AN ORDINANCE APPROVING TIIE VACATION
OF ALLEY BETWEEN 232 AND 234 HILLSDALE AVENUE
WHEREAS, Ed and Karen Fella and Steve and Shelly Stitzle are owners of certain real estate
located in the area under jurisdiction of the Common Council of the City of Greencastle; and
WHEREAS, there are certain public ways contiguous to and contained within said real estate;
and
WHEREAS, the abutting or nearby land owners of the property wherein the public way lies
are as follows:

WHEREAS, the public way to be vacated lies wholly within the jurisdiction ofthe Common
Council of the City of Greencastle, Indiana; and
WHEREAS, the Plan Commission of the City Greencastle, Indiana, did at its regular
meeting held October 28, 2002, approve the petition of the d and Karen Fetla and Steve and Shelly
Stitzle for the vacation of the alley and right of way locatedin the city of Greencastle, Indiana; and
WHEREAS, the Common Council of the City of Greencastle, Indiana, pursuant to law,
published notice that this matter would come before the common council for a public hearing at the
regular meeting of the Common Council to be held Tuesday, November 12, 2002, at 7:00 p.m. at the
Greencastle City Hall, One North Locust Street, Greencastle, Indiana; and
WHEREAS, the adjoining property owners have consented to, or have been notified pursuant
to statute, as to the vacation of the public way; and
WHEREAS, the Common Council of the City of Greencastle, Indiana, has, after public
hearing, determined that vacating the following described public way is in the public and economic
® interest of the City of Greencastle, such closing will not reasonably interfere with the flow of traffic
for the City of Greencastle road system, and that the relief requested in said petition should be
® granted, and that the portion of the described public way located in the City of Greencastle, Indiana,
should be vacated.
NOW THEREFORE be it ordained by the Common Council of the City of Greencastle,
Indiana, that the following alley and right of way located in the City of Greencastle, Putnam County,
Indiana, and more particularly described as follows:
Situate in the State of Indiana, County of Putnam and being a part of the Northwood
Addition to the Town (now City) of Greencastle, Indiana, more particularly described
to -wit:
Beginning at the Northwest corner of Lot 1 in Block 4 of Northwood Addition to the
Town, (now City) of Greencastle, Indiana as recorded in Plat Book 3, page 133 in the
office of the Recorder of Putnam County, Indiana; thence North 20.0 feet to the
Southwest corner of Lot 10 in Block 5 of said Northwood Addition; thence East
170.0 feet with the South line of said Lot 10 to the Southeast comer thereof; thence
South 20.0 feet to the Northeast comer of said Lot 1; thence West 170.0 feet with the
North line of sad Lot 1 to the point of beginning, containing 0.08 acre, more or less.
are hereby vacated as a public right of way of the City of Greencastle, Putnam County, Indiana, and
that such land shall cease to be a public alley or right of way, and that title to such vacated land shall
revert to the landowner pursuant to law.
® This Ordinance shall have full force and effect of law immediately upon its passage by the
Common Council of the City of Greencastle, Indiana.
PASSEA AND ADOPTED by the Common Council of the City of Greencastle, Indiana this
