AN ORDINANC AMENDING
SECTIONS 310 E SEQ. OF THE
MEDINA CODE O ORDINANCES
RELATING TO CURFEW FOR MINORS
The City Council of the City of Medina Ordains as follows:
SECTION I:
Section 310 et seq . of the Code of Ordinances of the City of Medina is amended
by deleting the ctricken materials and adding the underlined material as follows:

310.03. Barents RcGponGible. It is hereby declared to be unlawful for any parent,
guardian or other person having the legal care and custody of any person under 14
years of age to allow or permit any cuch child, ward or other person under Guch age,
while in cuch legal custody, to go or be in or upon any of the public streets, alleys
unless there existG a rc\sonable necessity therefor.
Section 310.01. Purpose. It is recognized that minors are increasingly the
purpetrators as well as the victims of crime. It is the intent of this ordinance to
restrict the hours minors may be at large both to decrease juvenile crime and to
lessen the opportunity for minors to be thvictim of crime.
Sec. 310.03. Definitions. The followin words and terms, when used in this
ordinance, shall have the meanings given to them, unless the context clearly
indicates otherwise:
Subd. 1. Adult - An individual 18 ears of age or older.

Subd. 3. Proprietor - Any person, firm, or corporation operating or in
charge of any place of amusement, entertainment, refreshment or other place of
business.

Subd . 4 . Public Place - Any publicly or privately owned place where the
general public is invited to be.
Subd. 5. Responsible adult - A parent, guardian, or other adult having
lawful custody and control of a minor.
Sec. 310.05. Curfew. Subd. 1. It is unlawful for any minor of the ages specified
in this section to be on or present in any public street, avenue, alley, park or public
place at the following times unless accompanied by a responsible adult or unless
there exists a reasonable necessity therefor:
(a) For any minor under 16 years of age, the hours of restriction are
between 10 : 00 p.m. and 5 : 00 a.m. the following day.
(b) For any minor 16 years of age or older, the hours of restriction are
between 12 : 00 midnight and 5 : 00 a.m. of the following day.
Subd. 2. It is unlawful for any minor to loiter or idle on or near any
structure, vehicle or private grounds during the periods of restriction provided in
this section without the consent of the owner and unless accompanied by a
responsible adult .
Section 310.07. Responsibility of adults . It is unlawful for any responsible adult
to knowingly or negligently permit a minor to violate this ordinance. Nothing herein
shall restrict a responsible adult from designating an earlier curfew for a minor
under his or her care.
Sec. 310.09. Proprietors . It is unlawful for the proprietor of any place of
amusement, entertainment or refreshment or other place of business to permit a
minor to loiter or idle in such establishment during the hours prohibited by this
ordinance unless the minor is accompanied by a responsible adult. Whenever a minor
continues to remain at an establishment after the proprietor of the establishment has
ordered him or her to leave, the proprietor shall immediately notify the police
department of the violation.
Sec. 310.011. Construction. This ordinance shall not be construed as permitting
the presence of a minor at any time or in any place where his or her presence is
otherwise prohibited by law.
Sec. 310.13. Exception. The curfew established by this ordinance shall not apply
to any minor who is accompanied by a responsible adult or when the minor is upon
an emergency errand or legitimate business directed by a responsible adult, or when
the minor is engaged in employment or an activity organized by a school, church or
community orgainization.
Sec. 310.15. Violation. Any person violating any of the provisions of this ordinance
shall be guilty of a misdemeanor. When a minor is arrested because of a violation of

this ordinance, the arresting officer shall notify a responsible adult of the minor's
arrest as soon as reasonably possible.
SECTION II:
This ordinance shall become effective upon its adoption and publication.
