PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Village resident Brian Mulheren 3. APPROVAL OF MIPILITES: A motion was offered by Assistant Mayor Roth and seconded by Councilman Berlin to approve the minutes of the March 16, 2004 Regular Meeting and March 30, 2004 Special Meeting. The motion carried unanimously (3-0), with Councilman Gorson and Councilina►i Jacobi absent, and the rnii:rttes were approved as submitted. 4. PRESENTATIONS: GENERAL EMPLOYEE OF THE MONTI." — MONICA ARNESON: Chief Hunker announced that Monica Arneson was selected as the "Employee of the Month" for 1vlarch 2004 for being the most vital member of his team in addition to all her duties, she Just completed a huge project of organizing the Annual Dade Chiefs Dinner Ms Arneson was presented with a plaque and a check with the thanks of the Mayor and Council OFFICER OF THE MONTH — DETECrIVE PAUL DEITADO: Captain Greg Roye announced that Detective Paul Deitado was selected as the "Officer of the Month" for March 2004 for courage and commitment in his undercover assignment which resulted in the seizure of $55,000 00 The successful conclusion of this investigation is a testament to Detective Deitado's abilities and professionalism Detective Deitado was presented with a plaque and a check with the thanks of the Mayor and Council 1 Councilman Berlin left the meetinu attei appiokal of tht. ►fit,ort Tat C ommittee Recommendations 2 Councilman Jacobi an ived Regular Council Meeting 04,20 2004 1 116 Chief Hunker presented Sergeant Charles Merrill with a framed article from the Miami Herald regarding his selection as Officer of the Year RECONIT1ON — BRIAN MULHEREN Chief Hunker explained that Village resident Brian Mulheren aided Officer Balikes in taking down a subject with two additional officers He presented Mr Mulheren with a plaque honoring his actions S. ORDINANCE FIRST READIN Mr Treppeda requested deferral of this ordinance for further review A motion was offered by Assistant Mayor Roth and seconded by Councilman Berlin to defer the following ordinance. AN ORDINANCE OF THE VILLAGE OF BAL HARBOUR CREATING SECTION 7.5 OF THE VILLAGE CODE ENTITLED "WIRELESS TELECOMMUNICATIONS TOWERS AND ANTENNAS"; PROVIDNG INTENT; PROVIDING FOR APPLICABILITY; PROVIDING DEFINITIONS; PROVIDING APPLICATION REQUIREMENTS; PROVIDING A REVIEW PROCESS; PROVIDING DEVELOPMENT STANDARDS; PROVIDING REMOV4L OF ABANDONED ATNE `NAS AND TOWERS; PROVIDING FOR PROTECTION OF THE VILLAGE AND RESIDENTS; PROVIDING FOR SECURITY FUND; PROVIDING PENALTIES; PROVIDING FOR SEVERABILITY, CONFLICTS, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE. 6. ORDINANCES SECOND READING/PUBLIC HEARIN None 7. LOBBYIST REISTRATIONS No New Registrations 6. REPORTS AND RECOMMENDAT1ONS2 A. MAYOR AND COUNCIL. Mayor Tantleff advised that he has been asked by several residents to look at where people live in the Village, in terms of districts changing and new buildings going up He reported that Mr Treppeda is putting together some information on that, which the Mayor will review Councilman Jacobi reported that Law Day is corning up at North Dade Justice Center on May 6th B VILLAGE ATTORNEY Mr Weiss stated that the Workers' Compensation Carrier, GRIT, failed and went into bankruptcy, so the Village ended up with another Workers' Compensation Carrier He advised the Council that they were able to recover $20,000 00 from the bankruptcy for the Village Regular Council Meeting 04 20, 2004 2 C VILLAGE MANAGER 117 Discussion of Biscayne Bav Societs Request for a Contribution: Mr Treppeda stated that the Biscayne Bay Society appeared before the Council at the last meeting and the Council deferred a decision on giving them a contribution until this meeting He advised that they have received the following funds so far FIU $25,000.00 (seed money to get started) Aventura $ 7,200.00 Sunny Isles Beach $ 5,000.00 Parkway Regional Medical Center S12,500.00 UBS Financial $ 2,500.00 Northern Trust $ 2,500.00 Mr Treppeda reported that this is a non-profit organization Assistant Mayor Roth confirmed that Mr Weiss mentioned that this is not considered charity, but is a non-profit organization and therefore, the Village would be allowed to make a contribution Mr Weiss agreed Councilman Jacobi questioned how the Biscayne Bay Society affects Bal Harbour They advised that Bal Harbour residents are solicited and are on the mailing lists and are encouraged to participate in all of the events He advised that most of the events are free Assistant Mayor Roth advised that he has received mail and they have some very interesting events Councilman Berlin stated that at the last meeting, Mayor Tantleff wanted to make sure that every resident in Bal