GENERAL MANAGER'S RECOMMENDATION Accept the Quarterly Ombudsperson Report (Attached) and the Ombudsperson Suggestions on the Number of Reports Provided per Year DISCUSSION The District's Ombudsperson program began in October, 2004 when you appointed Carol Joyce as the District's first Ombudsperson. She has been providing quarterly reports to the Board since that time and came before the Board in October 2005, after her first year with the District. It has now been a second year since appointment, and Ms. Joyce has agreed to come before the Board to present the third quarterly report for 2006 (attached) and discuss with you her recommendation to provide reports to you twice per year, (based upon the low volume of calls she receives throughout the year). At your September 27, 2006 meeting, you renewed Ms. Joyce's Volunteer Agreement for another year. Staff continues to find Ms. Joyce's work for the District to be responsive and effective. Joyce, Ombudsperson Date: 10/20/2006 Re: 2006 Third Quarter Report During the third quarter of 2006, 1 received a letter expressing concern regarding trail conditions at Rancho San Antonio after winter rains. The writer was concerned the trail conditions were dangerous for hikers and runners. I referred the concern to staff. Michael. Newburn and the maintenance supervisors met with the letter writer to understand his concerns. The staff agreed to take corrective action. The matter was closed. The letter writer was appreciative of the efforts taken to address his concerns. In my last report, I suggested that the number of reports I submit to the Board be reduced from 4 times a year to 2 times a year. My suggestion is based on the volume of inquires I have received since the first of the year. If the Board accepts this suggestion, I propose that it take effect on January 1, 2007. Joyce Ombudsperson Midpeninsula Regional Open Space District t Regional Open Space MIDPENINSULA REGIONAL OPEN SPACE DISTRICT R-06-125 Meeting 06-26 October 25, 2006 AGENDA ITEM 2 AGENDA ITEM Response to the Midpeninsula Regional Open Space District's Pe ce Officers' Association (MRPOA) Presentation GENERAL MANAGERS RECOMMENDATIONS 1. Direct staff to work with MRPOA on issues which are identified as being appropriate for a staff-level response. 2. Accept the recommendations for policy-related issues as identified in this report and direct staff to work on the issues requiring follow-up activities. BACKGROUND The Mid peninsula Rangers Peace Officer Association MRPOA is an association of peace p g (MRPOA) officer employees of the District who are also members of the Peace Officers Research Association of California(PORAC). In November 2005 three members of MRPOA met with the General Manager, the Assistant General Manager and the Operations Manager to share concerns regarding Ranger safety and other issues. The meeting was very productive, with the Association members sharing specifics, acknowledging management for actions already taken to improve safety, and expressing additional ideas for the District to consider in the future. The members also requested an opportunity to express their ideas directly to the Board of Directors. The General Manager agreed to arrange for such a meeting. Due to various scheduling issues for both MRPOA members and the District, the May 10th meeting was the first opportunity for this presentation (see report R-06-12). R-06-125 Page 2 DISCUSSION During the presentation, MRPOA members presented verbal and written materials, which are summarized in the lists below. Many of the issues which were raised are most appropriately addressed at the staff level, but some issues are policy matters which do require attention from the Board. To ensure that the safety concerns have been fully understood and addressed, the General Manager, Assistant General Manager and the Operations Manager will meet with the leadership of MRPOA to discuss further issues before developing a response and action plan as suggested in the second bulleted item below. Currently there are a number of different methods for communicating between managers, supervisors and staff, and for suggesting ideas for changes and improvements. These processes have been successful in addressing many issues. Encouraging communications through the existing chain of command, and staff committees, will help to ensure that all involved have a structured method to have concerns heard and ideas exchanged. The issues raised by MRPOA were divided by management into administrative issues and Board policy issues. Administrative issues are identified as appropriate for response by staff and policy issues are necessarily reviewed by the Board. Administrative Issues • There should be a clearer definition of the District's role as a provider of