Chairman Scrivner called the meeting to order at 7:30 a.m. A quorum was present at this
time. The following guests were present:
Representing Capital Region Medical Center: Nicholas Borgmeyer (Simon Oswald
Architecture); Sam Bushman, Ed Farnsworth, Tom Luebbering, Martin Grabanski, Jack Pletz,
Lorelei Riley Schwartz, and Jim Wisch. Representing Citizens for JeffTran: Paul VanHorn, Heidi
Lucas, Brian Wekamp, and Keith McGoian. Also, Glover W. Brown, Arthur H. Brown, Mike
Bates (CMPS), Kris Scheperle (All Seasons); Rockey Meo (Braik Brothers); Kim Roberts;
Willene Alley, Bill Alley, and Madeleine Leroux, News Tribune.
1) Introductions
Those present introduced themselves.
Chairman Scrivner explained to those present that the Committee would not be
discussing JeffTran issues at this meeting.
Councilman Bray moved and Councilman Schulte seconded to move Item 5.4 Capital
Region Medical Center to the top of the agenda, motion carried.
5) New Business
4. Capital Region Medical Center Expansion (Janice McMillan)
Mr. Grabanski gave a presentation on the project. He explained a demolition permit for
Doctors Park had been applied for at this time. The goal is to complete the project in 2015.
2) Approval of the May 22, 2013 Committee meeting minutes

Councilman Schulte moved and Councilman Bray seconded to approve the May 22,
2013 minutes, motion carried.
3) Citizen opportunity to address Council /Staff on Stormwater and Other Public
Works Issues
1. 439 Valley View Court (Bill Alley) (Don Fontana)
Mr. Fontana gave a presentation of the area during the last rain event.
There was discussion among Committee members, staff and those present regarding
emergency access and the flash flooding of the area.
Staff explained even if a culvert pipe was put in it would not improve the situation.
Mr. Smith explained there will be a change order going to the City Council to fix the pipe
in this location.
4) Old Business
1. Jefferson City Hangar Association Ground Lease Renewal (Bift Smith)
Mr. Smith requested this item be tabled to the July Committee meeting::
5) New Business
1. Approval of Yard Waste and Compost Contractor /Contract (Janice McMillan)
Ms. McMillan stated two pro - proposals were received and staff recommends All
Seasons for the contract.
There was discussion among Committee members and staff regarding the evaluations of
the proposals including experience, reliability and hours of service.
Councilman Bray moved and Councilman Branch seconded to refer the contract to the
City Council with recommendation to approve, motion carried.
2. Vacation of Alleyway at 501 Madison Street (Jefferson City School District) (Britt
Smith)
Mr. Smith explained the request stating the City would retain a utility easement within the
alley.
Councilman Schulte moved and Councilman Branch seconded to refer the vacation of
the alley to the City Council with recommendation to approve, motion carried.
3. Frog Hollow Right -of -Way Agreement (Jefferson City Public Schools) (David
Bange)
Mr. Bange explained the school district would like to table this item to a later date.
4. Stanley Mehrhoff Airport Ground Lease (Britt Smith)
Mr. Smith explained this is a renewal of the lease which expired in May.

Councilman Bray moved and Councilwoman Carroll seconded to refer the lease to the
City Council with recommendation to approve, motion carried.
S. Contract Proposal by Brown Family (Drew Hilpert)
Mr. Hilpert distributed a memo of understanding to Committee members.
There was discussion among Committee members, staff and the Brown's regarding the
proposal, benefits of the agreement, long term commitment, and possible uses of the property.
Councilman Scrivner requested this item be taken up at the July Committee meeting.
6. Accepting CDBG Grant for Program Year 2013 and 2013 Action Plan (Janice
McMillan)
Ms. McMillan explained additional funds had been received. Ms. Abbott described the
revised budget.
Councilman Branch moved and Councilman Schulte seconded to refer the request to the
City Council with recommendation to approve, motion carried.
7. Proposal for Parking Issues at Lincoln University (Britt Smith)
Mr. Smith explained this matter was reviewed by the Public Safety Committee and
referred to Public Works and Planning. At this time there is no parking on Chestnut Street
however Parking staff are routinely writing tickets in this area. He stated there are two options:
1) narrow the road with channelizes and concrete barriers known as jersey curbs which would
have a relatively low cost or 2) close the street with a pipe gate.
There was discussion among Committee members and staff regarding other options
including a tow away zone, leasing the area to LU, deputizing the LU parking staff, and possible
contract with LU.
Committee members requested staff discuss the situation with Lincoln University staff on
short term goals to alleviate the problems.
6) Other Topics
1) Planning & Protective Services Monthly Reports
Ms. McMillan referred Committee members to the report included in their packet.
• Councilman Scrivner requested something be done with the City seal in front of City Hall
and asked that staff look into this and bring a solution back to the next Committee
meeting.
7) Adjourn
Councilman Bray moved and Councilman Schulte seconded to adjourn the meeting at
this time (10:02 a.m.), motion carried.
MEMORANDUM OF UNDERSTANDING
FOR AN EVENTUAL
DEVELOPMENT AGREEMENT
THIS MEMORANDUM OF UNDERSTANDING FOR AN EVENTUAL DEVELOPMENT
AGREEMENT (this "Agreement ") is entered into as of , 2013, by and between the
CITY . OF JEFFERSON CITY, MISSOURI (hereafter referred to as the ACity @), Arthur and Daisy
Brown, Charles and Shirley Brown, and Donald and Joyce Webb (collectively Arthur Brown, Daisy
Brown, Charles Brown, Shirley Brown, Donald Webb, and Joyce Webb are hereafter referred to as
"Brown/Webb" /landowner), Larry D. and Janet B. Rademan (hereafter collectively referred to in. the
singular as "Rademan" /landowner) and Ed and Mary M. Rackers (hereafter collectively referred to in
the singular as "Rackers" /landowner).
WITNESSETH
WHEREAS Brown/Webb, Rademan and Rackers are the owners of Tracts A, B & C,
respectively on the attached map identified as exhibit A, attached hereto;
WHEREAS, Brown/Webb, Rademan, and Rackers desire that the City include in Sales Tax G
the construction of Mission Drive as conceptually shown on exhibit A, although all parties realize the
actual location and size ma y � va -

