 shall be developed or redeveloped nor shall any
licenses or permits, rezonings, plattings or land divisions
be issued by the city for any such development or redevelop-
ment except as provided in subdivision 3 hereof and except
as may be required to protect the public health, safety and
welfare.
Subd. 3. Notwithstanding the limitations, restrictions and
prohibitions contained in subdivision 2, the city council
may authorize the necessary permits and approvals to allow
the temporary use (not to exceed one year or the term of
this moratorium, whichever is longer) of the vacant
office/concession stand on the drive-in theater property as
an office, including the issuance of permits for necessary
repairs or alterations to the structure. The city council
finds that the temporary use, repair or alteration of said
structure will not be detrimental to the development of a
land use plan for the area and will not impede the
development or redevelopment of that portion of the city.
Subd. 4. This ordinance shall remain in effect for a period
of one year from its effective date, provided that in the
event the planning process has not been completed within
that period, its effectiveness may be extended for such
additional periods as the city council may by resolution
determine to be appropriate, not exceeding a total addition-
al period of 18 months.
Section II. This ordinance shall become
adoption and publication.

and has full knowledge of the facts herein stated as follows:
(1) Said newspaper is printed in the English language in newspaper format and in column and
sheet form equivalent in printed space to at least 1,200 square inches. (2) Said newspaper is dis-
tributed at least once a week for 52 weeks each year. (3) Said newspaper, in at least half of its issues
nch year, has no more than 75 percent of its printed space comprised of advertising material and
paid legal notices; and in all of its issues each year, has at least 50 percent of its news columns
ievoted to news of local interest to the community which it purports to serve, and not more than 25
percent of its total nonadvertising column inches in any issue wholly duplicates any other publica-
tion unless the duplicated material is from recognized general news services; (4) Said newspaper is
circulated in and near the municipality which it purports to serve, and has at least 500 copies
regularly delivered to paying subscribers, and has entry as second-class matter in its local post of-
fice; (5) Said newspaper purports to serve the Cities of Rockford, Greenfield, Corcoran, Loretto,
Medina, Independence, Hanover, and Rockford Township in the County of Hennepin and the County
of Wright and it has its known office of issue in the City of Rockford in said Hennepin County and
Wright County, established and open during its regular business hours for the gathering of news, sale
of advertisements and sale of subscriptions and is maintained by the managing officer of said
newspaper or persons in its employ and is subject to his directions and control during all such
regular hours and at which time said newspaper is printed. (6) Said newspaper files a copy of each
issue immediately with the State Historical Society. (7) Said newspaper is made available at single
or subscription prices to any person, corporation, partnership or other unincorporated association
requesting the newspaper and making applicable payment. (8) Said newspaper has complied with all
the foregoing conditions for at least one year preceding the day or dates of publication mentioned
below. (9) Said newspaper annually publishes and submits to the secretary of state a sworn United
States Post Office second-class statement of ownership and circulation.

published therein in the English language, once each week, fort successive weeks; that it was
first so published on Tuesday the1O day of Dec. 19/5and was thereafter printed and
published on every to and including the day of 19 and that the following
is a printed copy of the lower case alphabet from A TO Z, both inclusive, and is hereby
acknowledged as being the size and kind of type used in the composition and publication of said
notice, to wit:
