CITY OF TIFFIN ORDINANCE NO. 2016-390
AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY
OF TIFFIN, IOWA, FROM R-4 TO R-1A FOR CERTAIN PROPERTY
KNOWN AS TIFFIN HEIGHTS - PART THREE, LOT 109, TIFFIN,
JOHNSON COUNTY, IOWA, AND AS LEGALLY DESCRIBED HEREIN
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose. The purpose of this ordinance is to amend the
official zoning map of the City of Tiffin, Iowa, concerning property locally
described as Tiffin Heights - Part Three, Lot 109, Tiffin, Johnson County,
Iowa, attached hereto and incorporated herein.
Section 2. Amendment. The following legally described
property:
Tiffin Heights Part Three,Lot 109
REZONE PARCEL FROM R-4 TO R-IA
BEGINNING AT THE NORTHWEST CORNER OF LOT 109 OF TIFFIN HEIGHTS -PART THREE,
TIFFIN,IOWA,IN ACCORDANCE WITH THE PLAT THEREOF RECORDED IN PLAT BOOK 60,
AT PAGE 40,IN THE RECORDS OF THE JOHNSON COUNTY RECORDER'S OFFICE;THENCE
N61°22'15"E,ALONG THE NORTH LINE OF SAID LOT 109,A DISTANCE OF 643.22 FEET;
THENCE S28 037'45"E,ALONG SAID NORTH LINE,60.00 FEET;THENCE N61 022'15"W,ALONG
SAID NORTH LINE,60.00 FEET,TO THE NORTHEAST CORNER THEREOF;THENCE
S28 037'45"E,ALONG THE EAST LINE OF SAID LOT 109,A DISTANCE OF 423.09 FEET,TO THE
SOUTHEAST CORNER THEREOF;THENCE SOUTHWESTERLY,284.01 FEET,ALONG THE
SOUTH LINE OF SAID LOT 109 AND AN ARC OF A 967.00 FOOT RADIUS CURVE,CONCAVE
NORTHWESTERLY,WHOSE 282.99 FOOT CHORD BEARS S80 030'32"W;THENCE
SOUTHWESTERLY,283.00 FEET,ALONG SAID SOUTH LINE AND AN ARC OF A 1033.00 FOOT
RADIUS CURVE,CONCAVE SOUTHEASTERLY,WHOSE 282.12 FOOT CHORD BEARS
S81 004'27"W;THENCE S73 013'33"W,ALONG SAID SOUTH LINE,298.93 FEET,TO THE
SOUTHWEST CORNER THEREOF;THENCE N01 000'55"W,ALONG THE WEST LINE OF SAID
LOT 109,A DISTANCE OF 263.84 FEET,TO SAID POINT OF BEGINNING,CONTAINING 6.14
ACRES AND SUBJECT TO EASEMENTS AND RESTRICTIONS OF RECORD.
shall be changed from zoning classification R-4 TO R-1A (Multi-Family 3
or 4 Plex to Single Family) and further, that the official zoning map of the
City be amended to reflect the change described herein.
Section 3. Supplemental Agreement. This ordinance includes the
attached supplemental agreement.
Section 4. Repealer. All ordinances or parts of ordinances in
conflict with the provisions of this Ordinance are hereby repealed.

Section 5. Severability. If any section, provision, or part of this
ordinance shall be adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the ordinance as a whole, or
any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section 6. Effective Date. This ordinance shall be in effect after
its final passage, approval, and posting as provided by law.
On the 20th day of September 2016, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Bartels introduced Ordinance No. 2016-
390, and moved that it be given its first reading. The motion was seconded by
Councilperson Havens.
Ayes: Havens, Kahler, Upton, Bartels, Ryan
Nays: None.
Five members of the Council being present and having voted "Aye", Mayor
Steve Berner declared the motion carried, and Ordinance No. 2016-390, was
read the first time, discussed, and placed on record.
On the 4th day of October 2016, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Havens introduced Ordinance No. 2016-
390, and moved that it be given its second reading. The motion was seconded
by Councilperson Ryan.
Ayes: Kahler, Ryan, Havens, Bartels, Upton.
Nays: None.
Five members of the Council being present and having voted "Aye", Mayor
Steve Berner declared the motion carried, and Ordinance No. 2016-390, was
read the second time and discussed and placed on record.
On the 18th day of October 2016, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Bartels introduced Ordinance No. 2016-
390, and moved that it be given its third and last reading. The motion was
seconded by Councilperson Ryan.
Ayes: Kahler, Ryan, Havens, Bartels, Upton
Nays: None.
Five members of the Council being present and having voted "Aye", Mayor
Steve Berner declared the motion carried, and the ordinance was passed and
adopted.

Whereupon the Mayor declared that Ordinance No. 2016-390 be adopted and
signified his approval of same by fixing his signature thereto. Passed by the

Council on the 18th day of October 2016 and approved by the Mayor on the
19th day of October 2016.

an ordinance entitled AN ORDINANCE AMENDING THE OFFICIAL
ZONING MAP OF THE CITY OF TIFFIN, IOWA, FROM R-4 TO R-1E FOR
CERTAIN PROPERTY KNOWN AS TIFFIN HEIGHTS - PART THREE, LOT
109, TIFFIN, JOHNSON COUNTY, IOWA, AND AS LEGALLY DESCRIBED
HEREIN, and known as No. 2016-390 was duly passed by the Council on the
18th day of October 2016, and signed by the Mayor on the 18th day of
October 2016, and published on the 20th day of October 2016, by posting
copies thereof in three public places within the limits of the City of Tiffin,
Iowa. That I posted copies of Ordinance No. 2016-390 in the following places:
