HomeMy Public PortalAboutOrd. 865 - Omnibus Code Amendment - Title 8 - CA-08-06&07ORDINANCE NUMBER 865 AN ORDINANCE OF THE CITY OF McCALL, VALLEY COUNTY, IDAHO AMENDING McCALL CITY CODE SECTION TITLE 8, TO ENABLE THE ROAD NAMING AND SITE ADDRESSING STANDARDS AS THE NEW STANDARDS FOR ROAD NAMING. WHEREAS, an application for approval of a code amendment, pursuant to MCC 1-1-3, was submitted by the City of McCall on September 23, 2008; and WHEREAS, the Community Development Department is the City office authorized to assign and change road names and addresses as part of administering roads within the City of McCall; and WHEREAS, the code amendment would change road naming standards and procedure; and WHEREAS, McCall City Code 8-6, which contain the City's addressing and road naming procedures, is outdated and in need of revisions; and WHEREAS, the City of McCall has determined that it is in the best interest of the citizens of McCall and Impact Area to update the address regulations in Title 8, Chapter 6 to ensure that road names and addresses are unique and consistent and that signage for road names and addresses are uniform and visible; and WHEREAS, the purpose of this Resolution is to enhance easy and rapid location of structures by law enforcement, fire protection services, search and rescue, and emergency medical services to protect public health and safety of all persons living, working or visiting in the City of McCall and Impact Area; and WHEREAS, the McCall Area Planning and Zoning Commission held a properly noticed and regularly scheduled public hearing on November 4, 2008 to consider the proposed code amendment; and WHEREAS, the McCall Area Planning and Zoning Commission recommended the proposed Code Amendment for approval by the McCall City Council at the November 4, 2008 meeting; and WHEREAS, the City Council held a properly noticed and regularly scheduled public hearing on January 8, 2009 to consider the proposed code amendment; and WHEREAS, the proposed code amendment was approved by the McCall City Council at a regularly scheduled and properly noticed meeting on February 12, 2009. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MCCALL, IDAHO, AS FOLLOWS: Ordinance Number 865: Omnibus Code Amendments Page 1 of 7 February 12, 2009 Section 1: McCall City Code Section 8-6-020 is amended to read as follows: 8-6-020: DEFINITIONS: CHIEF: The Fire Chief of the City and the Police Chief of the City, either or both. COUNCIL: The City Council of the City of McCall. CUL DE SAC: A dead end street that provides a turnaround at its terminus. It may be named with 1+e stiffx GetifE Placo MANAGER: The City Manager of the City of McCall, or his designee assigned from time to time to administer this Chapter. OFFICIAL STREET MAP: The "Official Street Map of the City of McCall, Valley County, Idaho", as the same may be amended in accord with this Chapter. OFFICIAL STREET NAME LIST: The Official Road Name List maintained by Valley County pursuant to its Ordinance 2-90, as it may be revised from time to time, together with the City Official Street Name List, a list containing the official street names of streets within the City of McCall to be maintained by or under the direction of the Manager, which shall consist of all names having been given official recognition by Council, whether by plat, ordinance, resolution, Official Street Map or otherwise. PLANNING COMMISSION: The McCall Area Planning and Zoning Commission established under Title III of this Code. SHALL: The requirement stated is mandatory. STREET: Any road, alley or other platted and/or traveled way within the City limits of the City of McCall; shown on a plat of a subdivision; or shown on the Official Street Map; or shown on the so-called "Marsden" series of maps kept at City Hall; or used by the public and worked and kept up at the expense of the public as provided in Idaho Code section 40-109(5); or shown on some combination of the foregoing; and also private roads as such term is understood in the subdivision context under Title III of this Code. "Street" may also be used as a suffix for the name of a street within an urbanized area, as more specifically set out below. TRANSPORTATION COMMITTEE: The City of McCall Transportation Committee established under Title I of this Code. Section 2: McCall City Code Section 8-6-040 is amended to read as follows: 8-6-040: STANDARDS FOR STREET NAMES: Ordinance Number 865: Omnibus Code Amendments Page 2 of 7 February 12, 2009 (A) The City of McCall Road Naming and Site Addressing Standards following standards shall be used in determining and approving street names=. The Road Naming and Site Addressing Standards shall be adopted by the Council and may be amended by the Council as needed from time to time. 1. There shall be no duplication of street names by sound or spelling within the City of McCall, nor shall a street name within the City of McCall so duplicate any road name on the Valley County Official Road Name List, unless such name is assigned to one continuous road of the same name both inside and outsidc thc City. 2. Where a proposed street is in the same general alignment as an existing street and is a functional extension of that existing street, the proposed street shall be given the name as thc existing street. A proposcd street shall bc considered in general alignment with an existing street if their extended center lines are no more than one hundred fifty feet (150') 3. Where a proposcd street connects two (2) cxisting streets with different names, all three (3) being on the same general alignment, the Manager shall determine the name, giving consideration to thc length of each street segment, thc classification of each segment as an arterial, collector, or minor street; the length of time each has been known by its cxisting or common name; and thc number of persons affected. 