Regional Open Spac, MIDPENINSULA REGIONAL OPEN SPACE DISTRICT R-06-57 Meeting 06-12 May 10, 2006 AGENDA ITEM 1 AGENDA ITEM Presentation by the Midpeninsula Rangers Peace Officer As-9ociation GENERAL MANAGER'S RECOMMENDATION No action is required. DISCUSSION The Midpeninsula Rangers Peace Officer Association(MRPOA) is an association of peace officer employees of the District who are also members of the Peace Officers Research Association of California. In November 2005 three members of MRPOA met with the General Manager, the Assistant General Manager and the Operations Manager to share concerns regarding Ranger safety. The meeting was very productive, with the association members sharing specifics, acknowledging management for actions already taken to improve safety, but expressing additional ideas for the District to consider in the future. The members also requested an opportunity to express their ideas directly to the Board of Directors. The General Manager agreed to arrange for such a meetint Due to various scheduling issues for MRPOA members and the District,the May 10 meeting was the first opportunity for this presentation. DISCUSSION The Planning Department staff continues to work at capacity on an ambitious Action Plan. In addition to the substantial resource management activities,which are already an integral part of the Planning Department's projects, you have directed staff to grow the resource management efforts of the District. In reviewing the steps needed to grow the resource management program, and in conjunction with the Board's existing direction to write(or update)the various resource management policies, it is essential to add a new position to the Planning Department at this time. Specifically, staff is seeking to hire a Resource Planner I position within the Planning Department. During the first year of this position,the incumbent would take responsibility for a number of projects that are currently being managed by the District's Planner 1I(Resource Planner II), Kirk Lenington. Kirk would then be free to focus more time on development of high-priority resource policies and revision of the 5-Year Resource Management Strategic Plan. In the longer term, the Resource Planner I would compliment the efforts of other resource-oriented staff. Typical assignments would include researching habitat requirements and management techniques for sensitive species; conducting site assessments and surveys of new properties; providing assistance with agency permitting and regulatory agency coordination; performing CEQA review of projects; preparing grant applications; and assisting in Resource Management Plan development, implementation and monitoring. The annual cost of a Resource Planner I, including benefits, is approximately $70,260, Anticipating the time required for recruitment of this position, it is expected that the position would be filled by no later than July I". Therefore, the financial impact for this fiscal year would be approximately $52,700. There are anticipated salary savings in the Planning Department and district wide, due to vacancies,to cover this additional expenditure. Craig Britton, General Manager i Regional Open Space I N MIDPENINSULA REGIONAL OPEN SPACE DISTRICT R-06-56 Meeting 06-12 May 10, 2006 AGENDA ITEM 3 AGENDA ITEM Authorization to Purchase One Tractor ` GENERAL MANAGER'S RECOMMEND AT ION y � Direct the General Manager to execute a purchase agreement with Pape Machinery for one tractor at total cost not to exceed $70,000. BACKGROUND The District's fiscal year 2006-2007 budget that you approved on March 22, 2006 (R-06-40) provides for the purchase of a tractor. After evaluation of various small tractors, staff determined that a landscape loader type tractor would best meet the needs of the District's maintenance and construction staff. The District will be using the Federal General Services Agency(GSA) contract # GS-30E-1021D to purchase the tractor from the local vendor, Pape Machinery. The Federal GSA program allows the District to use a federally negotiated contract and purchase the equipment directly from the vendor. The District's ability to purchase equipment through an existing competitively awarded contract provides a significant price discount and greatly reduces the amount of staff time that would otherwise be required if the District conducted a separate bid process. The landscape loader, which is made by John Deere Tractor, will enable the maintenance staff to more efficiently complete projects and tasks. It will be used to install and maintain water bars and other drainage structures on District trails and fire roads. It will also be used for slide removal and other storm related damage to District roads. The 4-in-I bucket's clamping and lifting capabilities will allow staff to move downed trees and heavy logs, which will improve productivity and reduce potential for injuries. Confirm that the recommended actions are categorically exempt from the California Environmental Quality Act (CEQA) as set out in the attached Memorandum. 2. Adopt the Preliminary Use and Management Plan recommendation as set forth in the attached Closing Memorandum and name the property as an addition to Purisima Creek Redwoods Open Space Preserve. 3. Indicate your intention to dedicate the property as public open space. DISCUSSION The District accepted the gift of two Redwood Park lots under the General Manager's authority to approve and accept a gift interest in real property in accordance with the District's Rules of Procedure, Section 2.60 (B)2 as amended October 8, 2003 (see attached Closing Memorandum dated April 27, 2006). This gift of property, totaling 0.22 acres, was accepted from the Katharine H. Gilmartin Trust on April 20, 2006. The General Manager has determined that these lots are an appropriate addition to Purisima Creek Redwoods Open Space Preserve. Therefore, it is recommended that you confirm the CEQA determination made by staff and adopt the Preliminary Use and Management Plan as set forth in the attached memoranda. Britton, General Manager From: Del Woods, Sr. Real Property Planner Date: April 14,2006 Subject: Preliminary Use& Management Plan Recommendations and CEQA Compliance for the Gilmartin Property Addition to Purisima Creek Redwoods Open Space Preserve(San Mateo County APN 067-152-030) Preliminary Use and Manaimment Plan Recommendations The Preliminary Use and Management Plan will take effect at the close of escrow and remain effective until the plan is amended or a Comprehensive Use and Management Plan is adopted. The property will be maintained in a natural condition and no changes to land use are anticipated. If changes to land use are proposed in the future,the plan would be subject to further environmental review and public input. Public Access: Closed to public access at this time. Signs: Install Preserve boundary signs where appropriate. Name: Name the properties as additions to Purisima Creek Redwoods Open Space Preserve. Dedication: Indicate your intention to dedicate the property as public open space. Public Safety Review: Preliminary site safety inspection has been conducted and there are no known safety hazards on the site. CEQA Compliance Project Description The project consists of the acquisition of approximately 0.22 acres of land as an addition to the Purisima Creek Redwoods Open Space Preserve and the adoption of a Preliminary Use and Management Plan for the property. The land to be acquired consists of five lots within the Redwood Park"paper" subdivision,which is located in an unincorporated area of San Mateo County. The primary access is off Skyline Boulevard to the west. The land adjoins or is surrounded by existing District land. Ultimately,the property will be included in a Comprehensive Use and Management Plan for the Purisima Creek Redwoods Open Space Preserve. The land will be permanently preserved as open space and maintained in a natural condition. CEQA Determination It has been concluded that this project will not have a significant effect on the environment. It is categorically exempt from CEQA(California Environmental Quality Act)under Article 19, Sections 15316, 15317, 15325, and 15061 as follows: Section 15316 exempts the acquisition of land in order to create parks if the site is in a natural condition and the management plan proposes to keep the area in a natural condition. The preliminary use and management plan specifies that the land will not be developed and will remain in a natural condition. Section 15317 exempts the acceptance of fee interests in order to maintain the open space character of an area. The District will acquire fee interest and maintain the open space character of the area. No new development is proposed as part of this project. Section 15325 exempts transfers of ownership of interests in land in order to preserve open space. This acquisition will transfer fee ownership to the District and ensure it will be preserved as public open space by incorporating it into the Purisima Creek Redwoods Open Space Preserve This acquisition qualifies under all three sections.The actions proposed in the Preliminary Use and Management Plan are also exempt under Section 15061, as there is no possibility the actions may have a significant effect on the environment. This gift of land was accepted by the District General Manager in accordance with the District's Rules of Procedure, Section 2.60(2)as amended on October 8,2003 (see Report R-03-103), to wit: I "The General Manager is hereby authorized to approve the acquisition of an interest in or easement upon real property, or an option to acquire such an interest or easement,on behalf of the Midpeninsula Regional Open Space District provided the following conditions are met: 1. The General Manager determines that the acquisition of such interest in or easement upon real property is necessary or appropriate in order for the District to effectively acquire,plan, maintain and operate its system of open space preserves,and that such acquisition is consistent with all applicable District regulations and policies concerning acquisition of real property; and I 2. The purchase price, option price, or, in the case of a gift,the fair market value of the gift,does not exceed the General Manager's authority to expend District funds as provided in Section 5549 (b)(2)of the Public Resources Code and as authorized by the Board of the Directors, and 3. Prior to the General Manager's approval of an acquisition,the District undertakes all acts required by law prior to acquiring real property, including compliance with the California Environmental Quality Act; and 4. After acquisition,the General Manager shall notify the Board of Directors, in writing, of the acquisition or option and place upon the Board of Director's agenda at its regular meeting a Preliminary Use and Management Plan for the real property so acquired. Pursuant to the District's Public Notification Policy,the General Manager may determine that such Plan be presented to the Board for final adoption, in the event no public comments concerning the proposed plan have been received prior to Board action." The General Manager signed Certificates of Acceptance on April 20, 2006 for the Gilmartin lot,based upon the determination that acceptance of this gift is in accordance with the above stated policy. Some of the key findings are highlighted below. San Mateo County voters are satisfied with the quali of local city and county parks: 0 74% rate the overall quality of local�g parks as "Excellent" or"Good." 0 71% rate the overall quality of San Mateo Coun1y parks as"Excellent" or "Good. San Mateo County voters are satisfied with the management of local city and county parks: 0 74% rate the overall job performance of city parks and recreation departments as"Excellent"or"Good." 0 66% rate the overall job performance of the San Mateo County Parks and Recreation Department as "Excellent"or"Good." Certain projects resonate strongly with San Mateo County voters: 0 63% rate preserving natural open spaces as a"6"or"T'on a 7-point priority scale, where 7 means "Highest Priority." 