HomeMy Public PortalAboutResolution 70-387 PC" RESOLUTION NO. 70 -387PC RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING A VARIANCE IN ZONE VARIANCE CASE NO. 70-322. IIIThe Planning Commission of the City of Temple City does resolve as follows: SECTION 1. That the Planning Commission does hereby find, deter- mine and declare as follows: (a) That the owners of certain real property located in the City of Temple City, County of Los Angeles, State of California, located at 6211 -6213 North Oak Avenue in said City, more particularly described as Lot 2, parcel 3, Block "L ", Santa Anita Land Company's Tract, Book 6, page 137 of Maps in the Office of the County Recorder, County of Los Angeles, State of California ill have heretofore filed an application for a zone variance to expand an existing dwelling unit on a nonconforming R -2 lot; and (b) That the Planning Commission conducted a duly noticed public hearing on such application, that said hearing was duly closed; and (c) That based upon the evidence adduced at said hearing, the Planning Commission files and applicable staff reports, and each mem- ber of the Commission being familiar with the proposed site, said Commission determines that the facts required by Section 9201 of the Temple City Zoning Ordinance were present and therefore the zone vari- ance application should be granted. SECTION 2. That the zone variance application hereinabove de- scribed be and the same is hereby granted subject to the following condi- tions: (a) That the development of subject property shall be substantially in accordance with the plot plan marked Exhibit "A "; and (b) That all applicable City regulations shall be complied with; and (c) That this variance shall expire and be of no effect unless exercised within a period of one year from and after the date of adoption of this resolution; and (d) That applicant shall file, or cause to be filed, with the City Clerk, a document which the City may record, which shall ack- nowledge that the owner of the subject property is aware of and accepts the conditions set forth in paragraphs (a) through (c) above, and that the subject property, regardless of any change in ownership, is bound by and subject to the provisions of the resolution granting the variance and the conditions contained therein. 1 " RESOLUTION NO. 70 -387PC PAGE TWO SECTION 3.
