HomeMy Public PortalAboutMIN-CC-2013-12-10MOAB CITY COUNCIL REGULAR MEETING December 10, 2013 The Moab City Council held its Regular Meeting on the above date in the Council Chambers at the Moab City Center, located at 217 East Center Street, Moab, Utah. Mayor David L. Sakrison called the Pre -Council Workshop to order at 6:30 PM. In attendance were Councilmembers Jeffrey Davis, Kyle Bailey, Doug McElhaney, Gregg Stucki and Kirstin Peterson; City Manager Donna Metzler and City Recorder/Assistant City Manager Rachel Stenta; Planning Director Jeff Reinhart, Police Chief Mike Navarre, Public Works Director Jeff Foster, Community Development Director David Olsen, City Engineer Rebecca Andrus and Administrative Analyst/Economic Development Coordinator Kenneth F. Davey. Mayor Sakrison made a presentation to Councilmember Davis thanking him for his 12 years of service on the City Council. Mayor Sakrison called the Regular City Council Meeting to order at 7:00 PM and led the pledge of allegiance. Fourteen (14) members of the audience and media were present. Councilmember Peterson moved to approve the Regular Council Meeting Minutes of November 12, and the Special Meeting Minutes of November 21, 2013 as corrected. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. There were no Citizens to Be Heard. A Community Development Department Update was not given. An Engineering Department Update was not given A Planning Department Update was not given. A Police Department Update was not given. Under Public Works Department Update Public Works Director Foster distributed photos of the Rotary Park sport court project. The Fiscal Year 2012-2013 Annual Audit was Presented by Jon Haederlie of Larson and Associates. Discussion followed. December 10, 2013 REGULAR MEETING & ATTENDANCE PRESENTATION TO COUNCILMEMBER DAVIS REGULAR MEETING CALLED TO ORDER APPROVAL OF MINUTES CITIZENS TO BE HEARD COMMUNITY DEVELOPMENT UPDATE ENGINEERING UPDATE PLANNING UPDATE POLICE UPDATE PUBLIC WORKS UPDATE AUDIT PRESENTATION Page 1 of 6 Mayor Sakrison opened a public hearing on the Solicitation of Potential Projects for Community Development Block Grant (CDBG) Small Cities Program for Program Year 2014 at 7:22 PM. PUBLIC HEARING OPENED Planning Director Reinhart spoke on behalf of Community Development STAFF COMMENTS Director Olsen and stated the following: The grant money must be spent on projects benefiting primarily low and moderate income persons. Planning Director Reinhart further explained, the South Eastern Utah Association of Local Governments of which Moab City is a member is expected to receive approximately $250,000 in this new program year and that Moab City would potentially be competing with four counties for that funding. Planning Director Reinhart continued that all eligible activities that can be accomplished under this program are identified in the CDBG Application Policies and Procedures Manual and interested persons can review it at any time. Planning Director Reinhart stated that high priority projects include low to moderate income housing, food banks, water projects and sewer projects and that no activity will displace low to moderate income individuals. Planning Director Reinhart listed several CDBG grant projects that the City has administered: Cinema Court infrastructure, reroofing and replacing HVAC units at the Virginian Apartments, replacing the existing 10" diameter water transmission line, Center Street Ballpark bleachers, fencing and lighting , installing the East Center Street median and sidewalks, building the Moonstone Gallery mini park, improving the Virginian Apartments, tuck pointing mortar and landscaping at Star Hall, building Sun Court, developing the Mill Creek Flood Control and Parkway Project, buying property for the Seekhaven Family Crisis Shelter, providing financial assistance for the Grand County Housing Authority Affordable Housing Project, installing Rotary Park playground equipment and paths, installing the 400 East tree medians and paying for surveying and City digital mapping. Planning Director Reinhart provided copies of the City's project priority list. Planning Director Reinhart stated that parts of the project list, housing plan and general plan are included in the regional "Consolidated Plan" and that the list and plans show which projects the City has identified as being needed in the community. The Mayor asked that anyone with questions, comments or suggestions during the hearing please identify themselves by name before they speak. No public comment was given. December 10, 2013 Page 2 of 6 Community Development Director Olsen stated that the Housing Authority of South Eastern Utah had submitted a letter requesting a renovation project of an upgrade to the HVAC system, re -roofing and handrails for the Virginian Apartments for approximately 12 units. Mayor Sakrison closed the public hearing at 7:29 PM. Councilmember Bailey moved to approve a Request by Theresa King for Special Use of Swanny City Park on May 24 and 25, 2014. Councilmember McElhaney seconded the motion. The motion carried 5- 0 aye. Councilmember Stucki moved to approve a Special Business Event License for the Moab Arts Festival Inc., to Conduct an Arts Festival on May 24 and 25, 2014. