Larson, being duly sworn, on oath says that he is the publisher or authorized agent and em- ployee of the publisher of the newspaper known as The South Crow River News and has full knowl- edge of the facts which are stated below: (A) The newspaper has complied with all of the requirements constituting qualification as a legal newspaper, as provided by Minnesota Statute 331.02, 331.06, and other applicable laws, as amended. Section 605 of the Medina Code of • Ordinances is amended by deleting the stricken material and adding the under- lined material as follows: CHAPTER 6 BUSINESS REGULATIONS AND LICENSES 605 GARBAGE WASTE DISPOSAL 605.01 Purposes. The City Council of Medina finds, determines and declares that if it is necessary and conducive for the protection of the public health, safety and welfare of the people of the City to provide regulations for the dumping and other disposal of garbage, refuse trash within the City of Medina. 605.03. Special Use Permit. It is unlaw- ful for any person, including those per- sons hauling or disposing of garbage or refuse, trash or other rubbish for a fee, to deposit or dispose of any garbage, trash or other refuse on any property in the City of Medina which is not properly zoned for that purpose. Section 605.05. Disposal of Yard Waste. It is unlawful for any person to dispose of any material other than yar waste in any site designated by the Ci for such purpose. It is unlawful for an person other than one whose principl place of residence is within the City o Medina to dispose of any material at any site designated by the City for the dis- posal of yard waste. For the purpose of this section, yard waste means leaves, grass clippings and herbaceous plant materials but does not include brush, tree parts or trimmings, other woody plant materials or other organic or inorganic materials. Any yard waste deposited at a site designated by the City for such pur- pose must first be removed from its bag or other container and the bag or other container must be disposed of properly. Section 605.07. Disposal of Woody Plant Materials. It is unlawful for any per- son to dispose of any materials other than woody plant material at any site desig- nated by the City for such purpose. It is unlawful for any person other than one whose principal place of residence is within the City of Medina to dispose of any material at any site designated by the City for the disposal of woody plant materials. For the purpose of this section, woody plant material includes brush or tree parts or trimmings but does not include tree stumps, lumber or construction materials. Section 605.09. Council Regulation of Sites. The city council may by resolution designate and regulate sites for the dis- posal of yard waste and woody plant materials. Section 605.11. Penalties. Any person convicted of a violation of Section 605.05 or 605.07 shall be guilty of a misde- meanor and shall be punishable by a minimum fine of $100. Section II. This ordinance shall be- come effective upon its adoption and publication. Adopted by the City Council of the City of Medina this 19 day of March, 1991. Gary M.
