A vehicle front escort with a height sensor is required for the entire route. Houses are authorized travel between the hours of 9:00 a.m. to 3:00 p.m. Monday to Friday. Houses greater than or equal to 16' 3" shall require a Police Front Vehicle Escort and a Police Rear Vehicle Escort. The carrier is responsible for providing two-way communication, in good working order, so that the driver of the permitted load, the civilian escort (when required) and the police escorts will all have constant contact while escorting the load. GENERAL CONDITIONS This permit is granted under and subject to the vehicle laws of Georgia and to all applicable general and specific conditions for operating oversize, as promulgated and published by the State Transportation Board. In addition to complying with all applicable Federal and State Laws and regulations, permittee must comply with applicable County and Municipal ordinances when traveling off the State Highway System. Any false statement of a material fact on the permit application may result in the denial of future permits to the permittee. Non - compliance with specific conditions stated in the preceding sections of this permit renders this permit subject to immediate revocation and confiscation by any police officer or any authorized member of the Department. Tpis permit does not give the permittee the right to use or damage private property in any way. The permittee shah comply with all rules posted on any bridge or road traversed. However if we can move the building I will leave it off the ground until all site work is approved. Please contact him about the $250.00 fee. Also, he will be coming in this week to obtain a permit to move the Chinese Restaurant to a lot next to the Chu's 7- 11 on Inlet Avenue, across from Arbys. It is ok to issue the permit as Bubba and myself have worked out an agreement with him to move the building while he is waiting to go through the site plan process. Dee Anderson City of Tybee Island (912) 786 -4573 ext. 107 (912) 786 -9539 fax 2/1/2006 AGREEMENT AND POWER WHEREAS, Phil O'Dell (O'Dell) is the owner of a building located within the City of Tybee Island which he wishes to move to a commercially zoned triangular lot on Inlet Avenue; and WHEREAS, under the rules and ordinances of the City of Tybee Island a site plan would be required in order to permanently affix the building to the triangular lot where O'Dell wishes to place his building; and WHEREAS, due to time constraints O'Dell is requesting that the City allow him to move his building to the triangular lot on Inlet Avenue while he pursues site plan approval for such site and to allow the building to be temporarily placed thereon pending site plan approval; and WHEREAS, the City of Tybee Island is in need of assurances and security to enable it to require the structure be immediately moved in the event site plan approval is not granted for the building to be placed permanently upon the triangular lot; NOW, THEREFORE, in consideration of the City allowing O'Dell to move the building from its current site to the triangular lot on Inlet Avenue which is zoned commercial and to place it there temporarily O'Dell agrees as follows: 1. O'Dell shall immediately apply for site plan approval with all appropriate and available details with respect to his application to permanently affix the building on the triangular lot on Inlet Avenue and shall provide the appropriate information regarding setbacks, parking, etc. 2. The structure is not to be permanently placed on the triangular lot on Inlet Avenue until such time as site plan approval is secured from the City of Tybee Island. 3. O'Dell agrees to remove the structure from the triangular lot on Inlet Avenue or to demolish the building and remove the debris within 30 days of the City not approving the site plan and such time period shall not be extended by any suit, applications for reconsiderations or other relief and O'Dell hereby authorizes the City of Tybee Island to take whatever action is necessary with respect to the building in order to remove it from the triangular lot on Inlet Avenue or to demolish such building in the event O'Dell fails to do so within such 30 day period following disapproval of the site plan. 4. O'Dell agrees to immediately post an appropriate bond or letter of credit with the City in the amount of $10,000.00 to act as security for O'Dell's obligation to remove or demolish the structure in the event site plan approval is not granted. If site plan approval is granted such obligation shall be null and void and O'Dell shall proceed to permanently secure the structure to the triangular lot. Implementation of the site plan, once approved, shall be promptly accomplished. The letter of credit shall expressly state that it is available on the demand of the City of Tybee Island for use in connection with the movement or demolition of the structure to be temporarily affixed to the triangular lot on Inlet Avenue.