WHEREAS, the City desires, the annexation of said Tracts A, B, and C and orderly development
of the area shown on the attached map.
WHEREAS, this City Council sees the development of Mission Drive as a project to be
included in Sales Tax G so long as the conditions of this agreement are met.
NOW, THEREFORE, the City and landowners hereb y agree ree as follows:
1. Not a binding agreement but a statement of intent. This document -confirms the parties
mutual intention with respect to the potential actions and considerations described herein. This
document, in and of itself, does not represent an enforceable legal contract but provides the
terms the parties may enter into at a future date.
2. Authority. All parties affirmatively state that they have the power to execute this document
and have the authority to carry out the obligations of this agreement and bind their property,
organization (if applicable), and their heirs.
3. Obligations of the City. The City shall:
a. Include in Sales Tax G sufficient funds for the construction of Mission Drive as
determined by the City Engineering Staff from the east edge of Tract A and through the
West edge of Tract C.
b. Include a reference to the construction of Mission Drive in any promotional material for
Sales Tax G that includes references to other specific projects.

C. Construct sewer main line extensions at locations determined to be most beneficial to
providing sewer service off the main line extensions at locations determined by City
Engineers after consultation with all the affected property owners.
d. Discuss with the Cole County Commissioners a cost share plan for said construction.
e. Not request any contribution from Brown /Webb, Rademan, and Rackers, that is not
already identified in this Agreement, for the construction of Mission Drive or any of its
related infrastructure, including sewer main lines extensions to serve Tracts A, B, & C.
f. Construct the sewer main line extensions prior to or during the same construction season
as Mission Drive.
Obligations of Landowners. The Landowners shall:
a. Voluntarily Annex Tracts A, B, and C into Jefferson City upon the City letting the
contract to construct Mission Drive. Once filed, Brown/Webb, Rademan and Rackers
may not withdraw the application or refuse to annex unless authorized to cancel the
agreement pursuant to the terms herein.
b. Right of way and easements.
i. Prior to beginning construction, deed or dedicate to the City the agreed upon right
of way for the construction of Mission Drive.
11. Prior to beginning construction, execute permanent sewer line easements to the
City as required by the approved and agreed upon plans.
111. Prior to beginning construction, execute temporary construction easements for
Mission Drive and sanitary sewer lines to the City as required by the approved and
agreed upon plans.
iv. All of the above deeds, dedications and easements will be provided at no cost to
the City, but will contain reversionary interest such that failure to initiate
construction within 18 months of passage of Sales Tax G, shall cause the right of
way and easements to revert back to the property owners.
C. Dedicate temporary construction easements and permanent utility easements to the City
adjacent to the Mission Drive right of way, as required for future utilities, free of charge.
d. The section reserved. The parties will discuss creation of a special development district
such as a TDD prior to execution of a binding agreement.
e. Private driveway access to Mission Drive will not be allowed without prior written
approval by the City. Street access shall be mutually agreed upon by the City and
landowners.