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. Councilmember Davis moved to approve a Class IV Special Event Beer License for Michael Miller, d.b.a. Moab Brewery to Conduct a Beer Garden on May 24 and 25, 2014 at Swanny City Park. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. Councilmember Davis moved to approve a Park Alcohol Permit for Moab Brewery on May 24 and 25, 2014 at Swanny City Park and Approval of Local Consent for a Single Event Alcohol Permit for Moab Brewers LLC on May 24 and 25, 2014 at Swanny City Park. Councilmember McElhaney seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve a Special Business Event License for Seekhaven Inc., to Conduct Puttin' on the Ritz Fundraising Event on February 15, 2014 at the Grand Center. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve a Class IV Special Event Beer License for Jaylyn Hawks, d.b.a. Seekhaven Inc. to Conduct a Fundraising Event on February 15, 2014 and Approval of Local Consent of a Single Event Alcohol Permit for Seekhaven Inc. on February 15, 2014. Councilmember Davis seconded the motion. The motion carried 5-0 aye. Councilmember Stucki moved to approve a Waiver of Fees by Seekhaven Inc. in an Amount Not to Exceed $180.00 — Excluding the Class IV Special Event Beer License. Councilmember Bailey seconded the motion. The motion carried 5-0 aye by a roll -call -vote. December 10, 2013 PUBLIC HEARING CLOSED SPECIAL USE OF SWANNY CITY PARK FOR MOAB ARTS FESTIVAL, APPROVED SPECIAL BUSINESS EVENT LICENSE FOR ARTS FESTIVAL, APPROVED SPECIAL EVENT BEER LICENSE FOR MOAB BREWERY, APPROVED PARK ALCOHOL PERMIT FOR MOAB BREWERY, APPROVED SPECIAL EVENT BUSINESS LICENSE FOR SEEKHAVEN, APPROVED SPEICAL EVENT BEER LICENSE FOR SEEKHAVEN, APPROVED WAIVER OF FEES FOR SEEKHAVEN, APPROVED Page 3 of 6 Councilmember Peterson moved to Accept the Fiscal Year 2012-2013 Annual Audit. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember McElhaney moved to approve the Community Development Block Grant (CDBG) Small Cities Program Project for Program Year 2014 for Renovation at the Virginian Apartments. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. FISCAL YEAR 2012-2013 AUDIT ACCEPTED 2014 CDBG PROJECT APPROVED Councilmember Bailey moved to Approve Proposed Resolution #22-2013 RESOLUTION #22-2013, — A Resolution Endorsing The Efforts of the Moab City Economic APPROVED Development Office To Renew The Utah Enterprise Zone In Moab. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to Approve Proposed Resolution #23-2013 — A Resolution Designating Depositories For Moab City Funds. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Stucki moved to appoint Councilmember McElhaney as the Mayor Pro-Tem for 2014. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to appoint Councilmember-Elect Heila Ershadi as the Councilmember Responsible for Approving Bills in 2014. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to Approve the 2014 Regular City Council Meeting Schedule with the deletion of the December 23 meeting. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember McElhaney moved to Approve the 2014 Moab City Holiday Schedule. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. December 10, 2013 RESOLUTION #23-2013, APPROVED MAYOR PRO-TEM FOR 2014 APPOINTED COUNCILMEMBER RESPONSIBLE FOR APPROVING BILLS IN 2014 APPOINTED 2014 REGULAR CITY COUNCIL MEETING SCHEDULE, APPROVED 2014 MOAB CITY HOLIDAY SCHEDULE, APPROVED RESOLUTION #21-2013, Page 4 of 6 Councilmember Peterson moved to Approve Proposed Resolution #21- 2013 — A Resolution Accepting the Public Improvements Constructed in Association with the Planned Unit Development Known as "Mill Creek Village Planned Unit Development" and Authorizing the Release of the Performance Guarantees Associated with Said Improvements. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to Table a Relinquishment of a Sanitary Sewer Easement from AJB Holdings, LLC, Located at 236 North 100 West. Councilmember Bailey seconded the motion. The motion to Table carried 5-0 aye. Councilmember Davis moved to Approve a Class II Retail Beer License for John R. Huff, d.b.a. LaHacienda Restaurant Located at 574 North Main Street. Councilmember McElhaney seconded the motion. The motion carried 5-0 aye. Councilmember Davis moved to Approve Local Consent of a Full -Service Restaurant Liquor License for John R. Huff, d.b.a. LaHacienda Restaurant Located at 574 North Main Street. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. There were no Mayor and Council Reports given. There was no Correspondence to be Read. Under Administrative Report, City Manager Metzler stated that the City Christmas Party would be on December 14. City Manager Metzler then stated that staff was preparing for the mid -year budget opening process. A Report on City/County Cooperation was not given.
