A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD RELATING TO THE DESTRUCTION OF RECORDS.
WHEREAS, the Community Development Director in the lawful
execution of his /her responsibilities has retained certain Rehabilita-
tion Program records which are no longer required, and
WHEREAS, the Los Angeles County Community Development Com -'
mission's-interpretation of the applicable program regulations issued
by the Federal Department of Housing and Urban Development (HUD)
permits the destruction of rehabilitation case records after the same
are no longer required, and
WHEREAS, Government Code 34090 permits the head of a city
department to destroy any city record, document, instrument, book or
paper under his /her charge, without making a copy thereof, after the
same is no longer required.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD does
hereby find, determine, resolve and order as follows
Section 1 . The records to be destroyed pursuant to the reso-
lution do not include records, the destruction of which is specifically
prohibited by Section 3.011 of the Auditor - Controller Contract Account-
ing and Administration Handbook..
Section 2 . The records to be destroyed pursuant to this reso-
lution do not include records, the destruction of which is specifically
prohibited by Government Code 34090, namely
(a) Records affecting the title of real property or liens
therein;
(b) Court records,
(c) Records required to be kept by statute,
(d) Records less than two years old; and
(e) The minutes, ordinances, or resolutions of the legis-
lative body of the City of Lynwood.
Section 3 . The consent of the City Attorney has been obtained
prior to the destruction of any and all city records pursuant to this
resolution.
Section 4 . The Community
of Lynwood and /or his /her designee
following records
Development Director of the City
is hereby authorized to destroy the
Non - financial records and all other records pertinent to
those "drop -out" (unasEisted). Rehabilitation cases which
have been kept on file for a pexibd in excess of three (3)
years from the actual dates said cases were closed.
Section 5 . The records referenced in Section 4 above to
be destroyed upon.adoption of this Resolution and upon the termina-
tion of each fiscal year thereafter until such time the Rehabilita-
tion Program ceases- _toq,be,•operational,
1983.
