Hi Ann Marie-
I have received your messages and the fed -ex package regarding the
emergency at the Sewell's property and we are working on your project. We
have left a phone message for you regarding needing the name of the previous
owner. Additionally, we have some questions that will need to be posed to
the engineers most likely:
1. How are the injection pipes to be placed 6' deep? By water
jetting?
2. What will be done with the slurry that comes out of the
pipe? It could be contained onsite but outside our jurisdictional area
in a silt bag until it dewattered and then removed.
3. What diameter is the pipe? The finished 'wall' will be 6'
deep, but how wide will it be? If the drawing is to scale, it appears to
be about 3' wide. Is that how big the pipe is?
4. How big is the pipe driver and injection equipment?
5. How large of an area will they need to stage equipment in?
How large an area will they need to stage materials in? Do they have
adequate access on the lot without crossing another person's property? How
large of an area will be temporarily disturbed by this project? How
much of these staging areas are within our JD and do they have room to put
them somewhere else?
6. How are they proposing to restore original topography and
vegetation?
7. The injected -wall method of stabilization seems extreme to
stabilize the porches. You will need to provide compelling reasons
to employ this method for the porches. There should be satisfactory
alternatives to this approach that will minimize potential impacts.
Thanks for your follow up with this information. We understand the urgency
of the request and will work quickly with you to protect the integrity of
the structure.

Dear Ms. Stack:
This letter of permission (LOP) acknowledges your request of December 12, 2002 to shore up the
footings of the foundation of the above referenced structure by injecting chemical grouting under the
current footings. The design, placement, methods and materials will be as stated in your 12/12/02
letter; the Plat of Lot 3, Breakers Subdivision, Ward 4 submitted, my 12/15/02 e -mail to you and
your 12/18/02 reply (attached).
The proposed repairs referenced above are considered maintenance since they do not impact areas
outside of the footprint-of the existing structure. The Division does not object to this project. This
Letter of Permission (LOP) is valid for 60 days from commencement of repairs and is not meant to
exempt the above referenced activity from future environmental laws. No construction materials or
debris may be placed, disposed of, or stored in jurisdictional areas. Any incidental impacts
associated with this project must be rectified by restoring areas to their pre - construction topographic
and vegetative states.
This LOP may be revoked or deemed void should legal and/or environmental conditions change in
the future. The project must comply with all other Federal, State, and local statutes, ordinances, and
regulations and any other required licenses or permits must be obtained prior to commencement of
construction.

Dear Mr. Anderson:
This firm has been retained to represent Robert and Cynthia Sewell, owners of 2 13th
Street on Tybee Island. As you are most probably aware, the Sewell residence is in immediate
need of structural work in order to shore up the footings. The earthen material under the current
footings is shifting and causing the residence to "buckle." The residence is at risk of collapse
unless something is done in the very near future to rectify the problem.
We are currently working very intensely with the Department of Natural Resources
(DNR) to procure permission to proceed with the process of chemical grouting under the
residence's footings. We have provided technical information to DNR regarding the process,
and DNR is in the process of evaluating this information on a quick turn around basis. However,
DNR is very insistent on obtaining the original building permit for the residence. We have yet to
be able to obtain a copy of the permit.
I have spoken to both Chuck Bargeron (whom I understand is out of the office until
tomorrow) and Dianne Sikes regarding the permit. Apparently there is some difficulty in
locating the permit. Given the seriousness and urgency of this matter, we are again asking the
City of Tybee to try to locate the permit. Anything you could do to assist in this regard would be
immensely appreciated. The residence was built by Mike Ryan, and the Tax records indicate that
the house was built in 1993. We are unclear as to exactly when the permit was issued.

grouting procedure be approved by DNR as quickly as possible, and that the procedure take

Mr. Anderson,
I am an attorney with Bouhan, Williams and Levy LLP in Savannah representing the Sewells, owners of 2
13th Street in Tybee Island. As you are most probably aware, the Sewell residence is in immediate need of
structural work in order to shore up the footings. The earthen material under the current footings is shifting and
causing the residence to "buckle ". The residence is at risk of collapse unless something is done in the very near
future to rectify the problem.
We are currently working very intensely with the Department of Natural Resources (DNR) to procure
permission to proceed with the process of chemical grouting under the residence's footings. We have provided
technical information to DNR regarding the process, and DNR is in the process of evaluating this information on a
quick turn around basis. However, DNR is very insistent on obtaining the original building permit for the
residence. We have yet to be able to obtain a copy of the permit.
I have spoken to both Chuck Bargeron (who I understand is out of the office until tomorrow) and Dianne
Sikes regarding the permit. Apparently there is some difficulty locating the permit. Given the seriousness and
urgency of this matter, we are again asking the City of Tybee to try to locate the permit. Anything you could do to
assist in this regard would be immensely appreciated. The residence was built by Mike Ryan, and the Tax records
indicate that the house was built in 1993. We are unclear as to exactly when the permit was issued.
Given the current worsening condition of the residence, it is imperative that the chemical grouting
procedure be approved by DNR asap, and that the procedure take place within the next two weeks. Your prompt
attention to this matter is greatly appreciated. If you have any questions regarding this request, please call me at
