AN ORDINANCE AMMENDING SECTION 320.25
OF THE MEDINA CITY CODE REGARDING
THE REMOVAL OF PUBLIC NUISANCES
The City Counicl of the City of Medina ordains as
follows:
Section I:
The Code of Ordinances of the Ctiy of Medina is ammended
by deleting the str}eken materials and adding the underlined
materials as follows:
320.25. Abatement of Nuisance and Assessment of Cost. When
any nuisance is found to exist, except under 330.05 Subd. 14
of the Medina City Code, the City Clerk/Treasurer or a designated
representative shall order the owner or occupant thereof to
remove the same, at the expense of the owner or occupant, within
a period not to exceed 10 days, the exact time to be specified
in the notice. Upon failure of the owner or occupant to abate
the nuisance, the City Council shall order the Chief of Police
to cause said nuisance to be abated, to certify the cost thereof
to the Ctiy Clerk -Treasurer, and the Ctiy Clerk -Treasurer shall
certify said costs to the County Auditor to be extended on the
tax roll of the County against the real estate from which the
nuisance has been abated, all in accordance with Minnesota
Statutes Sections 145.22 and 145.23 and Section 412.221.
When a nuisnace is found to exist under City Ordinace 330.05,
Subd. 14, inoperable or unlicensed motor vehicles, the Chief
of Police or his designee shall place written notice on the
inoperable or unlicensed motor vehicle of the violation. If
the violation is not corrected within seven (7) days, the
Police Department is authorized to remove the motor vehicle
to a storage facility designated by the City. The costs of
removal and storage shall be borne by the owner of the motor
vehicle removed. Motor vehicles not claimed within thirty
(30) days of removal shall be disposed as unclaimed in accordance
with Minnesota Statutes Sections 168601 through 1688101.
Section II:
This ordinance shall become effective upon its adoption
and publication.
