HomeMy Public PortalAbout83-161 (12-12-83)RESOLUTION NO. 83 -161 V " RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD SUPPORTING LIBERALIZATION OF PROPOSITION A GUIDELINES TO ALLOW CITIES TO USE PORTIONS OF THEIR ALLOCATED LOCAL RETURN FUNDS FOR SUCH TRANSPORTATION PURPOSES AS THE REPAIR AND MAINTENANCE OF THOSE STREETS USED BY PUBLIC TRANSPORTATION VEHICLES. WHEREAS, Proposition A was approved by the voters of Los Angeles County to provide additional funds for transportation purposes throughout the County; and WHEREAS, these funds are administered by the Los Angeles County Transportation Commission (LACTC) an allocated to the cities on a specified formula, with the provision that the funds be used only and strictly for public transit systems; and, WHEREAS, many cities without municipal transit systems cannot use their-allocated funds strictly for this purpose, and either must market their funds as discount rates to other agencies that can use them for a public transit system, use their funds on transit programs of lesser importance, or lose the funds altogether; and, WHEREAS, the restrictions placed on the use of these funds are based on an administrative decision of the LACTC, and there is strong legal opinion that "public transit system includes streets and highways used by public transit vehicles, and that the wording of the proposition A ballot measure stating that local transit means "transit, paratransit and transportation systems manage- ment improvements that benefit one jurisdiction" and that "revenues can be used for capital or operating expenses" is language that is --------legally open to a broader interpretation than the LACTC has extended to it; and, WHEREAS, it has been well established that damage to our city streets is caused primarily by trucks and buses, and that passenger cars are responsible for an insignificant amount of pave- ment damage; and, WHEREAS, our cities without municipal transportation systems of their own are responsible for the repair and maintenance of their city streets that are used by public transit vehicles, thereby con- tributing heavily to the cost of maintenance and repair of those streets: NOW, THEREFORE, be it resolved: 1. That the City Council of the City of Lynwood hereby petitions the Los Angeles County Transportation Commission and strongly urges that the restrictions on the use of Proposition A funds be liberalized to allow cities to use Portions of their allo- cation of local return funds for such transportation purposes as the repair and maintenance of those streets used by public transportation vehicles so that such streets can be kept in good repair and continue to be used as part of the County transportation system, thereby more adequately fulfilling the intent of proposition A "to improve and expand existing public transit county- wide ". 2. That the City Clerk shall certify to the adoption of this resolution and submit copies to the County. officials. adoption. 3. This resolution shall take effect immediately upon its E 1983.
