Home My Public Portal About21-9872 Mural Sign on the Ace Hardware BuildingSponsored By: City Manager RESOLUTION NO. 21-9872 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, APPROVING THE INSTALLATION OF A MURAL SIGN ON THE ACE HARDWARE BUILDING WALL FACING BURLINGTON STREET, ON THE PROPERTY IDENTIFIED BY FOLIO 08-2121- 007-0790 AT 700 OPA-LOCKA BOULEVARD, OPA-LOCKA, FLORIDA 33054 IN ACCORDANCE WITH THE ZONING REQUIREMENTS OF THE CITY LAND DEVELOPMENT REGULATION, ORDINANCE 15-31, ARTICLE X, SECTION 22- 242 AND SECTION 22-246; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City Commission of the City of Opa-Locka adopted Ordinance No. 15-31 on October 28, 2015, providing Land Development Regulations (Zoning Code) for the City of Opa-Locka; and WHEREAS, Article X, Sign Regulations, Section 0(1), "Signage Design Standards", Ordinance No. 15-31, provides that a permit is required for Mural Signs, and the permit shall be issued only after a determination has been made that full compliance with all conditions of this Ordinance have been met; and WHEREAS, pursuant to Article X, Sign Regulations, Section 0(1), "Signage Design Standards", Ordinance No. 15-31, the building permit to install a Mural Sign shall be approved if the following conditions are met: (1) The Mural Sign is not to be used for the advertising of any business; (2) the Mural Sign shall be placed on a blank wall; (3) the Mural Sign will be permitted to cover the entire blank portion of a wall of a building; (4) the illumination of a Mural Sign shall be limited to the hours of 6 pm to midnight; (5) Mural Signs are subject to oversight by the City Commission; and WHEREAS, the determination of adherence to the Zoning Code requirements for Mural Signs shall fall under the jurisdiction of the City Commission in the absence of a designated arts commission; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: SECTION 1. The recitals to the preamble herein are incorporated by reference. SECTION 2. AUTHORIZATION Resolution No. 21-9872 The City Commission of the City of Opa-Locka, Florida hereby approves the Mural Sign permit, attached hereto as Exhibit" A", and Mural Sign attached hereto as Exhibit "B". SECTION 3. SCRIVENER'S ERRORS Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected copy of same with the City Clerk. SECTION 4. EFFECTIVE DATE This Resolution shall take effect upon the adoption and is subject to the approval of the Governor or Governor's Designee. PASSED and ADOPTED this 23rd day of June, 2021. Staff Summary: The City of Opa-locka Land Development Regulation, Zoning Code, provides that a permit is required for Mural Signs, it also provides the conditions and the process for approval. Mural Signs are permitted in the City of Opa-locka subject to obtaining a building permit. The building permit to install a Mural Sign is approved if the following conditions are met: The Mural Sign is not to be used for the advertising of any business; it shall be placed on blank walls; shall be permitted to cover the entire blank portion of a wall of a building; the illumination of a mural sign shall be limited to the hours of 6pm to midnight; Mural Signs are subject to oversight by the City Commission. The City Zoning Code provides the following concerning Mural Signs, Ordinance 15-31, Article X, Section 22-242 and Section 22-246. Ordinance 15-31 Article X, Section 22-242 which states, "It shall be unlawful for any person to install, alter, erect, construct, post, paint, maintain, or relocate, within the municipal limits of the City of Opa-locka any sign, unless otherwise exempt by this Ordinance, without first having obtained a permit from the City, and/or have a valid permit for said work." Said permit shall be issued by the City Manager or his designee only after determination has been made that full compliance with all conditions of this Ordinance have been met and complied with." And In accordance with this legislation, Ordinance 15-31 Article X, Section 22-246, Public Art, which states, 0. Mural signs located within the City of Opa-Locka shall be permitted, subject to the following conditions: 1, Compliance with Zoning Regulations. Mural signs shall be subject to zoning rules in determination of permitted uses. (a) (b) Murals and other forms of Public Arts with no advertising materials shall be subject to oversight by Public Arts Ordinances adopted by the City of Opa-Locka and to compliance with provisions set forth in this Ordinance. The City Commission or a designated arts commission. Determination of adherence to Public Arts ordinances for Mural signs of a non -advertising nature shall fall under the jurisdiction by the City Commission or a designated arts commission. The "Public Art" intended and requested for the property at 700 Opa-locka Boulevard meets the zoning code conditions and is therefore being submitted to the City Commission for final consideration and approval Background The applicant has submitted a building permit and a draft of the intended mural sign to be placed on the blank wall of the Ace Hardward Store building that faces Burlington Street at 700 Opa- locka Boulevard.. Financial Impact There are no financial impacts that would be a consequence of this request being approved. Proposed Action: Staff has recommended approval of this Request.
