Director Hanko Is Voluntarily Recusing Herself From Voting On The AT&T And Verizon Claims, Page 3 of 3 i Midpeninsula Regional • ' Open Space District R-09-17 Meeting 09-03 January 28, 2009 AGENDA ITEM 3 AGENDA ITEM Report by the Legislative, Funding, and Public Affairs Committee on Commemorating the Victims of the "Resolution"Airplane Crash. LEGISLATIVE, FUNDING AND PUBLIC AFFAIRS COMMITTEE RECOMMENDATION Direct District staff to install Christopher O'Donnell's plaque commemorating the victims of the "Resolution" airplane crash. DISCUSSION At its December 3, 2008 meeting,the District's Legislative, Funding and Public Affairs Committee (LFPAC)heard a suggestion by Christopher O'Donnell to honor the victims of the October 29, 1953 crash of the Australian passenger plane "Resolution," in what is today El Corte de Madera Open Space Preserve, by installing a plaque he created to commemorate the tragic events of that day. Mr. O'Donnell has asked the Board in the past to place a plaque near the crash site,but the Board instead decided to name a trail in the preserve after the Resolution and to place information materials about the accident in the signboard at El Corte de Madera. The reason for the Board's decision was that the placement of such a monument near the crash site, in the middle of the preserve, was deemed problematic by District staff who were concerned that the central preserve location might lead visitors to go off trail looking for the remaining parts of the airplane. As the Board knows, visitors are allowed to go off trail in all District preserves except El Corte de Madera, where they must stay on the trail in order to protect gains made by the District's ongoing, multi-year Watershed Protection Program to restore the environment and repair hundreds of years of damage caused by road construction, mining, and timber harvests. The Watershed Protection Program is designed and carefully calibrated to protect threatened species, such as the steelhead trout and coho salmon, which have experienced dramatic population declines primarily due to habitat loss from damaging practices of the past. Both Mr. O'Donnell and Grant Tischler, the Australian son of one of the crash victims, agree with staff that keeping people away from the actual crash site is critical in order to keep disturbances in the preserve to a minimum. t R-09-17 Page 2 of 2 While protecting the natural environment in El Corte de Madera remains the first priority of both staff and the Board, LPFAC believes that there is a way to satisfy both Mr. O'Donnell's request to install a plaque and the District's need to protect El Corte de Madera's fragile ecosystem. After consulting with District staff, LFPAC recommends installing Mr. O'Donnell's plaque at the entrance of the Methuselah trail on Skyline Boulevard., rather than in the middle of the preserve. The Committee also agreed with staff that the plaque should be attached to a stone rather than placed in a signboard. LPFAC believes that mounting Mr. O'Donnell's plaque at the entrance of the Methuselah trail would be a fitting way to commemorate the 19 victims of the worst aviation accident in San Mateo County's history while ensuring that El Corte de Madera's fragile ecosystem can be restored and threatened species have a chance to recover. FISCAL IMPACT Cost of purchasing and attaching the plaque to a stone. PUBLIC NOTICE Mr. O' Donnell has been notified of this agenda item. No other public notification is required. CEQA COMPLIANCE No environmental review is required as it can be seen with certainty that this plaque will not have a potentially significant impact on the environment. Prepared by: Rudy Jurgensen, Public Affairs Manager Contact Person: Legislative, Funding and Public Affairs Committee R Midpeninsula Regional ' ( Open Space District R-09-09 Meeting 09-03 January 28, 2009 AGENDA ITEM 4 AGENDA ITEM Appointment of District Representatives to the Governing Board of the Midpeninsula Regional Open Space District Financing Authority PRESIDENT'S RECOMMENDATION Approve the President's appointments of Directors Hassett and Siemens to serve on the Governing Board of the Midpeninsula Regional Open Space District Financing Authority along with the by-laws required Board President and Treasurer assignments. DISCUSSION The Governing Board of the Midpeninsula Regional Open Space District Financing Authority consists of five (5) members. In accordance with its by-laws, the District's Board President shall serve as the Chairperson of the Financing Authority and the Treasurer of the District shall serve as the Treasurer of the Authority. The President appoints two additional members each year from the remaining members of the Board of Directors. The President is recommending that Directors Hassett and Siemens be appointed as the two Authority members. The fifth member is the member of the Santa Clara County Board of Supervisors whose district encompasses the greatest territoryof the District, and who is appointed to the Financing Authority by the Board of Supervisors Chairperson. Accordingly, Supervisor Liz Kniss will remain as the fifth member. 