LRA 80 -17 RESOLUTION OF THE LYNWOOD REDEVELOPMENT AGENCY APPROVING THE DRAFT Ae1ENDMENT TO REDEVELOPMENT PLAN FOR REDEVELOPMENT PROJECT AREA A, DIRECT- ING THE PREPARATION OF A DRAFT EIR, ESTAB- LISHING BASE YEAR FOR ALLOCATION OF TAXES, AU- THORIZING CERTAIN TRANSMITTALS BE MADE TO AND CONSULTATIONS BE HELD WITH AFFECTING TAXING AGENCIES, AND AUTHORIZING THE TRANSMITTAL OF VARIOUS DOCUMENTS TO THE PLANNING COMMISSION WHEREAS, the Lynwood Redevelopment Agency (the "Agen- cy") has prepared a draft amendment to the Redevelopment Plan for Redevelopment Project Area A (the "Redevelopment Plan Amendment "); and WHEREAS, the Redevelopment Plan Amendment meets the requirements of the Community Redevelopment Law (Health & Safe- ty Code Sections 33000, et sue.); and WHEREAS, the Redevelopment Plan Amendment will elimi- nate those conditions which have caused a reduction of, or lack of, proper utilization of the area to such an extent that the area constitutes a serious physical, social or economic burden on the community which cannot reasonably be expected to De re- versed or alleviated by private enterprise acting alone, NOW, THEREFORE, THE LYNWOOD REDEVELOPMENT AGENCY DOES HERESY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1 : The Redevelopment Plan Amendment for Re- development Project Area A attached hereto and incorporated herein as Exhibit "A" is hereby approved. SECTION 2 : The staff of the Agency is hereby autho- rized and directed to begin preparation of and to complete the Report to the City Council as the information and reports to be included therein become available, and to have said Report available for inspection at such time as the Notice of Joint Public Hearing on the Redevelopment Plan is published. SECTION 3 : The Executive Director, or other Agency official as may oe appropriate in the circumstances, is hereby authorized and directed to consult with each taxing agency which levies taxes or on behalf of which taxes are le- vied in the Project Area with respect to said Redevelopment Plan Amendment. SECTION 4 : The Agency finds that the Redevelopment Plan Amendment could have a significant effect on the environ- ment, and approves the Initial Study attached 'hereto as Exnioic "B" in support thereof. SECTION 5 : The Agency staff is hereby directed and authorized to complete preparation of the Draft Environmental Impact Report, and to take all steps necessary to proceed with the preparation of documents related thereto in accordance with the California Environmental Quality Act and the State and Agency EIR Guidelines. SECTION 6 : The Agency hereby directs that Notice of Preparation of EIR be prepared pursuant to 14 California Admi- nistrative Code Section 15083(d). SECTION 7 : The Secretary shall cause a notice of the availability of said Draft EIR to be published when the Draft EIR has been completed. SECTION 8 : The Executive Director of the Agency snail request comments on said Draft EIR from such reviewing agencies as he shall deem appropriate in the circumstances. SECTION 9 : The Secretary shall cause'a Notice of Com- pletion to be filed and published. SECTION 10 : The base year for taxes allocated pursu- ant to Section 33670 of the Health'& Safety Code (with respect to the property to be added to Redevelopment Project Area A by the Redevelopment Plan Amendment) is the 1980 -1981 tax year, said taxes to be remitted by the County of Los Angeles and re- ceived by the Agency under the Community Redevelopment Law of the State of California. SECTION 11 : The Secretary of the Agency is hereby directed to make the transmittals required by Health & Safety Code Section 33327 and is hereby further authorized and direct- ed to cause the transmittals required by Health & Safety Code Section 33353.4 to be made. SECTION 12 : The Secretary of the Agency is hereby directed to transmit to the Planning Commission of the City of Lynwood (the "Planning Commission ") a copy of this Resolution, together with copies of a Project Area map for the Redevelop- ment Plan Amendment and the Redevelopment Plan Amendment, with a request that said Planning Commission (1) approve the Rede- velopment Plan Amendment; (2) render a report as to conformity of the Redevelopment Plan Amendment with the General Plan of the City of Lynwood; (3) render a report or reports pursuant to -2- a C Government Code Section 65402; and (4) transmit such approvals and reports to the Agency and to the City Council of the City of Lynwood. SECTION 13: The Secretary is hereby authorized and directed to transmit•a copy of this Resolution together with the attached Exhibits to the Planning Commission and City Coun- cil of the City of Lynwood, for such. action as they may wish to take. GREEN 1980 AMENDMENT TO REDEVELOPMENT PLAN FOR REDEVELOPMENT PROJECT AREA A n f The Redevelopment Plan for Redevelopment Project Area A hereby is amended in the following respects 1. Section III is hereby amended to read as follows: "III. Project Area Boundaries The Project Area consists of approximately five hundred a;xty -four ( 564) acres situated within the City of Lynwood, County of Los Angeles, State of Califor- nia. Said area is more particularly described on Ex- hibit "A" attached hereto and incorporated nerein and shown on Exhibit "B" attached 'hereto and incorporated herein. 