RESOLUTION URGING CONGRESS TO DELAY THE IMPLEMENTATION
OF THE BIGGER WATERS ACT 2012
WHEREAS, the United States Congress enacted legislation known as the Bigger Waters
Act of 2012 (the `Bigger Waters Act" or the "Act ") which amended the National Flood
Insurance Act of 1963, the ( "NFIA "); and
WHEREAS, the Bigger Waters Act has fundamentally altered the method used for
calculating flood insurance premiums which will dramatically increase flood insurance
premiums which will dramatically increase flood insurance rates to the Borough of
Carteret residents; and
WHEREAS, the Bigger Waters Act excluded certain properties from receiving
subsidized premium rates; and
WHEREAS, the increase in rates coupled with the elimination of subsidies will have a
profoundly adverse effect on residents of the Borough of Carteret, and may prevent
residents in areas hardest hit by Super Stomr Sandy from rebuilding their homes; and
WHEREAS, the result of implementation of the Bigger Waters Act would be
particularly harsh on residents still suffering the effects of Sandy; and
WHEREAS, the Bigger Waters Aves ignore the historical nature of construction in the
Borough of Carteret and other `non- shore" communities; and
WHEREAS, prudence and compassion, along with a common sense of fairness dictates
the implementation of the Bigger Waters Act be delayed; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE BOROUGH OF CARTERET, that the United States Congress delay
implementation of the Bigger Waters Act be delayed; and
BE IT FURTHER RESOLVED, that Congress consider amending the Bigger Waters
Act to take into consideration construction techniques in areas such as the Borough of
Carteret that routinely include basements, and tire cost of mitigating and lifting homes
after a thoughtful review of base flood elevations; and
BE IT FURTHER RESOLVED, that this Resolution shall be forwarded to W. Craig
Fugate, Administrator, Federal Emergency Management Agency, Senator Robert
Menendez, Senator Frank Lautenberg and Representative Frank Patton.