0 57% rate repairing bathrooms and drinking fountains as a"6" or"T" 0 56% rate expanding and improving after-school, summer, and holiday programs for youth as a"6"or'47. Several arguments in favor of the measure are effective with voters: 0 85% are more likely to support the measure after hearing that quali recreation programs help keep kids out of trouble. * 85% are more likely to support the measure after hearing that funding for parks has been cut drastically in recent years and the measure would mean parks open on time, bathrooms would be cleaned more frequently, and trash would be picked up more often. 0 80% are more likely to support the measure after hearing it would only cost the average resident of San Mateo County approximately $19/ye San Mateo County's parks are great, let's keep them that way! The data suggests that the overall theme to communicate with voters is that this measure is needed to help keep local parks in good condition. Voters are very happy with the current quality of local parks and it will be difficult to convince them that there is a crisis or huge problem that needs to be solved. A positive approach that utilizes the voters' already favorable image of the parks would likely be effective. Also, to the extent possible, changing the language of the ballot measure should be avoided. The current wording was carefully crafted and appears to be very effective. The telephone survey was conducted April 17-20, 2006, with a random selection of 600 likely voters from San Mateo County. The District Board respectfully disagrees with your interpretation of those obligations. As previously stated, the Board's position is that the level of required improvement goes back to the condition and road surface that existed when the easement was recorded on September 19, 1966. However, the District will continue to maintain the road through the former Comas property at the higher standard set by the previous owner. As a matter of clarification, the District contributes approximately a third of the costs for the maintenance and repair of the 2 miles of road you referenced, even though this is significantly disproportionate to its use of the road. Additionally, on November 16, 2005, a Board Real Property Committee meeting was held on the Portola Lookout property and historic road use and maintenance were discussed with neighbors. The Department of Fish and Game and other public agencies, ranging from federal to local,are increasingly turning to land trusts to be the long-term holders and managers of mitigation projects. Land trusts assume title and management respo sibilities for land and easements in perpetuity, undertake expensive restoration projects, and enforc easements. They are often an effective choice for undertaking this work and they provide a valuable public service in doing so. if land trusts are to continue to provide the valuable work of restoring and stewarding mitigation properties,they need adequate and timely financial resources to do so. The relationship between state and public!agencies, and nonprofit land trusts, in which the land trust assumes responsibility for the long-term care of public resources consistent with their conservation missions, is an excellent example of a beneficial public-private partnership. These partnerships have resulted in thousands of acres of successfully protected open space. I AB 2916 addresses an important need to establish a set of requirements, criteria,and guidelines for financial management of endowment funds and for land trusts to hold and manage the endowment funds for the lands and easements they are responsible for. We are confident that this is the necessary first step to developing an effective system for managing mitigation endowments and increasing public-private partnerships between the state and nonprofit land trusts. SPACE t]tSTR4CT The Santa Clara County Board of Supervisors is planning to implement a new set of zoning restrictions for hillside residences. These changes will restrict your ability to use your property and will sharply reduce its value. All of this is being done to you because the cities in the valley want a "no-houses" view of"their" hillsides from the valley floor. Changes include: • Limiting the size of your house and other buildings • Prohibiting you from building on a view site such as a ridge • Dictating the color of your house • Restricting your ability to remove trees or plant a vineyard • Not allowing you to rebuild your home if it is damaged by fire • Inviting your neighbors and environmental groups to sue you by recording all aspects of your property as deed restrictions Environmental extremists are driving this effort. They plan to devalue your home and property so that Open Space can acquire it cheaply or to make it so useless that you will never be able to build on it, improve it or sell it. We need your help.
