HomeMy Public PortalAbout83-064 (06-07-83)RESOLUTION NO. 83 -64 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD OVERRULING PROTESTING AND ORDERING THE LEVYING OF ANNUAL ASSESSMENTS FOR THE EXISTING LYNWOOD LANDSCAPE MAINTENANCE DISTRICT FOR FISCAL YEAR 1983 -84 WHEREAS, the City Council of the City of Lynwbbd did, on the 19th day of April, 1983, adopt its Resolution No. 83 -40 proposing the annual assessment for the Landscape Maintenance District and directing the Director of Public Works /City Engineer to prepare a report in connection therewith, and WHEREAS, the Director of Public Works /City Engineer ' did,. on the 17th day of May, 1983, submit a report in relation to said District pursuant to the provisions of the "Landscape and Lighting Act of 1972" .(Part 2 of Division 15 of the Streets and Highways Code of the State of California), and WHEREAS, the City Council did, on the 17th day of May, 1983, adopt Resolution No. 83 -55 approving,the Engineer's Report herein mentioned and declaring its intention to levy and collect assessments within said District and fixing the time and place for a hearing on the matter of said District. WHEREAS, evidence has been received as to the pub- lication and posting of notice of said hearing in the time, form and manner required by law; NOW, THEREFORE, the City Council of the City of Lynwood DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE as follows: SECTION 1 . Each and all of the recitals set forth hereinabove are true and correct. SECTION 2 . The protests submitted, if any, do not represent property owners owning more than 50 percent of the area of assessable lands within said district, and said protests are hereby overruled. SECTION 3 . That this City Council hereby confirms the diagram and sets the assessment at $0.803 per foot of front footage for each lot. The adoption of the Resolution shall constitute the levying of the assessments in connection therewith for Fiscal Year 1983 -84. SECT 4 . The City Clerk is hereby authorized and directed to forthwith file a certified copy of said diagram and assessment with the County Auditor. SECTION 5. The City Clerk is hereby further authorized and directed to file a statement as described in the Government Code Section 54900 and following with the County Assessor immediately after the adoption of this resolution. Director of Public Works /City Engineer 11330 Bullis Road Lynwood, California, 90262 r� REVISED ENGINEER'S REPORT THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL CITY HALL, LYNWOOD, CALIFORNIA LANDSCAPE MAINTENANCE DISTRICT OF THE CITY OF LYNWOOD Gentlemen: Pursuant to the Resolution No. 83 -40, adopted by your Honorable Body on aprii 19, 1983, I have prepared the ENGINEER's REPORT required by the Landscaping and Lighting Act of 1972, as amended, (being Division 15, Part 2, Streets and Highways Code of the State of California). The proposed special assessment proceedings contemplate the levying of an assessment for providing the necessary funds to maintain, operate, and improve the Landscape Maintenance District of the City of Lynwood, hereafter referred to. The levy will be against those parcels of land within said district bene- fiting from the proposed improvements, as required by law. THE ENGINEER'S REPORT Pursuant to Division 15, Part 2, of said Landscaping and Lighting Act of 1972, as amended, it is required that an Engineer's Report be prepared and filed with the City Clerk, who in turn presents it to the City Council for its consideration. The said Engineer's Report consists of the following: 1. DIAGRAM AND PLAN NO. 1978 -L SPECIFICATIONS The Lynwood Landscape Maintenance District was first formed and assessments first levied in 1978 following the passage of Resolution No. 78 -78 by the City Council. The plans and specifi- cations for the District are on file with the City Clerk and Director of Public Works /City Engineer. The district is diagrammed on the attached map and information on particular parcels is located on the Assessor's Maps. Briefly, the following services were provided for the residents of Lynwood by funding provided by the Landscape Maintenance Assess- ment District. LANDSCAPE MAINTENANCE CITY PARK (39 acres) Mowing, edging, weeding, irrigation, restroom maintenance, painting and fence repair. Also trash pick -up. June 7, 1983 Revised Engineer's Report Page 2 JOHN HAM PARK (10 acres) Mowing, edging, weeding, irrigation, painting and restroom maintenance. Also trash pick -up. CIVIC CENTER (3 acres) Mowing, edging, irrigation, trash pick -up and sweeping down walks. STREET MEDIANS (Long Beach Blvd., 15,000 square feet; State Street, 1' miles; Imperial Highway, 1,700 square feet) Mowing, edging, irrigation, trash pick -up, and eradicating pests. WATER WELLS (Six locations, 11750 square feet) Mowing, edging, weeding and irrigation. STREET ISLANDS (3 locations, 3,100 square feet) Mowing, edging weeding and irrigation. L.S.C. YARD (640 square feet) Mowing, edging, weeding and irrigation. 1. ESTIMATE EXPENDITURES 83 -84 EST. Tree Maintenance $241,500 Park Maintenance 220,100 Subtotal $461,600 Landscape Fund Estimated.Surplus from 1982 -83 16,816 TOTAL AMOUNT TO BE ASSESSED $444,784 SAY $444,900 During the past five fiscal years, the Landscape Maintenance District e- pended more than its assessments. This is due in part to maintaining an assessment rate lower than required to support the district. The deficits have been carried over to the next fiscal year and absorbed by the General Fund. On January 4, 1982, Council appropriated $100,000 from General Fund monies to the Landscape Maintenance Account, in order to establish a level of service consistent with the prupose of the Landscape Maintenance District. At that time, staff recommended that at least $170,000 annually be budgeted for tree maintenance in order to maintain that level of service. Staff is now recommending that the assessment rate be set at a rate that will make the Landscape Maintenance District self - sufficient. DISTRICT DESCRIPTION AND REVENUES There are approximately 9,963 parcels of property, with approximately 554,137 front footage within the City of Lynwood, excluding parcels of public property, the cost of which is not included in the district. ASSESSMENT ROLL Pursuant to said Landscaping and Lighting Act of 1972, as amended, the "Diagram and assessment roll so filed with the County Auditor, Page 4 Revised Engineer's Report June 7, 1983 the description of the properties on the map books of the County Assessor for the then current year, "shall be used in these proceedings." In compliance with the above statute, copies of the County Assessor's Map and the County Tax Collector's tax rolls were used in this Revised Engineer's Report. The assessment roll, for each parcel of land therein, shows the legal description; the County Assessor's code numbers; the assessable footage used in calculating the assessment against each individual parcel and the grand total assessment levied. All parcels of land in said district were included in two zones of benefit as set forth hereinabove. The foregoing Revised Engineer's.Report, which.includes PLAN and DIAGRAM NO, 1978 -L, ASSESSMENT ROLL and the ESTI_MATE OF COSTS, is presented herewith for your approval by resolution.