1. A cul dc sac with an overall length of one hundred feet (100') or less shall bc given the same name, but with the appropriate designation, as that of the street it intersects or extends. A cul dc sac with an overall length of more than one hundred feet (100') shall be given its own name, with the appropriate designation. 5. A proposed street in the same alignment with an existing street shall be given the same name as thc cxisting street, but with thc appropriate designation. b. Both segments of a L shaped street shall-Isc given thc same name, if and only if both or the shorter leg is one hundred feet (100') long or less. All others shall have two (2) 7. If the Manager determines that a strcct makcs a very obvious change in dircction, a new street name shall be assigned. The location of the name change should be at an intersection. 8. In general, road names should bc not more than ten (10) letters long, plus the designation. 9. The names of existing streets as of April 21, 199d, shall not be considered changed by this Chapter until, if ever, thereafter expressly changed by action under this Chapter. Avenue: A street generally running in a straight line, of collector status. 2. Boulevard: A street of arterial status, commonly with a center dividing landscaped 3. Circle: A street which returns back to the same street from which it originated. 'I. Court: A cul de sac running generally north and south. Parkway: A strcct of arterial status, commonly with landscaping. 8. Place: A cul do sac running generally cast and west. 9. Street: A strcct which runs generally north and south. Section 3: McCall City Code Section 8-6-050 is amended to read as follows: 8-6-050: PRIVATE ROADS: (A) Private roads shall be named in like fashion as public roads, both procedurally and substantively. Private roads shall have the record notation "P" placed beside their names on the City Official Street Name List. (B) The City shall have maintenance and replacement responsibility for signs for private roads only at their intersections with private public roads. Nevertheless, private road signs shall conform to Section 8-6-070(E) except that such signs shall indicate private road status by adding "PVT" at the end of the street name and designation. Section 4: McCall City Code Section 8-6-070 is amended to read as follows: 8-6-070: CHANGES IN STREET NAMES: (A) The Chief and/or the Public Works Director are encouraged to apply, and any affected citizen may apply, to the Manager to change a street name where the name fails to conform to this Chapter the City of McCall Road Naming and Site Addressing Standards, or it is otherwise deemed appropriate and in the public interest to make a change. If the applicant is not the Chief or the Public Works Director, the application must state the willingness of the applicant to pay for all new signage required to effect the change, if approved, and the Ordinance Number 865: Omnibus Code Amendments Page 4 of 7 February 12, 2009 approval shall not become final unless cash equaling the City -estimated cost of signage is deposited with the City. (B) Where the application is by the Chief and/or the Public Works Director and for the stated purpose of eliminating duplication of street names conforming to the City of McCall Road Naming and Site Addressing Standards, the Manager shall determine the street name(s) to be changed, and, using the procedure in the Standards, the name to which each is to be changed. The Manager shall consider the length of each street, the classification of each segment as an arterial, collector or minor street; the length of time each has been known by its existing or common name; and the number of persons affected, and any other factor deemed relevant by her or him. (C) The Manager shall then present the matter to the Transportation Committee for comment at its next meeting; thereafter the matter shall be referred with such comments to the Commission and in turn to the Council under the procedures of Title III with respect to the approval of special or conditional uses, except that those entitled to notice shall be those owning improved residential or commercial property fronting on the street the name of which is proposed to be changed. A failure to give such notice to any one or more persons entitled to it shall not affect the validity of the change, provided such failure occurred in good faith. The applicant is responsible to furnish the list of persons to be notified. If the number of addresses to be notified exceeds seventy five (75), in lieu of mailed notice under Title III, the matter may be noticed by public advertisement in the City's newspaper of record which clearly identified the affected streets and their location in the community by an appropriate map, and advises of the proposed name change(s). (D) (C) All changes shall be made in such a manner as to create the least possible inconvenience to residents and property owners in the area, considering the reasons for the change. A change proposed to eliminate a duplication of street