Harbour is on the mailing list He questioned if this would be an annual contribution or a one-time contribution The representative from Biscayne Bay stated that it is a one year contribution and they would have to come back Councilman Berlin clarified that they will probably come back again yearly The representative from Biscayne Bay agreed Councilman Berlin questioned if the Village will have the ability to review the value of what it is getting The representative from Biscayne Bay responded yes Mayor Tantleff stated that the Village contributes to Bay Harbor Elementary, which is a program for the kids He stated that this is a program for the adults and from what the Council has heard, it's a great program, so he thinks that it's important that the Village support it A motion was offered by Assistant Mayor Roth and seconded by Councilman Berlins to contribute $5, 000. 00. Request for Approval of Funds for New Computer Server: Mr Treppeda explained that the computer server at Village Hall is five years old and is no longer keeping up with the needs of the Village because it's out of space and is very slow He advised that Professional Network Solutions has been with the Village for seven years Mr Treppeda stated a proposal was received from Professional Network Solutions to provide the Village with state of the art equipment, which would cover three years of support, as well as delivery, installation, transfer of data, and configuration of work stations Regular Comic 1l Meeting 04, 20 2004 3 118 He requested approval of $24,038 Assistant Mayor Roth questioned if the Village will get any trade-in on the old server Mr Treppeda responded no, but it can be donated He advised that the proposal received from Professional Network Solution was compared to the Dell State of Florida bid A motion was offered by Assistant Mayor Roth and seconded bp Councilman Jacobi to approve $24,038.00 to purchase a iiew computer server per the proposal received roni Professional Network Solutions. The motion carried with the vote as follows: Mayor Tantleff `aye; Assistant Mayor Roth aye; Councilman Berlin aye; Councilman Corson absent; Councilman Jacobi aye. Recommendation of Appointment of Joni D. Blachar, Esq. As Special Master: Mr Treppeda advised that the Village Code authorizes the Village Manager to appoint Special Masters as he deems necessary He explained that Darcee Siegel currently serves as a Special Master, but due to an Attorney General Opinion, she will not be able to serve two cities at the same time (she also serves as a Special Master at Sunny Isles Beach) Mr Treppeda recommended the appointment of Joni Blachar, who has been in the community for a number of years and is an attorney He requested that the Council ratify his appointment Dina Cellini, resident — 211 Bal Cross Drive, stated that Mrs Blachar would be the Village's only Special Master and she foresees occasions when she might have to recuse herself in certain circumstances, so she would therefore suggest that the Village take some sort of affirmative action to find other special masters, in the event that would happen She stated that in doing so, she would also recommend that the Council look at the individual's legal experience and seek someone who, as the Code points out, has outstanding, professional ability and perhaps look at the Martin Dale Hubble, which is the preeminent legal rating system for lawyers in this Country and find some lawyers who are rated in there, preferably AV rated Mr Treppeda advised that since Mrs Blachar will be the only Special Master, he plans on getting some more He stated that the Village is looking for some more, if anyone knows any attorneys Mr Treppeda stated that the pay is $100 per hearings) date Babak Raheb, resident — 128 Balfour Drive, stated that his concern is a conflict of interest issue He stated that the majority of complaints will be coming from the gated community and the person residing there may have a conflict in essence to neighbors she may like or dislike, etc Mr Raheb thinks that what he has read as far as experience, Mrs Blachar has not practiced law since 1997 and it's his opinion that she doesn't have the judicial temperance (9133) to handle positions that might have a conflict He also sees conflict with the Bal Harbour Civic Association regarding her involvement in the election He suggests looking outside to avoid conflict Gabriella Webster, resident — 30 Park Drive, thinks that as Mrs Blachar has been a member of the community for quite a while, she has an objective disposition Counting ballots for the Civic Association doesn t necessarily influence her one way or the other She would like to see Mrs Blachar get started