A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD'IN OPPOSITION TO CALIFORNIA
STATE SENATE BILL 965.
WHEREAS,. the City of Lynwood is committed to the support
of environmentally sound and cost effective solid waste management
facilities in Los Angeles County, including transfer stations,
refuse- to- energy.facilities, and landfills; and
WHEREAS, California State Senate Bill 965 has been
introduced in the California State Senate which would eliminate
the expansion of existing solid waste management facilities or
siting of'new facilities and could jeopardize'the continued
operation of existing solid waste management facilities in Los
Angeles County within one mile of a residential structure, regard-
less of environmental control and documentation or economic
consequences; and
WHEREAS, the siting of solid waste facilities is a
matter appropriate to local control, so long as that control
is required to be exercised in an environmentally -sound and
responsible manner; and
WHEREAS, the Senate Bill 965 is unnecessary in that
existing State law, Section 66784.1 of the Government Code,
requires that the County in which a facility is located make a
finding that ".::..:.'.the distance of residents from the site
is sufficient to permit adequate control of noise levels, odor
nuisances, traffic congestion, litter nuisances and vectors'4,, and-
WHEREAS, the potential fiscal impact of Senate Bill 965 is
excessive and could exceed $1.5 billion per year as a direct
result of long distance haul to remote areas of Los Angeles County.
NOW THEREFORE, the City Council of the City of Lynwood
does.hereby find, determine, order and resolve, as follows:
Section 1. That the City does hereby express its total
opp6sition to California Senate Bill 965.
Section 2 . That a copy of this.resolution be forwarded
to Governor George Deukmejian,. Lt.'Governor'_Leo T. McCarthy, 11
Controller Kenneth Cory, Treasurer Jesse M.,Unruh, Members of
the Senate Finance Committee, and other Members of the California
Legislature.
Section 3 . This resolution shall take effect'iff6ediately
upon its adoption.