2. Section IV A. is hereby amended by deleting the words "as a commercial and professional area by" in the third line and inserting in place thereof the words "thereof for re- sidential, commercial and industrial uses by. ". 3. Section IV B. 1. is hereby amended to read: "It is in the public interest and is necessary in order to eliminate the conditions requiring redevelop- ment and in order to execute the Plan, for the power of eminent domain to be employed by the Agency to ac- quire real property in the Project Area. The Agency shall not commence eminent domain proceedings to ac- quire property within the Project Area at any time, more than twelve years from the effective date of this Plan." 4. Section IV F. is hereby amended to read: "F. Relocation of Persons Displaced by the Project 1. Assistance in Finding Other Locations The Agency shall assist all persons (includ- ing families, business concerns, and others) displaced by the Project in finding other locations and facili- ties. In order to carry out the Project with the mi- nimum of hardship to persons displaced from their EXHIBIT A for REZOLUTION homes, the Agency shall assist individuals and fami- lies in finding.housing that is decent, safe, sani- tary, within their financial means, in reasonable con- venient locations, and otherwise suitable to their needs. The Agency is also authorized to provide hous- ing outside the Project Area for displaced persons. Whenever dwelling units housing parsons and families of low or moderate income are destroyed or removed from the low and moderate income housing mar- ket as part of a redevelopment project, the Agency shall, within four years of such destruction or remov- al, rehabilitate, develop, or construct, or cause to be rehabilitated, developed, or constructed, for rent- al or sale to persons and families of low or moderate income an equal number of replacement dwelling units at affordable rents within the Project Area or within the territorial jurisdicton of the Agency, in accord- ance with all the provisions of Sections 33413 and 33413.5. 2. Relocation Payments The Agency is authorized to pay all reloca- tion payments and to provide relocacon advisory assis- tance in conformity with the adopted Relocation Plan and the California Relocation Assistance Guidelines or as otherwise required or authorized by law to all Pro- ject residents and business concerns relocated from the Project Area. The adoption of this Redevelopment Plan con - sticuces a finding that there are not a substantial number of low and moderate income families to be dis- placed by the Redevelopment Project and, therefore, further constitutes a finding that the formation of a Project Area Committee was not required. Except as otherwise permitted by law, prior to the execution of an agreement for acquisition of real property, or the execution of an agreement for the disposition and development of property, or the execution of an owner participation agreement, which agreement would lead to the destruction or removal of dwelling units from the low and moderate income hous- ing market, the Agency shall adopt by resolution a replacement housing plan. The replacement housing plan shall include (1) the general location of housing to be rehabilitated, developed, or constructed pursu- ant to Health & Safety Code, Section 33413, (2) an -2- adequate means of financing such rehabilitation, de- velopment, or construction, and (3) a finding that the replacement housing does not require the approval of the voters pursuant to Article XXXIV of the California Constitution, or that such approval has been ob- tained. A dwelling unit whose replacement is required by Health & Safety Code, Section 33413 but for which no replacement housing plan has been prepared, shall not be destroyed or removed from the low and moderate income housing market until the Agency has by resolu- tion adopted a replacement housing plan. Nothing in this section shall prevent an Agency from destroying or removing from the low and moderate income housing market a dwelling unit which the Agency owns and which is an immediate danger to health and safety. The Agency shall, as soon as prac- ticable, adopt by resolution a replacement housing plan with respect to such dwelling unit." 5. Section IV H is hereby amended to read: "The Agency is authorized to install and con- struct or to cause to be installed and constructed the public improvements and public utilities (within or outside the Project Area) necessary to carry out the Plan. Such public improvements include, but are not limited co: over or underpasses, bridges, streets, curbs, gutters, sidewalks, street lights, sewers, storm drains, traffic signals, electrical distribution systems, natural gas distribution systems, water dis- tribution systems, parks, plazas,. playgrounds, motor vehicle parking facilities, and any buildings, struc- tures or improvements necessary and convenient to the full development of any of the above. The Agency, wick the consent of the legisla- tive body, may pay all or part of the value of the land for and the cost of the installation and con- struction of any building, facility, structure, or other improvement as described herein, which is pub- licly owned either within or outside the Project Area upon a determination by resolution of the Agency and City Council: (1) that such buildings, facilities, structures and other improvements are of benefit to the Project Area or the immediate neighborhood in