I 5 1 "3/o AN ORDINANCE OF THE CITY OF JEFFERSON , MISSOURI, AUTHORIZING THE MAY OR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH J.C. INDUSTR IES, INC., FOR THE MISSOUR I BOULEVARD SIDEWALK PROJECT. WHEREAS , J .C. Industries, Inc., has become the apparent lowest and best bidder on the Missouri Boulevard Sidewalk project. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI , AS FOLLOWS: Section 1. The bid of J.C. Industries, Inc., is declared to be the lowest and best bid and is hereby accepted. Section 2. The Mayor and City Clerk are hereby authorized to execute an agreement w ith J .C. Industries, Inc., for the Missouri Boulevard Sidewalk project. Section 3. The agreement shall be substantially the same in form and content as that agreement attached hereto as Exhibit A. Section 4. This Ordinance shall be in full force and effect from and after the date of its passage and approval. We will return a fully executed copy to you. Please be aware the Project Development/Implementation Schedule (Exhibit B) in the program agreement. The PS&E approval deadline for this project is April I, 2013. It is not the responsibility of MoDOTto keep the entity informed as to the status of the project. The entity will keep MoDOT informed as to any delays and/or unforeseen conditions that may hinder the project's progress. Procedures outlined in the LPA Manual must be followed if the city elects to utilize federal funding for the preliminary engineering. Local agencies must use competitive negotiation for the procurement of engineering and design-related services on every project involving federal-aid highway funds. The Brooks Act and 23 CFR 172.3 must be followed if the local agency is seeking federal reimbursement for these services. The QBS process must include a public announcement, advertisement or other acceptable method that assures qualified in-state and out-of-state consultants are given a fair opportunity for consideration, which allows for a minimum two-week response time. It is recommended the local agency use the MoDOT Consultant Resources website to post the public announcement or advertisement (Fig. 136.6.7 Sample Solicitation). The solicitation form should be submitted to the appropriate MoDOT district representative. If the LPA wishes to use an altemative procedure to advertise and solicit qualifications f'or the RFQ, they must submit a written request with an advertising plan attached that complies with state and federal requirements. The advertisement plan must include advertisement of the availability in a major newspaper of general circulation. The notice may be advertised multiple times if desired. The advertisement plan should also identify and send the solicitation to organizations qualified to do specified work as well as professional societies and recognized DBE organizations. Project costs include construction of sidewalks along Missouri Boulevard from Heisinger Road to just east of Stoneridge Parkway in City of Jefferson. The engagement noted no questioned costs or findings. The total eligible and allowable costs for the project are $471,244.36. The Commission's obligation is $370,978.00. The city was reimbursed $370,978.00, resulting in no monies due to or from MoDOT. MoDOT's Financial Services Division has utilized the eligible and allowable costs discussed in this letter to calculate the final amount based on the federal share established for this project.