5. Plans and Specifications. Any plans for the development of Mission Drive or of tracts A, B, or
C including infrastructure development shall promptly be provided to the City.
6. Notices. Any notice, demand, or other communication required by this Agreement to be given
to any party hereto another shall be in writing and shall be considered sufficiently given or
delivered if dispatched by certified United States first class mail, postage prepaid, or delivered
personally to:

7. Termination. This Agreement may be terminated by any party, herein named by sending 30
days prior written notice upon the following causes and conditions:
a. This Agreement may be terminated by any party herein named prior to any vote by the
City Council to approve an election for Sales Tax G, by sending all parties notice of its
intent to terminate. Termination any party herein named constitutes termination of the
entire agreement.
b. Failure of the electorate of the City of Jefferson to pass Sales Tax G shall terminate all
obligations of this Agreement without further notice.
C. Failure of the County of Cole to agree to cost share the construction of Mission Drive
shall terminate all obligations of this agreement.
d. Failure of the City of Jefferson to proceed with the construction of Mission Drive, after
the construction contract for Mission Drive has been let, in accordance with the
established time frames as set out in the construction contract language. In addition to
all other remedies available pursuant to cancellation, Brown/Webb, Rademan, and
Rackers may withdraw any application to annex or refuse to annex.
8. Successors to be bound. All agreements to sell Tracts A, B, or C shall include provisions
which bind said successors to this Agreement.
9. Specific Performance. All parties acknowledge that a major inducement for the City to
construct Mission Drive is the annexation of Tracts A, B and C. Failure by any landowner(s)
to annex said tracts into Jefferson City limits upon the City meeting all its obligations under the

Development Agreement to begin construction of Mission Drive would result in damages to the
City which are uncertain and difficult if not impossible to calculate. In light of these
considerations, this being a matter involving real property, specific performance as to the
annexation is an appropriate remedy for the City in the event of such failure by any
landowner(s).
10. Choice of Law. This Agreement shall be taken and deemed to have been fully executed, made
by the parties in, and governed by the laws of the State of Missouri for all purposes and intents.
11. Entire Agreement /Amendment. This Agreement constitutes the entire agreement between the
parties and no other agreements or representations other than those contained in this Agreement
have been made by the parties. This Agreement shall be amended only in writing and effective
when signed by the authorized representatives of each party or parties.
12. Counterparts. This Agreement may be executed in multiple counterparts, each of which shall
constitute one and the same instrument.
13. Severability. If any term or provision of this Agreement is held to be unenforceable by a court
of competent jurisdiction, the remainder shall continue in full force and effect, to the extent the
remainder can be given effect without the invalid provision.
IN WITNESS WHEREOF, the parties have caused this Agreement to be executed by the parties their
respective officers or representatives.

Subject: Pavement Marking for West Edgewood Drive and West Stadium Boulevard
City Staff is recommending that the committee give its approval for the revised pavement marking
layout for W. Edgewood Drive and W. Stadium Drive as shown on the attached drawings.
This restriping arises from a number of actions that have taken place in the area over the last month.
Most notably are the addition of a right turn lane from southbound Stadium Boulevard to Westbound W
Edgewood, the overlay of West Edgewood from Stadium to Hwy 179, and a traffic signal optimization
study which was performed at the intersection of Stadium and Edgewood.
The combination of these factors has led to three main changes. These include the return of the left
only movement from the inside lane of eastbound W. Edgewood and a straight and right turn from the
outside lane. This is the lane arrangement which was used prior to being modified for the closing of
Hwy 179 for the construction of the Mission Drive overpass. Secondly a two way left turn lane is being
proposed along the length of the noted section of W. Edgewood, in a response to the traffic drawn into
the commercial development along the southern side of W. Edgewood. Lastly, the plan includes the
conversion of W. Stadium from a two lane section to a three lane section from Hard Rock Drive to
Edgewood in preparation for anticipated development.
The traffic counts on these roadways are approximately 10,000 vehicles per day on W. Edgewood and
11,000 vehicles per day on W. Stadium. A rule of thumb is that a three lane roadway section can
accommodate 15,000 cars per day. The traffic projections drawn from the MPO traffic forecasting
model do not indicted that this volume will be exceeded in the 20 year horizon.
Accident data was reviewed along Edgewood Drive and since 2008 there were thirteen accidents
reported. Of these accidents two almost certainly would have been avoided while two others potentially
could have been avoided with the addition of the proposed two way left turn lane.

Article I. Generally
■ Delete sections pertaining to fees (Sec 25 -2 and 25 -3) as these are referenced
elsewhere in the code.
Article 11 Street Names and Addressing Procedures (no changes)
Article Ill. Urban Redevelopment Through Private Capital Investment (no changes)
Article IV. Housing Rehabilitation Grant Guidelines
■ A completely new section will be drafted, pertaining to the City's administration
of the HUD Entitlement - Community Development Block Grant program.
Article V. Neighborhood Redevelopment
■ Codify all of the Old Town /Neighborhood Reinvestment Act Ordinances
( "Parts ") within Article V.
-- Ordinances No. 14296 and 14774, residential tax rebates; "Part One"
-- Ordinances No. 14507 and 14773, residential down payment, "Part Two"
-- Ordinance No. 13963, downtown fagade program, "Part Three," previously
codified in Chapter 17, Article XV, will be moved to Chapter 25.
