General Conduct - Personal Behavior. Use of all city parks shall be eublect to the following regulations. Subdivision 1. Drug end Alcohol Use. It shall be unlawful for any person to* (a) Use, possess or sell any controlledsubstance in violation of state statute; (b) Serve, possess or consume any alcoholic beverage in individual serving containers, except melt liquor and wine, within a perk or on public property directly adjacent to the park; or Sell any alcoholic beverage in any perk without a temporary license from the city council; or bring alcoholic beverages into a perk in kegs, barrels or case lot quantities without a permit. Organization and Enforcement. Subd. I. The organisation of the Abuilding ladepartment and enforcement of the Cede SBC shall be conducted within the guidelines established by Chapter 21 of the Uniform Building Code 0779 1994 Edition. The eerie SBC shall be enforced within the incorporated limits of die Pity Medina. Subd. 2. The C-city Abuilding b^sPeetog official shall be the Abuilding Ccode °department of tke6ity-ef Medina. The Aadministrative Aaulhorily shall be a Sstate C.-certified "Abuilding°official' so designated by the Aappointing Aluthority. The Aappointing Aauthority shall be the city Ceouncil `�CPref-Me4ina. Subd. 3. A Board of Appeals is hereby established for the purpose of hearing and rendering a determination regarding conflicting interpretations of the provisions of the building Bede SBC and regarding conflicting opinions of the suitability of alternate materials and methods of construction. The Board of Appeals shall consist of three persons appointed by the city council for such terms as the council may deem appropriate. The persons appointed to the Board of Appeals shall be qualified by experience and training to pass upon matters pertaining to building construction. The city building iespeeter official shall be an ex officio member and shall act as secretary to the Board of Appeals. Appeals to the Board shall be in writing and shall be filed with the city clerk-treasuret. The city clerk -treasurer shall notify the appellant in writing at least five days prior to the date of the hearing before the Board. The appellant shall have the right to be represented at the hearing and to present evidence relevant to the matter at hand. Within 15 days of the close of the hearing, the Board shall make a determination regarding the matter and shall (nail a copy of its decision to the appellant. The Board shall also mail a copy of its decision to the city building inspector official and to the state building inspector. The state building inspector may affirm, reverse or condition the decision of the Board on -any matter. 805.097. Pemdts and Inspections. The issuance of permits, conduction of inspections and collection of fees shall be as provided for in Chapter 3_ of the 1.444Eigna-Roilliing-Cede SBC. 805.4409. Fee Schedule. Fees for plan checks and Abuilding Ppermits shall be as set forth in a resolution of the °city °council. 805.+3I I. Surcharge. In addition to the 8building permit fee, the applicant shall pay a surcharge in the amount fixed by blaw. The amount required by blaw shall be remitted to the state Abuilding flnspector SECTION II: This ordinance shall become effective upon Its adoption and publication.