which the Project Area is located, regardless of whether such improvements are within another project area or in the case of a project area in which sub- stantially all of the land is publicly owned that such -3- improvement is of benefit to an adjacent project area of the Agency; (2� that no other reasonable means of financing such buildings, facilities, structures or other improvements, are available to cne community. When the value of such land or the cost of the installation and construction of such building, facility, structure, or other improvement, or both, has been, or will be, paid or provided for initially by the community or other public corporation, the Agency may enter into a contract with the community or ocher public corporation under which it agrees co re- imburse the community or other public corporation for all or part of the value of such land or all or part of the cost of such building, facility, structure, or other improvement, or both, by periodic payments over a period of years. Any obligation of the Agency under such con- tract shall constitute an indebtedness of the Agency for the purpose of carrying out the Redevelopment Pro- ject for such Project Area." 6. Section IV J is hereby amended to substitute the word "bidding" for the word "building" in the third line of the second paragraph of Section IV J. 1. 7. Section V A is hereby amended to read as follows: "A. Map In addition to illustrating the location of the Project Area boundaries, the Map attached hereto-as Exhibit "B" also illustrates, generally, the street layout and the distribution of permitted uses within the Project Area, the precise location of such uses shall be consistent with the City's Zoning Ordinance and General Plan as they now exist or are hereafter amended." B. Section V B. is hereby amended to read as follows: "B. Residential, Commercial and Industrial Uses 1. Residential Uses Uses permitted in areas designated as resi- dential include but are not limited to single - family detached single - family attached (including condomini- ums and townhouses) and multi - family dwelling units and such uses as are permitted by the Zoning Ordinance of the City. 2. Commercial Uses permitted in areas designated as com- mercial include, but are not limited to regional and community shopping centers, general business and com- mercial services, specialty and accessory shops, en- tertainment, related auxiliary uses, motels, hotels and other highway related commercial uses, and sup- porting vehicle parking facilities. New development in the areas shall be developed according to City standards. Except as inconsistent with this Plan all requirements of the City's zoning ordinance as it now exists or as hereafter amended shall apply to com- mercial development hereunder.' 3. Industrial Uses permitted�in areas designated as indus- crial include, but are not limited to industrial parks, light and heavy manufacturing, wholesale and distributive uses, and other related facilities. Ex- cept as inconsistent with this Plan all requirements of the City's zoning ordinance as it now exists or as hereafter amended snall apply to industrial develop- ment hereunder." g. Section V D 14 is hereby amended to read as fol- lows: 11 14. City Code and Ordinance The redevelopment of the Project Area shall be undertaken in accordance with the provisions of the City Code, the Zoning Ordinance and the General Plan of the City of Lynwood; provided, however, the Agency may impose such additional requirements which it de- termines are necessary or convenient to the accomp- lishment of the purposes of this Plan." A. Section VI D is hereby added co read as follows: "D. Limitations The number of dollars of taxes which may be divided and allocated to the Agency pursuant to Cali- fornia Health & Safety Code Section 33670 shall not -5- exceed - Million Dollars ( ) except by amendment of this Redevelopment Plan. No loan, advance or indebtedness to be re- paid from such allocation of taxes established or in- curred by the Agency to finance in whole or in part the Redevelopment Project shall be established or in- curred after twenty (20) years following the date of adoption of the ordinance approving and adopting this Redevelopment Plan. Such loan, advance or indebted- ness may be repaid over a period of time longer than such time limit. Such time limitation may be extended only by amendment of this Redevelopment Plan. The amount of bonded indebtedness, to oe repaid, in whole or in part from such allocation of taxes, which can be outstanding at one time shall not exceed Million Dollars ( ), with- out an amendment of this Redevelopment Plan. The Agency may in any year during which it owns property in a redevelopment project pay directly to any city, county, city and county, district, in- cluding, but not limited to, a school district, or other public corporation for whose benefit a tax would have been levied upon such property had it not been exempt, an amount of money in lieu of taxes. A proportionate share of any amount of money paid by an Agency to any city and county pursuant to this section shall be disbursed by the city and county to any school district with territory located within a redevelopment project area in the city and county. 'Proportionate share', as used in this section, means the ratio of the city and county, to the total tax rate of the city and county.
