SPECIAL MEETING - MARCH 10, 2004
A Special Meeting of the Bal Harbour Village Council was held on Tuesday, March 30,
2004, in the Council Chambers, at Bal Harbour Village Hall, The meeting was called to
order at 10:03 a.m. by Mayor Tantleff. Those present were:

As a quorum was determined to be present, the meeting commenced.
4. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was not done.
3. DISCUSSION OF STIPULATION FOR SETTLEMENT - EDWARD
L_ Mr. Wolpin explained that there is a proposed settlement of Edward Law versus
Bal Harbour Village, the Americans with Disabilities Act (ADA) lawsuit that related to
access to the public beach, and particularly the parking lot improvements needed and a
couple of other improvements needed, pursuant to the Stipulation. He advised that the
Village Attorneys would recommend approval of this Stipulation. Mr. Wolpin reported that
the total attorney fees and costs, payable to the Plaintiff, has been reduced to $10,000.00
and the items that the Village has to do are spelled out in the Stipulation. He advised that
ample time is provided for performance of all the items that relate to future improvements
to be made to the parking lot, at the north area of the Village, and an access ramp that
exists, at the northern end of the beach area. Mr. Wolpin reported that a couple of
improvements that will be made include an ADA compliant handrail, along the last sloping
section of the ramp that leads from the parking lot to the public beach, at the north end of
the beach. He explained that the Village Attorneys feel that it's a reasonable settlement of
these disputed claims and that Village Attorney Ed Guedes has successfully negotiated the
settlement on terms, which protect the interests of the Village. Mr. Wolpin advised that they
would recommend approval of that settlement.
A motion was offered by Assistant Mayor Roth and seconded by Councilman Berlin to approve a
$10,000.00 settlement for the Edward Law versus Bal Harbour Village lawsuit. The motion
carried with the vote as follows: Mayor Tantleff aye; Assistant Mayor Roth aye; Councilman
Berlin aye; Councilman Gorson absent; Councilman Jacobi absent.

4. ADJOURNS There being no further business to come before the Council, a
motion was offered by Assistant Mayor Roth and seconded by Mayor Tantleff to adjourn. The
motion carried unanimously (3-0), with Councilman Gorson and Councilman Jacobi absent, and
the meeting adjourned at 10:06 a.m.