names shall not be disapproved, although the Commission and the Council may consider alternative names which do not already appear on the Official Street Name List. No change shall become effective until fifteen (15) days after the final action by the Council, which action shall be by resolution. All persons owning improved property fronting on the street the name of which has been changed shall be given written notice of the change, after adopting of such resolution. A failure to give such notice to any one or more persons entitled to it shall not affect the validity of the change, provided such failure occurred in good faith. (E) All street name signs shall be located in such a manner as to be clearly visible to persons height and placed on a six inch (6") by "variable length" blank. All signs shall be reflectorized, in addition to having contrasting colors. All street name signs shall be green, Shall have the names lettered or both side ara "hat be sit one that the r e sthle from bot Section 5: McCall City Code Section 8-6-080 is amended to read as follows: Ordinance Number 865: Omnibus Code Amendments Page 5 of 7 February 12, 2009 8-6-080: VARIANCES AND APPEALS: (A) The standards for a variance from the provisions of this Chapter are those set out in Title III with respect to a variance under the Zoning Ordinance. (B-} (A) Appeals from decisions of the Commission shall follow the procedures of Title III for an appeal of a Commission action under Title III. (Ord. 660, 4-14-94) Section 6: McCall City Code Title 8, Chapter 7 is amended to read as follows: Chapter 7 NUMBERING SYSTEM; LOTS, BUILDINGS AND STRUCTURES 8-7-1: HOUSE NUMBERING REQUIRED: All lots, buildings and structures in the City shall be numbered in accordance with the City of McCall Road Naming and Site Addressing Standards. The Road Naming and Site Addressing Standards shall be adopted by the Council and may be amended by the Council as needed from time to time. following plan: North and south numbers shall commence at Dcinhard Lane. East and west numbers shall commence at Mission Street. Odd numbers shall bc on thc cast and north sidcs of the streets. In thc business district and in the residential area of said City there shall be one number to every fifty feet (50') of frontage. 8 7 2: NUMBERS ON STRUCTURES: It shall bc the duty of thc owners and occupants of every structure in thc City to have placed thereon in a place visible from the street, figures at least three inches (3") high, showing the number of thc structure, and any person, firm or corporation failing to so number any housc, building or structure occupied by him, or if after written notice to do so from the Chief of Police shall continue in his failure so to number such housc, building or structure, shall bc guilty of a misdemeanor and punishable as hereinafter set forth. 8 7 3: DELECATION OF AUTHORITY: The Chief of Police of the City is hereby authorized and directed to establish a system of numbering of houses, structures and buildings in accordance with thc provisions of this Ordinance Number 865: Omnibus Code Amendments Page 6 of 7 February 12, 2009 Police shall designate an appropriate number to any such house, building or other structure. 8 7 4: CHART: The Chief of Police of the City shall keep a chart showing the proper street number of every lot in the City, which shall be open to inspection by anyone interested. 8-7-52: PENALTY: Any person, firm or corporation violating the provisions of this Ordinancc the City of McCall Road Naming and Site Addressing Standards shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not to exceed three hundred dollars ($300.00) or by imprisonment in the County jail not to exceed ninety (90) days or by both such fine and imprisonment. Approved: By aft B Kulesza, or Attest: Ordinance Number 865: Omnibus Code Amendments February 12, 2009 Page 7 of 7 A SUMMARY OF ORDINANCE NO. 865 PASSED BY THE CITY OF McCALL, IDAHO AN ORDINANCE OF THE CITY OF McCALL, VALLEY COUNTY, IDAHO AMENDING McCALL CITY CODE TITLE 8, TO ENABLE THE ROAD NAMING AND SITE ADDRESSING STANDARDS AS THE NEW STANDARDS FOR ROAD NAMING; AND TO PROVIDE FOR AN EFFECTIVE DATE. This ordinance amends Title 8 of the McCall City Code regarding road naming and site addressing standards, to the below sections: 8.6.020: is amended to delete irrelevant definitions. 8.6.040: is amended to provide that the City of McCall road naming and site addressing standards shall be adopted by Resolution of the City Council. 8.6.050(B): is amended to clarify that city maintenance and replacement responsibility for signs for private roads is only for the signs at the intersection of the private road with a public road. 8.6.070: is amended to provide that changes in street names shall use the City of McCall Road Naming and Site Addressing Standards. 8.6.080: is amended to provide that appeals from decisions of the Planning and Zoning Commission related to commission action shall follow the procedures of Title 3 for that appeal. Title 8, Chapter 7 is amended to require that all lots, buildings and structures in the city must be numbered in accordance with the City of McCall Road Naming and Site Addressing Standards, as they may be adopted or amended by the Council from time to time, and deleting irrelevant sections, and clarifying the violation of the standards is a misdemeanor. The Ordinance shall be effective upon its passage, approval and publication as required by law.
