HomeMy Public PortalAbout266CITY OF MEDINA ORDINANCE NO.: AN ORDINANCE AMENDING CHAPTER 720 OF THE MEDINA CODE OF ORDINANCES RELATING TO INDIVIDUAL SEWAGE DISPOSAL SYSTEMS The City Council of the City of Medina Ordains as Follows: SECTION I. Sections 720.09, 720.17, 720.37, 720.39, 720.95 and 720.97 are amended by adding the underlined material and deleting the stricken material as follows: 720.09. Application. The standards of the Minnesota pollution control agency (MPCA) regarding individual sewage treatment systems, as amended from time to time, are hereby incorporated into this code and made a part thereof as if fully set forth herein. TheGO The MPCA standards define the minimum standards for individual sewage treatment systems installed in Medina. Notwithstanding the adoption of the MPCA standards, if any provision or standard set forth in this code is more restrictive than the MPCA standard, the provision or standard set forth in this code shall prevail. It is intentcd intended that the administration and enforcement of these standards be conducted by the Administrator of the City of except for the following systems which also require State Disposal System Permits, as well aG approval by the Administrator._ Subd. 1. Systems disposing of waste other than sewage..—; Subd. 2. Collector systems which serve fifteen (15) dwellings, or which collect 5,000 gallons or more per day r; or Subd. 3. Individual sewage treatment systems which serve a single facility generating greater than 15,000 gallons per day. 720.17. Lot Size. A Every lot shall have an adequate area for all expected improvements in addition to an adequate area of contiguous soil suitable for the installation of the individual sewage treatment system in accordance with all requirements pertaining thereto. Every lot created after [ effective date of the amendment] shall also have an adequate area of contiguous soils suitable for the installation of a secondary individual treatment system in the event of the failure of the primary system. Areas containing wetlands, disturbed soils or slopes in excess of 12 percent may not be utilized for the primary or secondary individual sewage treatment system. 720.37. Site Evaluation. Proposed primary and secondary sites for all private sewage disposal systems shall be explored, evaluated, and reported on forms as provided for by the City. Site inveGtigation evaluations shall be made by a site evaluator. The site evaluator shall sign the report, Erha11 determine the suitability of the primary and secondary sites and the sus soils for sewage disposal, and Ghall recommend the type and design of the systems following the terms of this Gcode . Soils shall be identified by strata and the textural classes of the strata defined RHH28198 ME230-5 according to an accepted classification system. The primary and secondary sites for individual sewage treatment systems must be staked or marked in a manner so as to be clearly visible and to prevent any disturbance which would affect their suitability as sites for septic systems. 720.39. The site evaluation itreport shall be supported by: Subd. 1. A location plan, with the proposed lots, lines and streets clearly marked.—; Subd. 2. A log of all soil exploration including a description of the various strata encountered,,—; Subd. 3. Slopes of the land areas in question.—i Subd. 4. Groundwater conditions (including indications of seasonal groundwater fluctuations)—; Subd. 5. The design and type of systems selected according to this Code (including the amount and type of fill required or any special design factors which could be considered)—; Subd. 6. Distances to all surface waters, wells, springs, or other surface waters within one hundred fifty (150) feet of the proposed disposal areas—; Subd. 7. For each proposed primary and secondary site, Rresults of at least three (3) percolation tests and one (1) soil boring performed according to testing procedures described in Sections 720.41 and 720.43 of this code—; and Subd. 8. A description of the soils at the sites in accordance with the standards of the National Cooperative Soil Survey and the Hennepin County Soil Survey - 1974. 720.W95 . Alinual Periodic Inspections. Each owner of property containing an A11 conventional and innovative sewage disposal systems chall must, within twelve (12) m +h f r,a af-t -, the data „f +he ad -option of this ordinance, cause said cyctem to be inspected by a person, firm, or corporation duly licensed an inspector selected by the City_ t + c t 5 f +h rdiranee and rly thcro.-,ftor shall, within said twelve (12) month period, The inspector must submit to the City Clerk - Treasurer a written statement showing the date upon which inspection was completed, the name and address of the person, firm or corporation by whom such inspecting was completed, and a report of finding of said regarding the inspection in a form satisfactory to the City. All components must be inspected, including measurement of the depth of the sludge and scum in the septic tanks. The inspection must be conducted and the report submitted every four years or upon any transfer of the property, whichever occurs first. The cost of such inspection shall be payable by the property owner in accordance with the fee schedule adopted by the city council. 720.9497. Repair and Maintenance. The owner of any property found to have an individual sewage disposal system which is failing shall be required to repair or replace the system. ^ t l„ c+ th. of r+; tanU hie__ rt septic tank.