4 f Article II of the FinancingAuthority's by-laws calls for four 4 officers: Section 2. o tY Y ( ) Chairperson, Secretary, Treasurer and Controller. As discussed above, the Board President and Treasurer shall automatically serve as the Authority Chairperson and Treasurer respectively. The Controller of the Authority shall be the District Controller Mike Foster. The Secretary is the District Clerk, Greg Sam. The Authority must confirm these officers at its first meeting each calendar year and will do so at its next scheduled meeting. FISCAL IMPACT None. PUBLIC NOTICE None required. Sam, Administration and Human Resources Manager Contact person: Nonette Hanko, Board President c ' IMidpeninsula Regional Open Space District R-09-08 Meeting 09-03 January 28, 2009 AGENDA ITEM 5 AGENDA ITEM Appointment of Standing and Ad Hoc Board Committee Members for 2009 PRESIDENT'S RECOMMENDATION Approve the President's recommendations for appointments to the Board Standing and Ad Hoc Committees, appointments as Board representatives to other bodies, and termination of Ad Hoc Committees whose tasks have been completed as contained in this staff report, including the determination of compensation status for attendance at Board Committee meetings. DISCUSSION The Board of Director's Rules of Procedure Sections 1.80 through 1.83 call for the President to appoint Board members to annual Standing and Ad Hoc Committees and to represent the District on outside bodies, with consent of the Board. The four(4)current Board Standing Committees consist of: 1. Administration and Budget Committee (ABC) 2. Legislative, Funding and Public Affairs Committee (LFPC) 3. Use and Management Committee (U&M) 4. Real Property Com mittee p Y Following the Board's Rules of Procedure, Director Riffle (Board Treasurer) will be assigned as one of the three members of the Administration and Budget Committee. The six (6) Board Ad Hoc Committees from last year consist of: 1. General Manager Recruitment Committee 2. General Manager's Retirement Event Committee 3. Board Appointee Evaluation Committee 4. La Honda Master Plan Committee 5. Sierra Azul/Bear Creek Redwoods Master Plan Committee R-09-08 Page 2 of 2 Staff recommends keeping the Board Appointee Evaluation, La Honda Master Plan, Sierra Azul and Bear Creek Redwoods Master Plan Committees for 2009, and eliminating the General Manager Recruitment and General Manager Retirement Event Committees, which were created for two specific purposes that have since been completed. Section 2.30 of the Board's Rules and Procedure states that all Standing Committees are compensable. Compensability for attendance at Ad Hoc Committee meetings is determined on an annual basis by the Board. It is recommended that attendance at all Board Ad Hoc Committee meetings be compensable. The two outside bodies, the Bay Ridge Trail Council and California Joint Powers Insurance Authority (CaIJPIA), are proposed to remain non-compensable. The proposed committee assignments for 2009 are shown in the attachment. The President looks forward to the Board's consideration and anticipated concurrence of the proposed appointments. DISCUSSION At the Special Board meeting on January 10, 2009,the Board discussed improving the effectiveness of communication among Board members and staff, including working relationships between the two groups. At the meeting, the Board requested that item number 10 of the District's"GUIDELINE FOR BOARD-STAFF WORKING RELATIONSHIPS"be amended as shown below in underlined text: 10. Management team and the Board will set a positive example of Board-staff relations for public and staff. Staff is following up on the Board's request to implement the Guideline changes. General 1. Board members may go to any staff member for information. If information request requires more than minimal staff time, the request should be made to the General Manager or Department Manager who shall confer with the General Manager. 2. Board members are encouraged to give staff sufficient lead time to fulfill Board requests and to put important requests in writing. 3. Information (except trail conditions) provided from a Board member to staff should be routed through individual Department Managers or the General Manager. 4. If an individual Board member suggests that staff time be spent on a project not previously approved by the Board, he/she will contact the General Manager. The General Manager will then make an initial assessment of the project, evaluating its consistency with established goals and policies, effects on other projects, and availability of staff and financial resources. The General Manager will then communicate the information to the Board and obtain Board approval prior to proceeding with more in-depth assessment or proceeding with the project. 5. Management reports and recommendations to the Board should present areas of potential controversy and concern. 6. Board members and management will endeavor not to surprise each other with important information; if a Board member wants additional information or documentation on an agenda item, the Board member is encouraged to contact the General Manager before the Board meeting. The General Manager will advise Board members when he/she feels that any Board member is attempting to direct the administration of the District. 