on the right foot by having everyone support her A Assistant Mayor Roth added that Joni would make decisions for the whole village not just the Security District Mr Treppeda stated that she wouldn't have a problem hearing cases Regular Council Meeting 04 20 2004 4 from anywhere in the entire city Mrs Blanchar wanted it on record that she just purchased a condo at Lanai Condo on Collins Avenue and now is a property owner outside the Security District and will be fair She is also flattered that Mr Treppeda recommended her for the appointment A motion was offered by 4ssistaiit Mayor Rotli and seconded by Coiincilinaii Jacobi to ratify the Village Manager's appointment of Joni Blachar, Esq. as a Special Master for Bal Harbour Village. WCI Request to Erect Decorative Fence Wraps Around the Perimeter of the Construction Site and Banners on a Limited Number of Street Light Poles: Mr Michael Patrizia, the Project Manager for WCI's One Bal Harbour with Steve Sorenson is requesting two separate approvals for temporary fence construction and one for graphics on the fencing along Collins Avenue to promote One Bal Harbour and Bal Harbour itself This would enclosed the site so construction, dust will not be seen and to appease his neighbors to the South —Harbour House South — as they have concerns about dust and have requested a barrier The graphics image,presented reflect a lifestyle of Bal Harbour and are tastefully done The fence and graphics would wrap around the entire perimeter of the project site The structure of the fence will be subject to approval of the building department and the graphics would be added on to the fence Brian Mulheren, resident -- Carlton Terrace, stated he thinks it's a great idea because living next to the Bellini is a disgrace The Bellini site is not maintained The fences are mismatched and dust, paint and concrete comes into his property He commends WCI for their diligence in maintaining their site and thinks the graphics fence is a great idea Mr Patrizia stated that the second item is the requirement to have a five star hotel as a part of the development agreement for One Bal Harbour He is currently in negotiations with a hotel but can't announce it yet because they have signed a confidentiality agreement but will announce it when he is legally permitted to At that time he would like to place graphic banners along all Collins Avenue light posts to announce this hotel operator and promoting Bal Harbour The layout was presented showing the hotel and the Bal Harbour promotion The council would like the Resort Tax Committee to discuss this before it comes to the Council Babak Raheb, resident — 128 Balfour Drive, stated that he is concerned that the hotel agreement should be updated to include penalties/fines for WCI not securing a Five Star hotel using Michelin as a guide to the rating He thinks the contract should have more "bite" to protect residents The council approved the temporary fencing and graphics around the One Bal Harbour project as follows A motion was offered by Coiliiciliilaii Jacobi and seconded by Assistant i1!ai'or Roth to approve the temporary fence and graphics . The motion carried with the vote as follows: Mayor Tantleff aye; Assistant Mayor Roth aye; Coitiicilitiaii Berlin aye; Coitiiciliiiaii Gorsoii absent; Councilman Jacobi at,e. 119 Regular Council Meeting 04,20 2004 5 I ? 0 Request for Approval of Funds for Landscaping Maintenance: Mr Treppeda stated that he and Mr Robert Wheldon, Director of Public Works, would like to contract Luke's Landscaping for removal and trimming of trees Dina Cellini, resident — 211 Bal Cross Drive, wants to know why we're contracting outside for landscaping and thinks maybe the city should hire more Public Works people Mr Wheidon said it takes twelve weeks to get this work done with three employees and a truck being tied up Assistant Mayor Roth said it would be cheaper to pay the outside contractor than to hire someone as the cost of his salary, insurance, worker's comp etc would cost the city more The following proposals were received Luke's Landscaping Landcare Tree Experts of Florida, Inc. $25,020.00 $30,516.00 A motion was offered by Assistant Mayor Roth and seconded by Councilman Jacobi to approve $25,020.00 for Luke's Landscaping to remove dates in April, remove coconuts in May & August, and trim black olive trees in May & August. The notion carried with the vote as follows: Mayor Tantleff aye; Assistant Mayor Roth aye; Councilman Berlin aye; Councilman Gorsoii absent; Councilman Jacobi aye. Request for Approval to Paint Bus Shelters, Benches, and Trash Receptacles Throughout Bal Harbour Village: Mr Treppeda explained that he has had complaints