Aid EMERGENCY ORDINANCE PROHIBITING GAMES OF CHANCE AND DECLARING THE S1r1E TO BE A PUBLIC NUISANCE, AND PRO— VIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE. THE CITY COUNCIL OF THE INCORPORATED CITY OF LYNWOOD, CALIFORNIA, DOES ORIDAIN AS FOLLOWS: Section 1. It shall be unlawful for any person to play or bet at, or as owner or employee to open, deal, play, carry on or conduct any game of chance played with cards, dice, balls, pins, checkers, counters, quoits, beans, spindles, tables, wheels, machines, or any other device, contrivance or apparatus, or with any combina- tion thereof, for money, checks, or other thing or representative of value, within the corporate limits of the City of Lynwood, California. Section 2. It shall be unlawful for any person, firm or corporation to permit or house or encourage or protect or promote, within the corporate limits of the City of Lynwood, California, any game of chance or other device or contrivance or apparatus or combination of the same, for money, checks or other thing or representative of value prohibited by Section 1 of this ordinance. Section 3. It is hereby ordained that any person who permits, allows, conducts or maintains or participates in any game of chance pro- hibited by Sections 1 and 2 of this ordinance, tends to and does debauch and corrupt the public morals, encourage idle and dissolute habits, and draws together numbers of disorderly persons, and disturbs the public peace, and creates traffic and fire hazards andthereby is injurious to health, indecent, and offensive to the senses, and impairs the froe enjoyment of lire and property of the neople of the City of Lynwood, California. -I- 1 2 3 4 5 6 7 8 9 10 11 12 13 } d 14 m} �1Z mo� 15 O t _ U E W Q m o w d 16 _J 0 } 0 3 a� r0 " ^ ° 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Be it therefore further ordained that the maintaining, conducting, promoting or participating in any game of chance played with cards, dice, balls, pins, checkers, counters, quoits, beans, spindles, tables, wheels, machines, or any other device, contrivance or apparatus, or with any combination thereof, for money, checks, or other thing or representative of value, within the corporate limits of the City of Lynwood, California, constitutes a public gambling nuisance. It is further ordained that each violation of this ordin- ance upon any day or night shall constitute a separate offense and be punishable under the provisions of this ordinance as though the same were the only violation thereof. Section 4. It is further ordained that this ordinance is an emergency measure and is urgently required for the immediate preservation of the public peace, safety and morals and health and decency, and for the free use of property of the people of said City of Lynwood, California, by reason of tine following facts and conditions, to wit: That there are at the present time, three or more gambling houses or places of gambling now being operated within the corpor- ate limits of the said City of Lynwood, which because of no suffic- ient law prohibiting or regulating the operation of the same, are subject to no control or supervision by the police or the admini- strative authorities of said City of Lynwood; because of recent decisions of Courts and a lack of proper regulatory and prohibiting ordinances, places of gambling, commonly known as gambling houses and gambling establishments have been opened and are now operating within the said City of Lynwood in defiance of the police and ad- ministrative departments of said City, and which said gambling establishments are the proximate cause of a constant and serious tra hazard and a constant and serious fire hazard, and are tending to debauch and corrupt public morals and to encourage idle and dissolute persons to congregate, all of which disturbs the public peace and which is contrary to health and is indecent and -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 m r d q- 14 o c m 15 Q o U E (n 0] J c�0z 16 � 0 = U C' 0 V m , 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 offensive to the senses, and an obstruction to the free use of property and interferes with the comfortable enjoyment of life and property of the people of said City of Lynwood; that there are no sufficient statutory provisions to prohibit said gambling and gambling houses; that this measure is neceasary to prohibit and abate gambling and gambling houses in said City of Lynwood. Section 5. It is further ordained that any person, firm or corpor- ation violating any provision of this ordinance shall be guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of not exceeding $300.00 or by imprisonment in the city or county jail, not exceeding 90 days, or by both such fine and impris- onment. Section 6. It is further ordained that the City Clerk shall certify to the separate vote on the urgency of this ordinance by the unani- mous vote of said City Council, and that the City Clerk shall fur- ther certify to the passing of this ordinance. Section 7. It is further ordained that this ordinance shall be effective immediately after its passage and adoption. Anderson, City Clerk of the City of Lynwood, California, do hereby certify as follows: That the above and foregoing ordinance was introduced at the special meeting of tree City Council of the City of Lynwood, California, held in the council chambers of the city hall of said City at the hour of 1:00 o'clock�m. upon the r day of April, 1941. That the City Council of the City of Lynwood, Calif- ornia voted unanimously that an emergency existed because of the prevalence of gambling places ana gambling now conducted in the City of Lynwood in defiance of the police and administrative departments thereof, and because of no ordinance or statute properly regulating or prohibiting gambling in said City, there is a present tendency to debauch and corrupt public morals and to encourage idle and dis- solute habits, and that numbers of persons are, because of said gambling, drawn together, disturbinS the peace and quiet of this City, and jeopardizing the health and the decency of the people of the City of Lynwood, and impairing the free enjoyment of life and property in said City, and that because thereof an emergency exists for the passing and adoption of an emergency ordinance prohibiting gambling and gambling houses and making, the same a nuisance and a misdemeanor; M .� That said ordinance was read �- t04 and on motiop which was duly seconded, that the reading of the foregoing ordinance t ; the title to the said ordinance being read the second time, on motion which was duly seconded that the second read- ing of the proposed ordinance be waived, the City Council voted unanimously to waive the second reading of the ordinance; on motion duly made and seconded, the foregoing ordinance was passed and adopted said .. ` day of April, 1941.