9. Any Board member will advise the General Manager when he/she feels staff is attempting to direct or set Board policy. 10. Management team and the Board will set a positive example of Board-staff relations for public and staff. 11. Board members and staff will respect each other's personal time. 12. Board members may serve in District volunteer programs under the same terms and Y p g conditions as any member of the volunteering public. When volunteering, they agree to conduct themselves as would any other member of the volunteering public. They will accept all direction from staff members organizing the volunteer activity. The hiring process included extensive interviews, a background investigation, psychological exam and a nine- week ranger academy where they were trained as peace officers. The rangers will work to preserve and protect the District's 57,000 acres of public open space land. Rangers interact with preserve visitors providing interpretive and educational information, first aid, and law enforcement. They also patrol and maintain roads and trails, complete projects that enhance and restore the natural environment and work to prevent and sometimes fight fire. The District has two field offices, each with a staff of nine rangers. Trout will work from the Foothills field office serving the open space preserves in the Los Gatos, Saratoga and Cupertino areas. She has degrees in history,biology and ecology and worked as a journalist before joining the District. Gibbons and Pennington will work from the Skyline field office and cover District lands in the Skyline and Coastside areas. Gibbons has a degree in biology and interned with the National Park Service where he studied big cats and other wildlife. Pennington holds degrees in park management and business administration and has experience in interpretation, maintenance, resource management and visitor services through his work with the Santa Clara County parks. Cecily Harris was sworn in as the newest elected official on the Midpeninsula Regional Open Space District's Board of Directors. She was elected in November by voters in El Granada, Half Moon Bay, Montara, Moss Beach, Redwood City, San Carlos and Woodside. The District is divided into seven geographic wards each represented by a board member elected to a four-year term. Harris replaces Director Ken Nitz, who served on the District's Board for three consecutive terms. Harris, a San Carlos resident, is a Financial Services Manager with the San Mateo County Parks Department and served nine years as a San Carlos Parks and Recreation Commissioner. She is interested in single and multiple use trails, interpretive programs, and natural resource protection. Santa Clara County Sheriff's deputies were summoned and the rangers found the suspect in the Lexington County Park, Miller Point Picnic Area. The suspect was arrested for possessing a prescription drug without a prescription. 17 A call was received from Mountain. View dispatch at 8:45pm stating that an equestrian was overdue/hiiissing, and believed to be in Purisima Creek OSP. The caretaker did not have permission to take the horse, and was unfamiliar with the trails. San Mateo Sheriff's Department was notified and a California Highway Patrol helicopter flew over the preserve until the weather conditions prevented further flyovers. The equestrian was located on the Grabtown Gulch Trail at 11:44pm, and escorted out of the preserve. 18 A ranger performing surveillance on a section of fence that had been repeatedly cut at Rancho San Antonio County Park observed a suspect grabbing and shaking the same j section of fence that had been repaired. The suspect was cited for being in a closed area. i The"Closed Area" sign was later determined to be missing. 20 In Sierra AZlll OSP a ranger and the contract deputy discovered three juveniles engaged in illegal trail construction in a section of grassland near Jaques Ridge. All three suspects were cited and their parents were called to pick up their children. 25 In the pullout on Mt. Umunhum Road a ranger discovered a vehicle had been high- centered. A District ranger called in to assist located the driver while en route and brought him to the scene. The suspect was issued a written warning for after—hours use, and defacement of signs. A tow truck was called and took the vehicle and the driver to the rental agency where he had rented the vehicle. 27 At Rancho San Antonio County Park, a ranger discovered a radio-controlled helicopter and two cases in the field near the upper parking lot with no apparent owner in the vicinity. After waiting several minutes for the owner to return the ranger picked up the items. A man returned and began yelling at the ranger and accusing him of stealing the items. The ranger tried to explain that he was collecting the equipment for safekeeping so it wouldn't be damaged or stolen, but the subject continued yelling and using profanity. Santa Clara County Sheriff's deputies were called and interviewed the subject, then asked him to leave. A campfire was discovered at the main house. The combo lock on the log cabin had been cut. Upon entering the cabin, the OST heard a noise and left. Near the cabin he found a long rifle near a tree.