regarding the appearance of the Bus Shelters, Benches and Trash Receptacles and is asking for approval of funds for this project He recommends Ed French whom has been used in the past and submitted the lowest estimate The following proposals were received Ed French Painting Jomac of Miami, Inc. Painting & Services Unlimited $18,500.00 $23,065.00 $23,300.00 A notion was offered by Assistant Mayor Roth and seconded by Councilman Jacobi to approve $18,500.00 for Ed French Painting to paint the bus shelters, benches, and trash receptacles throughout the Village (funds will cone from the % cent transportation tax for the bras shelters and from the general fund for the items located on the beach). The motion carried with the vote as follows: Mayor Tatitlef f' aye; Assistant Mayor Roth aye; Councilman Berlin aye; Councilman Corson absent; Councilman Jacobi aye. Request for Approval for Amendment to Franchise Agreement between Bal Harbour Villaje and Surfside: Mr Treppeda reported that Surfside has a problem with the larger sewer pump size setting a higher pressure load They will not consider our changes In order to keep the project moving, our engineer feels that it's okay to accept Surfside's changes He would recommend approval of these changes because Surfside has threatened an injunction against the Village to stop the project Mr Weiss suggested another attorney review the agreement to avoid the appearance of conflict as his firm has done some work for Surfside He suggested Andy Morotis to review the Regular Council Meeting 04,20 2004 6 agreement to insure the city is protected 121 A motion was offered by Assistant Mayor Roth and seconded by Coiiiiciliiia,i Jacobi to have another attorney review the franchise agreement . The motion carried with the vote as Follows: Mayor Tantleff aye; Assistant Mayor Roth aye; Councilman Berlin aye; Councilman Gorsoii absent; Coiiizcilntait Jacobi aye. Mayor Tantleff called for a recess at 9 50 a m and the meeting was reconvened at 9 58 a m The clerk called the roll Councilman Berlin and Councilman Gorson were absent Request for Approval of Forfeiture Expenditures: Mr Treppeda explained the Chief Hunker is requesting approval of forfeiture funds for the following items Taser X26 Weapons (12 units @ $1,250 per unit) $15,000.00 Department Web Site $ 5,000.00 Laser Speed Measurement Devices (3 units @ $3,810 per unit) $11,430.00 Computer Server (for Police Department) $27,000.00 TOTAL: $58,430.00 A motion was offered by Assistant Mayor Roth and seconded by Councilman Jacobi to approve $58,430.00 in Forfeiture Expenditures for the above listed items. Extension and Expansion of Take Home Vehicle Program: Chief Hunker is pleased with the program for Supervisors and would like to extend it to all officers for a three year test period A motion was offered by Assistant Mayor Roth and seconded by Councilman Jacobi to approve the extension and expansion of Take Home Vehicle Program. The motion carried with the vote as follows: Mayor Tantleff aye; Assistant Mayor Roth aye; Councilman Berlin aye; Councilman Gorsoii absent; Councilman Jacobi aye. Resort Tax Committee Recommendations: Mr Treppeda reviewed the following items that were recommended for approval by the Resort Tax Committee, at their meeting on April 15, 2004 1) Sales Calls & Media Blitz During POW -WOW 2004 Trade Show in Los Angeles $ 3,000.00 (Week of April 24) (Co-partner NN ith the GMCVB — Costs for ( atenntz .end (rift During Sales Calls) 1OTAL: $ 3,000.00 A motion was offered by Assistant Wayor Roth and seconded by Cotiiiciliiiaii Jacobi to approve S3,000.00 in resort tax funds, for the above listed iteiii. The motion carried with the vote as follows: Mayor Tantleff aye; Assistant Mayor Roth aye; Coiliicilitiaii Berlin aye.j Coiiiicilnraii Gorson aye; Councilman Jacobi absent: Request for Approval of Agreement with Kent Security: Mr Treppeda explained that the contract between Kent Security and the Village had recently Regular Council \leeting 04/20'2004 7 122 expired and we now need a new agreement Kent came in the middle with their bid. The Civic Association President is in favor of remaining with Kent Kent has not had problems since they upgraded their computers, software and personnel Babek Raheb, resident — 128 Balfour Drive, stated that when this matter came up in September 2002 the Association could not make a decision They asked the Police Department to help and still couldn't make a decision and wound up turning it back to the city He feels the Civic Association is not qualified to make this decision Pat Tumpson, resident —10185 Collins Avenue, stated that Kent has served in her area for twenty years and she was very pleased with