HomeMy Public PortalAboutOrd. 0371rrd M DZo =M Q q - W Q m o w g0z Ly J 3 " = U a J V 04 a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 371____ AN ORDINANCE OF THE CITY OF LYNWOOD, CALIFORNIA, PROVIDING FOR THE EXAMINATION AND LICENSING OF JOURNEYMAN AND MASTER ELECTRICIANS, AND FOR RE- VOKING SUCH LICENSES; ALSO PROVIDING THAT NO LICENSE SHALL ISSUE FOR ELECTRICAL WORK OR ELECTRICAL CONTRACTING IN THE CITY OF LYNWOOD WITHOUT COMPLI.ZCE 1WITH THE TERMS OF THE ORDIN- ANCE; AND PROVIDING PENALTY FOR VIOLATION OF THE PROVISIONS OF THE ORDINANCE. THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES ORDAIN AS FOLLOWS: Section 1. EXAMINATION. No person, as principal, agent, manager or employee, shall conduct, manage or carry on the trade, busi- ness or calling of a master electrician, or work as a journeyman electrician, or do any electrical work of any kind or description in the City of Lynwood, for which an electrical permit is required, without having first submitted to a practical examination before, and obtaining from, the examining board of electricians in the City of Lynwood a certificate of competency showing such person to have sufficient practical experience and sufficient knowledge to do electrical work. Any master electrician or journeyman electrician who fails to pass the examination will not be allowed to appear before the board for further examination until the ex- piration of a period of sixty days from the date of such examin- ation. Section 2. EXAMINING BOARD. The examining board of electricians of the City of Lynwood shall consist of two Master Electricians and one Journeyman Electrician who shall be appointed by the Mayor, subject to the confirmation by the City Council, and shall serve -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 O E� mo� 15 ¢ ' U E uw¢ 16 J O c o 17 18 19 20 21. 22 23 24 25 26 27 28 29 30 31 32 during the pleasure of the City Council. The Electrical Inspector of the City of Lynwood shall be a member, ex- officio, of the examin- ing board, and shall act as Secretary to the board. At all meetings, a majority of the board shall constitute a quorum for the transaction of business. The members of the examining board shall receive such compensation for their services as the City Council shall stipulate. The examining board of electricians of the City of Lynwood is hereby empowered to promulgate its own rules for examining and grading of applicants, to conduct hearings, suspend and revoke licenses. Said board shall keep a record of its proceedings and preserve for one (1) year the examination papers of every applicant. Such records are to be kept in the custody of the secretary of the examining board. PROVIDED, HO'NEVER, that the master electrician and the journeyman electrician on the examining board may be non - residents of the City of Lynwood; and provided further that upon the recommen- dation of the electrical inspector of the City of Lynwood, the City Council may, in its discretion, approve the credentials of any appli- cant when he shall have satisfactorily passed the examining board of any municipal government in the County of Los tingeles and State of California, upon an examination held by i1 for either master or journeyman electricians. Section 3. EXAMINATION FEES. The fees for examination of electricians by said examining board shall be Five Dollars ($5.00) for each Master Electrician, and Two and a half Dollars ($2.50) for each Journeyman Electrician. Every certificate of qualification shall be issued for a period ending December 31st of the year of issue. Any such certi- ficate may be renewed from year to year withcu t further examination unless same has been cancelled or revoked. Every renewal shall be made in not to exceed thirty ( 30 ) days from date of expiration of the certificate, and any such certificate not so renewed shall become null and void and may then only be renewed by the holder thereof taking a new examination and paying the same fee as provided for in this section. MASTER ELECTRICIANS. Any applicant successfully quali- fied by examination as a master electrician will be deemed to be qualified and be permitted to also act as journeyman electrician if qualified as journeyman electrician so far as the requirements of this ordinance are concerned. A master electrician, as pro- vided for in this ordinance, may be the owner, proprietor, em- ployee or corporation officer, but in all cases the Master Electri cian shall be the person who isdirectly responsible for the physical and mechanical manner in which electric materials, equipment and devices are placed or installed. A master electrician is empowered to countersign applications for electri cal permits and to supervise electrical work authorized by such p The name of the master electrician authorized as such, the person, firm or corporation for whom permit applications are are to be countersigned shall be set forth in the business license, and it shall be unlawful for any master electrician to countersign permit applications for more than one person, firm or corporation. It shall be unlawful for any master electrician to permit his name to be used or to knowingly permit himself to be held out as the officer or employee of any person holding an electrical contractor's license, unless he is in fact such officer or employee and does in fact supervise the doing or installation of electrical work performed by such person. Section 5. JOURNEYMAN ELECTRICIAN. For the purpose of this ordin- ance, a journeyman electrician shall be deemed to be any person who is employed to do electrical work for wages or salary, by an electrical contractor, but who does not furnish any materials or supplies in the execution or performance of electrical work. Section 7. APPRENTICE OR HELPER. The registration fee for helpers or apprentice electricians shall be Fifty Cents. No examination will be required. It will be unlawful to employ anyone as an apprentice or helper electrician without a permit having been obtained. An apprentice or helper shall be deemed to be anyone other than a Journeyman electrician who does electrical construc- tion work for pay or wages but does not furnish any material and who may work only under the immediate supervision of a journeyman electrician and on the same premises as said journeyman electri- cian. It is unlawful for any person, firm or corporation holding an electrical contracting license in the City of Lynwooa to employ more than one (1) helper or apprentice to each oni (1) journeyman electricians or fraction thereof on any one premises. Section 8. It is further ordained that no license shall issue for electrical work or electrical contracting within the City of Lyn- wood until the person, firm or corporation applying for the license shall maintain some person duly licensed as a master electrician at the licensees regular place of business. Section 9. It is further ordained that as soon as this ordinance becomes effective the license collector shall notify all licensed electrical contractors within the City of Lynwood of this ordin- ance, and require that the licensee comply with the requirements -4- 1 2 3 4 5 6 7 8 9 10 11 12 13 n 14 } m} q� �Zo G�ma� 15 Q U `- Q w ° Z O J c o Z 16 C o m 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 of this ordinance within thirty (30) days thereafter. That if such licensee shall not have complied with the requirements of this ordinance within thirty (30) days after such notice, the license collector shall at once cancel such license. Section 10. It is further ordained that any person, firm or corpor- ation violating the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not exceeding Two Hundred Dollars ($200.00), or imprisoned in the city jail not exceeding sixty (60) days, or both such fine and imprisonment. It is further ordained that each and every day this ordinance is violated shall constitute a separate offense for f which the person, firm, or corporation violating the ordinance may be punished. Section 11. The City Clerk of the City of Lynwood shall certify to the aaoption of this ordinance, to its approval and signature by the mayor of said City, and to its attestation byethe City Clerk, snail cause same to be published by one insertion in the Lynwood Press ,a newspaper of general circulation, published and circulated in. the City of Lynwood, and thereafter the same shall become effective according to law.
