A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LYNWOOD DENYING A CONDITIONAL USE PERMIT WITHOUT PREJUDICE
TO OPERATE A SENIOR CITIZEN'S RESIDENTIAL
FACILITY AT 12519 ATLANTIC AVENUE, LYNWOOD,
CALIFORNIA
The City.Council of the City of Lynwood does hereby find, re-
solve and determine as follows:
SECTION 1. The City Council, having had submitted to it the
appeal of Sam Menlo Enterprises requesting a conditional use permit
pursuant to Sec 25 -22.7 of the Lynwood Municipal Code for the estab-
lishment of a senior citizen's residential facility on that certain
real property as described in the report of the Planning Commission
on the 9th day of February, 1982, does hereby find and determine as
follows:
SECTION 2 . A public hearing was held before the City Council
on this appeal on the 16th day of March, 1982;
SECTION 3. The City Council does hereby find that said appli-
cation for Conditional Use Permit should be denied for the following
reasons:
1. Applicant has failed to show that the requested
use will not jeopardize, adversely affect, or be
detrimental to the public health, safety and
welfare or to surrounding property and residents.
2. Applicant has failed to show that the proposed
conditional use permit meets the principles and
standards specified in Sec,25, -22.7 of the zoning
ordinance.
3. That the proposed conditional use will not comply
with the minimum requirements for landscaping open
space and parking of the R -3 '(Multi- Family Re -'.
sidential) zone;
4. That the applicant is presently operating a similar
facility to the proposed conditional use at another
location in the City, without a City license.
SECTION 4. A certified copy of this resolution shall be mailed
to applicant.