emergency medical treatment and clarification of the agency's status in relation to the counties' emergency medical systems. • A committee, comprised of a Board member, manager(s) and field staff should be convened to address issues raised at the May 10, 2006 meeting. • Better signage, especially about dogs and bicycles, should be provided at preserve entrances to reduce the number of violations and to assist in prosecutions. • Posting more "No Parking After Hours," signs in areas where people frequently enter the preserves after hours would enhance officer safety and increase deterrence. • Completion/implementation of the Ranger Operations Manual was slow. • Better communication is needed with other law enforcement and emergency response agencies at the command and supervisory level. • Patrol trucks could be better marked (colored reflective striping) to enhance night time visibility. • The radio dispatch system needs to be integrated with systems from other agencies so the location of rangers could be displayed along with locations of emergencies. • Staffing levels should be re-evaluated especially in light of extended travel times. R-06-125 Page 3 • Staffing levels should be set so that there is a minimum of four patrol staff for each late shift. • An independent review should be done of the District's training of staff. Martinelli & Assoc. was recommended for this purpose. • Further training is needed on Incident Command System (ICS), and there is a lack of fire leadership training for supervisors. • There is a need for a Field Training Officer(FTO) Program. Policy Issues The following issues were identified by management as policy issues which require Board attention (staff recommended action is also proposed): 1. Enabling legislation and the scope of peace officer authority need to be clarified. Also there is a need to review the source of the rangers' authority to ensure that the correct code is being referenced. Recommended Action: Direct District General Counsel to re-submit the request to the Attorney General to clarify the scope of District Rangers' authority, since the Del Mar case has now been resolved. Note that this action is already in process. 2. The design of the District logo (patch) should be changed to modernize it and to better reflect the District's mission. Recommended Action: Staff has no specific recommendation regarding the patch (and logo). If the Board wishes to direct staff consider a re-design of the patch, then the work should be evaluated along with other priorities in the 2007/2008 work plan. 3. Extended response times for police/sheriffs (frequently 45minutes to over I hour) continue to raise concerns about staff safety. Recommended Action: Direct staff to research and report back to the Board on the length of time from the initial call for an armed "fill"unit to the time of arrival of the unit where calls were requested over the last two years. Once quantitative information has been provided to the Board, then develop an action plan to identify areas where specific problems are occurring and make further recommendation to address response times for those areas. 4. Public perceptions are that rangers are armed. Rangers would be safer with firearms. R-06-125 Page 4 Recommended Action: Re-affirm the Board's prior direction not to arm the ranger staff(see report R-99-22) and reinforce the Board's determination that staff should continue to maintain a low-profile law enforcement approach. 5. Staff would be safer if a rifle was available to deal with vicious animals/mountain lion attacks. Recommended Action: Re-affirm the Board's prior direction not to arm the ranger staff and direct staff to continue to work cooperatively with armed wildlife agencies when necessary. 6. The radio system needs to be improved especially in the Bear Creek area. FCC mandated changes need to be planned for and implemented. Recommended Action: Direct staff to continue with planning for necessary radio improvements, extended coverage for the Coastal Protection Area, and for compliance with Federal Communications Commission legal requirements. Direct staff to return to the Board in a timely manner, so that any necessary radio system upgrades can be considered as part of the 2007/2008 budget preparation process. Staff therefore recommends canceling the Regular Board meetings on November 8, 2006 and November 22, 2006 and recommends scheduling Special Meetings of the Board of Directors for Wednesday,November 15, 2006 and Wednesday,November 29, 2006, anticipating a number of agenda items for these meetings. The second meeting in December falls on December 27, 2006, which is scheduled during the holiday closure for administrative office staff. DISCUSSION Sections 1.80 through 1.83 of our Rules of Procedure call for the Board President to appoint Board members to our existing Standing and Ad Hoc Committees and to outside committees, with consent of the Board. At the January 25, 2006 Board Meeting, the Board approved my recommended committee proposals which included assignment of Director Deane Little to the following committees: Use and Management, Real Property and the La Honda Master Plan Ad Hoc Committee. Director Little resigned from the Board on August 11, 2006, and Curt Riffle was appointed to the Board on October 9, 2006. It is now time to appoint him to the appropriate committees. My recommendation is to have Curt Riffle serve on the Use and Management and Real Property Standing Committees. Regarding the La Honda Master Plan Ad Hoc Committee, per our Rules of Procedure, I have served on this Committee in Director Little's place for the past two months. For the benefit of continuity, it is my preference and staff s recommendation that I continue to serve on this Committee for the remainder of the committee proceedings. The Madonna Creek Uplands Addition encompasses 359 acres of ridge tops,hillsides, and watershed lands in the middle of an undeveloped expanse of coastal mountains in Northern San Mateo County. d Mills Creek to the south and overlooks the City of This property is bordered by Madonna Creek to the north an Half Moon Bay and coastal lowlands. The watersheds of Madonna Creek are extremely important spawning grounds and nursery streams for the federally threatened steelhead trout, as well as home to the red-legged frog. Protection of this key riparian corridor and the surrounding ridges will allow the District the opportunity to play an important role in the restoration efforts now underway to enhance steelhead habitat downstream in both the Pilarcitos Creek and Arroyo Leon watersheds. This 359-acre addition to the Mills Creek Open Space Preserve would create an opportunity for connecting trails in the area to include Burleigh Murray Ranch State Park, and future Public Parks and open space lands. A road and trail network that extends through the property and adjacent open space lands will likely provide a major link in a regional trail that will someday connect the planned Bay Area Ridge Trail and the California Coastal Trail. On September 13th another cyclist was cited for this offense. In late August five had also been cited for the same offense. 4 A man was contacted at Horseshoe Lake in Skyline Ridge and issued a citation for smoking. This is a time of year when high fire danger exists. 6 Two people were contacted at the Upper Stevens Creek County Park trailhead across from the Hickory Oaks trailhead of Long Ridge. They were smoking marijuana. A Santa Clara County ranger and county deputy were requested. Both suspects were issued citations. 8 A person at Thormewood was cited for having a mini-dirt bike in the preserve. He was with three friends. He said he had pushed the bike into the preserve. 10 Rangers investigated a report of off-road motorcycles in the Loma Prieta Ranch area of Sierra Azul and were able to locate and detain the motorcyclists. One man had a no-bail warrant arrest out of San Mateo County. A Santa Cruz County deputy was requested. Due to the extended response time a Santa Clara County deputy and a CHP officer also responded. All three motorcyclists were cited for off-road vehicles, and one was arrested for the outstanding warrant. 16 Two pickup trucks could be seen parked on the former POST Mirarnontes Ridge property at Mills Creek. There appeared to be dog cages in the truck beds. Dogs could be heard barking in the canyon below. It is believed that the suspects were deer hunting. The suspects left the area after sunset, shortly after being observed. They exited via nearby private property roads. Contact was not attempted due to remoteness and difficult access for fill units. 16 An OST at Rancho San Antonio County Park received a report of a person down near the tennis courts. Two rangers evaluated the hiker. Initially he was unconscious and unresponsive. The victim's friend reported that the patient had said that: he had been bitten or stung by something, had complained of pain, and needed to support himself After walking a few steps, he then collapsed. The hiker was transported by ground ambulance to El Camino Hospital. 19 Two rangers observing with binoculars saw three men wearing bright orange hunting vests in the Miramontes Ridge area of Mills Creek. They were standing next to vehicles with dog cages in the back. Dogs could be heard within the preserve. Shortly after sunset they called their dogs and left the preserve. 19 A neighbor near Skyline Ridge reported hearing shots, perhaps near Horseshoe Pond. Rangers responded and heard a couple distant shots. Poaching is suspected, but no hunters or associated cars were located. 21 The Santa Clara County Marijuana Eradication Team eradicated a marijuana cultivation site at Picchetti Ranch. Prior to the eradication, observation cameras were stolen and some of marijuana buds were harvested. The site has been cleared, but still needs to be cleaned up. 22 A man was injured by his own radio controlled model airplane at Rancho San Antonio County Park. He was working on the airplane in the back of his truck. The wind caught the canopy of the plane, causing it to hit the radio transmitter, which caused the plane's motor to turn on full throttle. The man instinctively grabbed the plane at the propeller, resulting in severe lacerations on his hands. He was transported by ground ambulance to Kaiser in Santa Clara. 23 A person at Windy Hill was cited for smoking. This occurred during a Red Flag Warning, indicating high fire danger. The person was standing in dry grass. 23 A large block of frozen chicken parts was discovered near the Alpine Road pullout at Russian Ridge. In the past this has been associated with illegal feeding of coyotes. 25 A wildfire was ignited in Russian Ridge. A contractor driving a grader, working on a District project, reported seeing a truck driver smoking at the origin point of the fire. When the fire began, 2 the trucker was seen leaving the scene at the origin point. The contractor acted quickly, cutting around the fire with the grader while District staff came in with the water tanker. Ranger staff and CDF responded. All information regarding the trucker was given to CDF. The fire was extinguished and contained to approximately 1/2 acre. 28 The Santa Clara County Marijuana Eradication Team and CAMP eradicated two separate sites in Sierra Azul, netting 2,334 plants. The plants were transported to the landfill for disposal. 28 A wildland fire of an unknown origin started on a property north of Fremont Older. CDF and Santa Clara County Fire responded. District rangers assisted the fire crews with access to the fire location. The fire burned approximately two acres. 29 Law enforcement agencies established an Incident Command staging post at Monte Bello in the Adobe Creek area, for the removal of approximately 10,000 marijuana plants valued at five million dollars. A helicopter was used to sling-load out plants from several gardens located on the border of the preserve and Hidden Villa. Environmental damage is associated with these garden operations. 29 Three individuals and four horses were stung by yellow jackets while on Hamms Gulch trail in Windy Hill after a horse stepped on a yellow jacket nest. One of the stung individuals had a more severe reaction. A District ranger contacted the party by cellular telephone and recognized the potential severity of the person's reaction and called for fire and medical response. The patient was transported by ground ambulance to the hospital. A pest control company removed the nest that evening. The Madonna Creek Uplands Addition encompasses 359 acres of ridgetops, hillsides, and watershed lands in the middle of an undeveloped expanse of coastal mountains in northern San Mateo County. The Madonna Creek Uplands Addition borders the 960-acre Preserve and overlooks the city of Half Moon Bay and coastal lowlands. Madonna and Nfiramontes creeks border the property to the north and south, respectively. The watersheds of Madonna Creek are extremely important spawning grounds and nursery streams for the federally- e to the red-legged frog. Protection of this key riparian corridor and threatened steelhead trout, and also serve as a home the surrounding ridges will afford the District the opportunity to play an important role in ongoing restoration efforts to enhance steelhead habitat downstream in both the Pilarcitos Creek and Arroyo Leon watersheds- Additionally, acquisition of this property would protect a key section of coastal ridgeline, providing a primary wildlife corridor for deer and mountain lion moving back and forth between the coastal lowlands and San Francisco Watershed Lands. The Madonna Creek property also boasts recreational assets that warrant protection. Aside from creating an opportunity for connecting trails between the Preserve, Burleigh H. Murray Ranch State Park, and future public park and open space lands, it contains a road and trail network that extends through the property and adjacent open space that will likely provide a major link in a regional trail that will someday connect the planned Bay Area Ridge Trail to the California Coastal Trail. These factors make the acquisition and preservation of the Addition a high priority for the District and the public, and I urge you to ensure that the property is permanently protected by helping to fund this project.
