HomeMy Public PortalAboutPlanning Board Packet 06/24/20PB Minutes 06/10/2020 Page 1 of 2 Brewster Planning Board 2198 Main Street Brewster, MA 02631-1898 (508) 896-3701 x1133 brewplan@brewster-ma.gov BREWSTER PLANNING BOARD MEETING MINUTES Wednesday, June 10, 2020 at 7:00 pm Brewster Town Office Building (virtual) Chair Madalyn Hillis-Dineen convened a remote meeting of the Planning Board at 7:00 pm with the following members participating remotely: Roberta Barrett, Ned Chatelain, Charlotte Degen, Kari Hoffmann, and Elizabeth Taylor. Paul Wallace did not participate. Also participating remotely: Ryan Bennett, Town Planner and Lynn St. Cyr, Senior Department Assistant. The Chair read the Notification: “Pursuant to Governor Baker’s March 12, 2020 Order Suspending Certain Provisions of the Open Meeting Law and his March 15 and March 23, 2020 Orders imposing strict limits on the number of people that may gather in one place, this meeting will be conducted via remote participation to the greatest extent possible. Specific information and the general guidelines for remote participation by members of the public and/or parties with a right and/or requirement to attend this meeting may be found on the Town’s website at www.brewster-ma.gov. For this meeting, members of the public who wish to listen to the audio broadcast may do so via the Town of Brewster website at http://livestream.brewster-ma.gov or on Channel 18. No in-person attendance of members of the public will be permitted, but every effort will be made to ensure the public can adequately access the proceedings in real time via technological means. The Town has established specific email addresses for each board and committee that will be meeting remotely so that residents can send their comments in writing either before or during the meeting. For this meeting, please send comments to planningboardmeeting@brewster- ma.gov. In the event we are unable to live broadcast these meetings, despite best efforts, we will post on the Town website an audio recording, transcript, or other comprehensive record of proceedings as soon as possible after the meeting at http://tv.brewster-ma.gov.” The meeting packet will be posted prior to the meeting and can be found at http://records.brewster-ma.gov/weblink/0/edoc/126049/PB%20Packet%20061020.pdf. 7:03 PM PUBLIC MEETINGS Approval Not Required Application #2020-06: Applicant/Owner: Roman Catholic Church and Newcomb Knolls, LLC. Representative: Paul E. Sweetser, PLS for property located at 292 A. P. Newcomb Road and shown on Assessor’s Map 25, Lot 1 and 482 Stony Brook Road and shown on Assessor’s Map 25, Lot 2, both located in the Residential Medium Density (R-M) zoning district. Documents:  02-27-20 Approval Not Required plan  05-07-20 Approval Not Required Application with narrative, ownership documents, and lot closure information  Approval Not Required Checklist Paul Sweetser, PLS was present on behalf of the Applicant Roman Catholic Church and Newcomb Knolls, LLC. Jay Merchant, Applicant, was also present. Sweetser stated that the purpose of the plan is to divide the parcels so that the church gains land and Newcomb Knolls gains frontage necessary for the next ANR plan that will be presented. Taylor asked about the Newcomb Knolls subdivision open space and Sweetser clarified that this plan is not related to the Newcomb Knolls subdivision. Degen asked for clarification on the land swap and Sweetser reviewed the land areas for the Roman Catholic Church and Newcomb Knolls. Approximately 10.5’ of frontage on A.P. Newcomb Road is being given to Newcomb Knolls. Both properties will maintain sufficient frontage under zoning. Barrett confirmed with the Applicant that the frontage gained in this plan would be used in the next ANR to provide sufficient frontage to the lots delineated on that plan. Hoffmann sought clarification on ownership of the parcels and Sweetser directed the Board to the ANR plan and stated that Parcels A and B2 would be owned by the Roman Catholic Church and Parcels B and A2 would be owned by Newcomb Knolls, LLC. Motion by Taylor to Endorse Approval Not Required Application #2020-06. Second by Barrett. Vote: Chatelain- aye, Degen- aye, Taylor- aye, Barrett- aye, Hoffmann- aye, and Hillis-Dineen- aye. Vote: 6-0-0. 