AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE
VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO THE PRESENT
CITY LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED TO THE REAR
OF 1206 BOONVILLE ROAD; DESCRIBED AS PART OF THE SOUTHEAST CORNER
OF SECTION 27, TOWNSHIP 45 NORTH RANGE 12 WEST, IN THE COUNTY OF
COLE, STATE OF MISSOURI; AND AMENDING SECTION 1-17 OF THE CODE OF
THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY
BY ADDING ONE NEW SUB-SECTION PERTAINING TO THE SAME SUBJECT.
WHEREAS, pursuant to Section 71.012.2 RSMo, the City Council of the City of
Jefferson desires to annex the unincorporated area of land described in
Section 1; and
WHEREAS, the property is owned by the City of Jefferson; and
WHEREAS, the property is adjacent to the current City boundary; and
WHEREAS, a public hearing concerning the annexation was advertised in advance of
the hearing in the Jefferson City News Tribune; and
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The City Council intends to and shall proceed to annex, as provided
by law, the unincorporated area of land described as follows: Part of the Southeast
Quarter of Section 27, Township 45 North, Range 12 West, Cole County, Missouri, more
particularly described as follows: From the Quarter Section corner on the south side of
said Section 27; thence North 3 Degrees 17 Minutes 08 Seconds East, along the
Quarter Section line, 1439.13 feet to a point intersecting the north line of the Missouri
Pacific Railroad right-of-way; thence along said right-of-way line the following courses:
Easterly, on a curve to the left, having a radius of 779.67 feet, an arc distance of 73.49
feet, (the chord of said curve being South 71 Degrees 51 Minutes 33 Seconds East
73.46 feet); thence South 15 Degrees 26 Minutes 26 Second West, 75.00 feet; thence
on a curve to the left, having a radius of 854.67 feet, an arc distance of 11.93 feet, (the
chord of said curve being South 74 Degrees 57 Minutes 33 Seconds East, 11.93 feet);
thence along a spiral curve to the left, having a chord bearing of South 79 Degrees 02
Minutes 59 Seconds East, a distance of 182.00 feet; thence on a curve to the right,
having a radius of 5977.15 feet, an arc distance of 224.22 feet, (the chord of said curve
being South 83 Degrees 30 Minutes 17 Seconds East, 224.21 feet) to a point in the
present center of Gray's Creek and the point of beginning for this description; thence
leaving the north line of said Missouri Pacific Railroad right-of-way, along the present
center of Gary's Creek the following courses: North 6 Degrees 44 Minutes 00 Seconds
East, 80.97 feet; thence North 21 Degrees 55 Minutes 00 Seconds West, 127.0 feet;
thence North 31 Degrees 40 Minutes 00 Seconds East, 116.0 feet; thence North 88

being North 56 Degrees 04 Minutes 12 Seconds West, 134.28 feet); thence on a spiral
curve to the left, having a chord bearing of North 57 Degrees 21 Minutes 44 Seconds
West, a distance of 157.50 feet; thence northwesterly, on a curve to the left, having a
radius of 1700.03 feet, an arc distance of 553.86 feet, (the chord of said curve being
North 68 Degrees 41 Minutes 54 Seconds West 551.41 feet); thence on a spiral curve to
the left having a chord bearing of North 79 Degrees 33 Minutes 06 Seconds West, a
distance of 128.43 feet; thence northwesterly, on a curve to the left, having a radius of
5977.15 feet; an arc distance of 220.06 feet, (the chord of said curve being North 81
Degrees 22 Minutes 31 Seconds West, 220.04 feet) to the point of beginning. Except
that part, if any, that lies within the boundary of the above described parcels by Quit
Claim Deed of Record in Book 6, Page 35, Cole County Recorder's Office. Containing
4.87 acres.
Section 2. The City Council finds and declares that the land described in
Section 1 is contiguous to the City boundary; that the annexation is reasonable and
necessary to the proper development of the City; and further, did determine the City has
an ability to furnish normal municipal services to this area.
Section 3, A public hearing was held on June 17, 2013 as provided by law,
concerning the annexation of the unincorporated area described in Section 1.
Section 4. The land described in Section 1 shall be zoned RC until such time as
the zoning may be changed in the manner provided for by State Statute and City Code.
Section 5., Section 1-17 of the City Code of the City of Jefferson, Missouri is
hereby amended by adding one new subsection which shall read as follows:
(U)The City's boundaries shall also include the following parcel: Part of the

Section 6. The annexed area shall be in Ward 3 of the City.
Section 7. The effective date of this Ordinance and the annexation of the area
described in Section 1 will be immediately upon passage, provided that no written
objections to the proposed annexation are filed with the City Council. If sufficient
objections are filed, this ordinance shall not become effective until such time as the
annexation issue has been resolved pursuant to the provisions of Chapter 71 RSMo.

Case No. P13007 — 1206 Boonville Road; Voluntary Annexation. Request filed by City of
Jefferson for a voluntary annexation of 4.87 acres and zoning plan of RC Conservation for
property located to the rear of 1206 Boonville Road described as Part of the SE comer of Section
27,Township 45 North, Range 12 West.
Mr. Barron described the proposal and explained that the purpose of this request is to incorporate
the subject property into the city limits with a RC Conservation zoning designation. He stated that
the property was purchased by the City in conjunction with a sanitary sewer system improvement
project. Mr. Barron explained that the City submitted a petition to annex the property into the city
limits. He stated that the property is in the floodpiain and is currently used in an agricultural
manner. Mr. Barron explained that the Planning and Zoning Commission recommends the zoning
for the property whereas the City Council will consider the annexation petition.
No one spoke on this request and no correspondence was received.
Mr. Barron gave the Planning Division staff report
Mr. Yamell moved and Mr. Lester seconded to recommend approval of,the zoning plan for the
property to be zoned RC Conservation to the City Council. The motion passed 8-0 with the
following votes:
