AN ORDINANCE AMENDING SECTION 510 ET SEQ.
OF THE CODE OF CITY ORDINANCES
REGULATING MOTOR BOATS
THE CITY COUNCIL OF THE CITY OF MEDINA ORDAINS AS FOLLOWS:
SECTION I. Section 510 et seq. of the Medina Code of Ordinance
is amended by deleting the otricken material and adding the
underlined material as follows:
510.01. Operation. It shall be unlawful for any person
operating a boat or any vessel used for transportation on or in
public water within the City of Medina, whether that boat or
vessel be propelled by machinery, motor, or sail3 in a arcicss,
reckless, or imprudent manner.
Adopted by Reference of State Statute and Rules. Minnesota
Statutes, Chapter 86B, Water Safety, Watercraft, and Watercraft
Titling and related Boat and Water Safety Rules 6110.0100 -
6110.2300 are hereby adopted by reference and are made a part of
this ordinance as if fully set forth herein. Any violation of
the statute or rules adopted by reference is a violation of this
ordinance.
510.03. Muffler. Except for special events approved by the City
Council, it shall be unlawful to use a boat wholly or partly
propelled by motor, unless that motor be provided with an
adequate muffling device.
Subd. 1. An adequate muffling device shall mean that the
motor exhaust shall, at all times, be so muffled as to suppress
unnecessary, excessive or unusual noises.
Subd. 2. The discharge of cooling water through the exhaust
shall be considered a sufficient muffling device.
510.05. Safe Operation; Interference with Another. Subd. 1.
Each operator of a motor boat shall manipulate the boat in a
careful and prudent manner, and, at a speed not to endanger,
annoy, or interfere with the free and proper use of public water
by another.
Subd. 2. It shall be unlawful for any person to operate a
boat or any vessel used for transportation on or in public water
within the City of Medina, whether that boat or vessel be
propelled by machinery, motor, or sails in a careless, reckless,
or imprudent manner.
510.07. Swimming Area. No person shall operate a motorboat
within an area marked by buoys or other marker designating a
swimming area.
510.09. Intoxication. No person, while under the influence of
intoxicating liquor or drugs may operate a boat on or in any
public waters in the City of Medina.
510.11. Offenses. It shall be unlawful for any person to do any
of the following:
Subd. 1. Interfere with, obstruct, or tend to obstruct or
render dangerous for use or passage, any public water within the
City.
Subd. 2. The depositing of refuse, sewage, waste or other
deleterious, poisonous or injurious substance in any public water
within the City.
Subd. 3. The erection or maintenance of any dock or
structure which interferes with, obstructs, or render dangerous
for use public waters within the City.
Subd. 4. Water skiing within 50 feet of an occupied craft,
and any careless or reckless act on water skis in public water
within the City.
Subd. 5. The failure to equip and maintain lights, and to
have such lights lighted when the boat or vessel is operating in
public water within the City.
Subd. 6. Obstructing or interfering with passage of a boat
or vessel through a channel or narrow water passageway in public
waters within the City.
510.13. Special Regulation for Mooney Lake; Firearms Prohibited.
It shall be unlawful to discharge a firearm on or over the
surface of Mooney Lake or on or over any land area within 50 feet
of the shoreline of Mooney Lake.
510.15. Holy Name Lake, Motorboats Restricted. It shall be
unlawful for any person to operate a motorboat as defined in M.S.
§ 3G1.02, Subd. 8, Minnesota Statutes, Chapter 86B, except those
which are propelled by steam power or electric motors, on Holy
Name Lake.
510.17. Mooney Lake Special Provisions. The following
additional regulations and limitations are hereby imposed upon
watercraft operated, placed or maintained in or upon Mooney Lake:

Subd. 1. No person shall operate, place or maintain a
watercraft which is propelled by an internal combustion engine
having a size and power in excess of five horsepower.
Subd. 2. Each watercraft shall be equipped so as to direct
its motor exhaust under water, or otherwise completely and
effectively to muffle and silence the sound of the explosions of
such motor. No watercraft shall otherwise make any unnecessary
noise in its operation.
Subd. 3. No person shall operate a watercraft between the
hours of 8:00 p.m. and 8:00 a.m.
Subd. 4. No person in charge of or occupying a watercraft
shall dump or throw garbage, paper, bottles, cans, refuse or
debris into the lake.
510.1419. Exemptions. Authorized Department of Natural
Resources management personnel, Emergency Rescue workers and law
enforcement personnel when acting in the performance of their
duties shall be exempt from the provisions of this ordinance.
SECTION II. This ordinance shall become effective upon its
adoption and publication.