7:15 PM PUBLIC MEETINGS CONTINUED Approval Not Required Application #2020-07: Applicant/Owner: Newcomb Knolls, LLC. Representative: Paul E. Sweetser, PLS for property located at 292 A. P. Newcomb Road and shown on Assessor’s Map 25, Lot 1 in the Residential Medium Density (R-M) zoning district. Jay Merchant, Applicant, was also present. Sweetser stated that this ANR plan takes the frontage gained from the previous ANR plan to provide frontage to the four lots outlined on this plan. The plan provides ample frontage and area for all four lots. Hoffmann asked the Applicant to confirm that he was seeking an approval not required not subdivision approval. Sweetser confirmed that an ANR plan was being presented as the lots have ample frontage on a town way and ample area. Motion by to Chatelain to Endorse Approval Not Required Application #2020-07. Second by Degen. Vote: Chatelain- aye, Hoffmann- aye, Barrett- aye, Taylor- aye, Degen- aye, and Hillis-Dineen. Vote: 6-0-0. 7:19 PM PLANNING DISCUSSION Approval of Meeting Minutes: May 27, 2020. The Board reviewed the May 27, 2020 meeting minutes. Motion by Taylor to Approve May 27, 2020 Meeting Minutes, as amended. Second by Hoffmann. Vote: Degen- aye, Chatelain-aye, Hoffmann- aye, Barrett- aye, Taylor- aye, and Hillis-Dineen- aye. Vote: 6-0-0. 7:22 PM PLANNING DISCUSSION CONTINUED Discussion and possible vote to rescind May 27, 2020 Planning Board vote pursuant to the provisions of G.L. c.41, §81P (ANR plans) and §81X (subdivision plans) to authorize a single individual to endorse plans on behalf of the Board for recording in the Registry of Deeds. St. Cyr stated that upon further research, the votes taken to authorize Ryan Bennett, Town Planner, as the single signatory on subdivision and ANR plans may not be as useful to the Board as initially expected. The mechanism is only valid plans that have land recorded in the Registry of Deeds. The Planning Board sees a fair number of plans that contain land registered in Land Court. Board member signatures would still be required as the Land Court is not accepting single signatory plans. Also, the associated recording fees were costly given the fact that this practice will only be used on a temporary basis. Motion by Hoffmann to Rescind May 27, 2020 Planning Board vote pursuant to the provisions of G.L. c.41, §81P (ANR plans) and §81X (subdivision plans) to authorize a single individual to endorse plans on behalf of the Board for recording in the Registry of Deeds. Second by Taylor. Vote: Chatelain- aye, Taylor- aye, Barrett- aye, Hoffmann- aye, Degen- aye, and Hillis-Dineen- aye. Vote: 6-0-0. 7:26 PM PLANNING DISCUSSION CONTINUED Committee Reports. Hillis-Dineen stated that she is the current Planning Board representative to the Housing Trust and that position needs to be reaffirmed prior to the Trust’s meeting in July. Hillis-Dineen is interested in remaining as the Board’s representative to the Housing Trust. Hillis-Dineen asked the Board to let her know if anyone else is interested in the position. Taylor announced a meeting related to the update to the 2013 Open Space and Recreation Plan. A meeting will be held via Zoom on June 18, 2020 at 7:00 pm. Chatelain attended a meeting of the Water Quality Review Committee and noted an upcoming solar project on Freeman’s Way. Motion by Taylor to adjourn. Second by Hoffmann. Vote: Hoffmann- aye, Barrett- aye, Degen- aye, Chatelain- aye, Taylor- aye, and Hillis-Dineen- aye. Vote: 6-0-0. Meeting adjourned at 7: 35 pm.
