OF THE CODE OF ORDINANCES ADOPTING THE 1994 UNIFORM BUILDING CODE The City Council of the City of Medina Ordains as follows: SECTION I: Sections 805.01 et sec . of the Code of Ordinances is amended by deleting the tf-ielEeft materials and adding the highlighted material as follows: 805.01. Building Code. The Minnesota State Building Code (the"SBC"), established pursuant to Minnesota Statutes, sections 1.613.59 to 1613.73, one copy of which is on file in the office of the Ccity Cclerk—Ttreasurer, has been adopted as the Bbuilding Qcode for Medina. Such code is incorporated in this Code of Ordinances as completely as if set out in full. 805.03. Contents. The 1980 Edition following chapters' of the SBC are hereby -aElept-s adopted. by reference: Subd. 1. 1979 Edition of the Uniform Building Code, identified as "UBC"; Subd. 2. 1978 Edition of the National Electric Code identified as "NEC'; Escalators and Moving Walks, identified as ANSI A17.1 1978 and Supplement, ANSI A17.1a 1979; Army; Subd. 5. "Flood Proofing Regulations," June 1972, Office of the Chief of Engineers, U.S. identified as SBC 7101 through SBC 8505; Subd. 7. "Design and Evaluation Criteria for , Buildings," identified as 2MCAR Section 1.16001 through 2MCAR Section 1.16006; Subd. 8. State of Minnesota Mobile Home Installation Standards 1977, identified as 2MCAR 1.904-50 installations and related definitions in 2MCAR 1.90103; RHB89177 ME230-5 Subd. 9. Standards of Performance for Solar Energy Systems and Subsystems Applied to Energy Need of Buildings, 1977 Edition, identified as 2MCAR 1.16101 through 2MCAR 1.16108. Subd. 1. Additional Standards. In addition to those items listed above, certain Appendices, Standards and Supplemental Materials referenced in thc Code arc hereby adopted by reference RHB89177 ME230-5 completely as if set eut in full, including but are not limited to the following: Subd. 1. Technical Requirements for Fallout Shelters, identified as SBC Appendix A. Subd. 2. Variations in Snow Loads, identified as Minnesota State- Wilding Code, Appendix B. Subd. 3. 1979 Uniform Building Code Appendix Chapter 35. Subd. 4. Minnesota Plumbing Code Appendix B. 805.075 Organization and Enforcement. Subd. 1. The organization of the Bbuilding Pdepartment and enforcement of the ale SBC shall be conducted within the guidelines established by Chapter 21of the Uniform Building Code 1979 1994 Edition. The cede SBC shall be enforced within the incorporated limits of the City Medina. Subd. 2. The amity Bbuilding specter official shall be the B-building Ecode Pdepartment of the Medina. The 4administrative Aauthority shall be a •gstate Ecertified "Bbuilding °official" so designated by the 4appointing Aauthority. The 4appointing Aauthority shall be the city Qcouncil of the City of Medina. Subd. 3. A Board of Appeals is hereby established for the purpose of hearing and rendering a determination regarding conflicting interpretations of the provisions of the hoildiog cede SBC and regarding conflicting opinions of the suitability of alternate materials and methods of construction. The Board of Appeals shall consist of three persons appointed by the city council for such terms as the council may deem appropriate. The persons appointed to the Board of Appeals shall be qualified by experience and training to pass upon matters pertaining to building construction. The city building inspeetef official shall be an ex officio member and shall act as secretary to the Board of Appeals. Appeals to the Board shall be in writing and shall be filed with the city clerk -treasurer. The city clerk -treasurer shall notify the appellant in writing at least five days prior to the date of the hearing before the Board. The appellant shall have the right to be represented at the hearing and to present evidence relevant to the matter at hand. Within 15 days of the close of the hearing, the Board shall make a determination regarding the matter and shall mail a copy of its decision to the appellant. The Board shall also mail a copy of its decision to the city building hector official and to the state building inspector. The state building inspector may affirm, reverse or condition the decision of the Board on any matter. 805.097. Permits and Inspections. The issuance of permits, conduction of inspections and collection of fees shall be as provided for in Chapter 4 of the SBC. 805.4409. Fee Schedule. Fees for plan checks and Bbuilding Ppermits shall be as set forth in a resolution of the Qcity Ecouncil. RHB89177 ME230-5 3 805.4-311. Surcharge. In addition to the building permit fee, the applicant shall pay a surcharge in the amount fixed by blaw.
