The city council is concerned Ihnl Its officinl conhols relating to wetlands et other wnler resources mey not adequately reflect the contents of i comprehensive plan and luny be hmdequate in light of the amount end typ of development taking place within the. city. ' 1.05. Pursunnt to Minn. R. 8420.0240, the city is eutherizad to ndopt prncedu and standards providing protection to wetlands over the level established stale law. 1.06. The city is required to review and pursue consistency between 1 cemprehensive pints and Its official controls, Including flume controls relntit to wetlands and other water resources within the city, porenent to the 19 amendments to Minnesota Statutes, sectfone 473.85R, subd. 1 end 473.86 subd. 2. 1.07. The city council Is further concerned that Its ordinances pertehdng to the us of its roads may be Inadequate in light of the amount and types of developmen taking place within the community. -1,09. The city bee authority to regulate the use of roade within its jurisdiction pursuant to Minnesota Statutes, section 169.04.. -1.10. There exist a number of significant planning end Innd use issues pertalnin to the use of rends within the city's jurledictlon, inelnding the following: a. the effects of lerge-scale development projects on the ability o the roads to support heavy use by trucks or term+ equipment; b. the effects of large-scale development projects on the safety o roads In surrounding neighborhoods and the neighborhoods through which the attendant trucks and henvy equipment must travel; and c. the effects of such eustelned use on surrounding. property end natural resources. 1.11. Minnesota Statutes, section 462.355, .subd. 4 Mimes lho ehyto adopt. an nleerlm ord ni once for the purpose of protecting the pinnning process and the health, safety and welfare of Its citizens. 1.12. The city council desires to adopt an interim ordlnmwe thnt is betted enough to protect its planning process end the health, safety end welfnre of Its citizens while reviewing the above matters, but limited enough sn thnl npproprinte development may take place during the interim. Section 2. Findings 2.01. The city council finds that It Is necessnry to conduct shuliea to determine If there Is a. need,to emend the city's official controls or Ite comprehensive plen relating to wetlands and other water resources and use of roads, and if so, to adopt the eppruprinte amendments. 2.02. The city council finds that there Is a need to adept nn interim ordinance for the purpose of protecting the plenning,process end the henllh, enfely and welfare of Ile eltlzene regerdtng such metters. Sectlod 3. Definitions 3.01. Except as provided herein, allterms shall have the definitions given them by the Medina city code. 3.02. Excavation: The displacement or remove' of sediment, hydrlc or other soils, or other materiels by any method. 3.03. Sediment: Solid mineral or organic materiel tint Is In suspension, is being transported, or has been moved from its originel locetlon by alr, water, gravity, or Ice, and has been deposited at another locetlon. 3.04. Soli: The unconsolidated mineral and organic materiel on the immedinte surface of the earth that serves ns netnral medium for the growth of land plants. Section 4. Planning end Zoning Study; Moratorium. 4.01. A study is authorized to be conducted by city stnff and consultant q to determine whether the elly's officiel controls need to be reconciled with Its comprehensive plan. The city staff end consultants ere further authorized to ettidy how to appropriately regulete wetlands end other water resources and the use of roads within the city. The scope of the study should Include, but ' 1s not limited to, the following: a. coordination of city ordinances and plans with stale laws end plans, and regulations end plans of caller local Fined regtonnl governmental entities; b. the need for and the most approprinte terrine of prntrcting wetlands and other water resources; f 1 t d a e Y s 5 5 D +a Secal use en eurrounding property and naham' resources; end - e. the effects of large -settle development projecte nn the merely of rands in surrounding neighborhoods end the neighborhoods through which the ntlendenl equipment must travel. 1.02. IA. b. It shell be unlawful for any person to undertake, engnge In, or cause the removal of more then 10,000 ruble'viede of soil from any pelmet of lend. Section 5. Enforcement. 5.01. The city may enferee any provision of this ordlnence by mandamus, Injunction or any other appropriate civil remedy to any court of competent jurisdiction. Section 6. Separability. 6.01. Every section, provision or part of this ordinance, is declared separable from every other aection,'provlslon or pert of this ordinance. If nny section, provision, or part of this ordtnence is adjudged in be invalid by q court of competent jurisdiction, such judgment shall not love!Mete any other section, provision, or part of this ordinance. Section 7. Duration. 7.01. This ordinance shell remain In effect for one year -from its effective dale or until such time as said ordinance shall be revoked, extended or otherwlee emended. Section 8. Effective Date. • 8.01. This ordinance shall take effect the day after the date of its publicatlan. Adopted by the City Council of the City of Medina this 3rd day of October , 1995.
