SPECIAL MEETING - DECEMBER 5, 2003
The Special Meeting of the Bal Harbour Village Council was held on Friday, December 5,
2003, in the Council Chambers, at Bal Harbour Village Hall. The meeting was called to
order at 9:06 a.m. by Mayor Tantleff. The roll was called and those present were:

Councilman Joel S. Jacobi
Alfred J. Treppeda, Village Manager
Jeanette Horton, Village Clerk
Ellisa Horvath, Deputy Village Clerk
Michael Popok, Village Attorney
Absent: Councilman Peg E. Gorson
As a quorum was determined to be present, the meeting commenced.
4. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Mrs.
Horton.
Mr. Popok advised that the open meeting is concluded and the time is 9:07 a.m.
3. ATTORNEY -CLIENT SESSIONS Mr. Popok stated that the Council is
going to have an Attorney/Client Session, in accordance with Florida Statute 286.011, in
order to discuss strategy and options, including appeal, with respect to a pending litigation
of Bal Harbour Village versus William Welsh, Case Number 02-10212CA04, pending in the
Eleventh Judicial Circuit, Miami -Dade County. He advised that the session is a ;timate I to
last 15 minutes and the following people will be in attendance at the meeting.

Mr. Popok advised that the proceedings will be recorded by a Certified Court Reporter and
at the conclusion of all litigation discussed, the transcript will be made part of the public
record. All individuals, who were not named. left the room.
The meeting was reconvened at 9:30 a.m. Mayor Tantleff explained that the
Attorney/Client Session has been terminated and that members of the general public are
invited back into the Council Chambers for any further proceedings or matters. Those

4. OTHER BUSINESS: None
S. ADJOURN: There being no further business to come before the Council, a
motion was offered by Assistant Mayor Roth and seconded by Councilman Jacobi to adjourn. The
motion carried unanimously (4-0), with Councilman Gorson absent, and the meeting adjourned
at 9:37 a.m.