their service and would recommend them to the council Dina Cellini, resident — 211 Bal Cross Drive, wants to know why the Village doesn't get bids for security companies for the security district She is afraid of favoritism and want the Village to try to save the resident's money by getting more bids Sandra Dunn, resident — 208 Park Drive, apologized for burdening the Council with this issue She asked Chief Hunker to do a survey as no one had any expertise in this area She recommends that Kent Security continue as they have improved their service and know the community and it's needs Doug Rudolph, resident — 212 Bal Bay Drive, feels that the Civic Association made the right decision in turning security over to the Council and the City He backs whatever decision is made by Mr Treppeda and the Council Brian Mulheren, resident — Carlton Terrace, is very pleased with the Council and the number of bids received He said to let the government and police department do their jobs Richard Weiss, Village Attorney, stated that there are no competitive bid requirements within the Village code except for things required to be bid by state law The Council can instruct the Manager to get bids but he doesn't have to He can just make a recommendation Chief Hunker, spoke to the Civic Association and Council He talked to each of the Security Companies and said the prices are around one to two percent difference His concern is service He felt Wackenhut would give a little better service It would cost a lot more if the Police Department were to do Security He feels Kent provides adequate service for the needs of the community and is doing a good job He agrees with the Manager on his recommendation of Kent The following price comparisons were received Bal Harbour Village Wackenhut Kent Security Y 50 State Security Elite Guard $215,514.05 per year $187,941.69 per year $162,275.20 per year $145,854.00 per year S144,436.00 per year A motion was offered by -lssistaiit Mayor Roth and seconded by Councilman Jacobi to approve Regular Council Meeting 04 20 2004 8 the agreement with Kent Security . Request for Additional Funds for Guardhouse Maintenance and Repairs: Mr Treppeda stated that in October 2003, approval was given for $10,000 00 for Maintenance and Repairs but it did not include the gates and fence and the gate at the 96th Street entrance The additional $1500 00 is from Security District Funds As soon as a contractor is selected, we can move ahead with the project A motion was offered by Assistant Mayor Roth and seconded by Mayor Tantleff to approve $1,500.00 in Security District funds to conduct repairs and maintenance of the guard house and gates/fences. The motion carried with the vote as follows: Mayor Tantleff aye; Assistant Mayor Roth aye; Councilman Berlin absent; Councilman Gorson absent; Councilman Jacobi aye. Resolutions: A resolution was read by title, by the Village Clerk, transferring designated and undesignated funds within the general fund budget for the Fiscal Year 2003-2004 A motion was offered by Councilman Jacobi and seconded by Assistant Mayor Roth to adopt Resolution 1Vo. 658 . The motion carried with the vote as follows: Mayor Tantleff aye; Assistant Mayor Roth aye; Councilman Berlin absent; Councilman Gorson absent; Couitcilnian Jacobi aye. Thus becoming: RESOLUTON NO. 658 A RESOLUTION OF BAL HARBOUR, FLORIDA, TRANSFERRING DESIGNATED FUNDS, UNDESIGNATED FUNDS WITHIN THE GENERAL FUND FOR THE FISCAL YEAR 2003/2004. A resolution was read by title, by the Village Clerk, authorizing the Chief of Police to enter into a Memorandum of Understanding with other Law Enforcement Agencies A motion was offered by Assistant Mayor Roth and seconded by Mayor Tantleff to adopt Resolution No. 659 . The notion carried with the vote as follows: Mayor Tantleff aye; Assistant Mayor Roth aye; Councilman Berlin absent; Councilman Gorsoii absent; Councilman Jacobi aye. The motion carried with the vote as follows: Mayor Tantleff aye; Assistant Mayor Roth aye; Councilman Berlin absent; Councilman Gorson absent; Councilman Jacobi aye. Thus becoming: RESOLUTION NO. 660 A RESOLt TION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA, REVISING THE SPECIAL ASSESSMENT FORMULA TO BE UTILIZED FOR THE SECURITY PROGRAM FOR THE RESIDENTIAL SECTION OF BAL HARBOUR (THE "SECURITY AREA") AS PROVIDED BY RESOLUTION NO. 645, BY REVISING THE ASSESSMENT UPON EACH UNIT OF APARTMENT BUILDINGS (COOPERATIVES, CONDOMINIUMS, ETC.); PROVIDING FOR UTILIZATION OF SUCH NEW SPECIAL ASSESSMENT FORMULA FOR ASSESSMENTS THAT SHALL BE APPLICABLE TO THE FISCAL YEAR COMMENCING OCTOBER 1, 2004 AND THEREAFTER; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR EFFECTIVE DATE. 10. OTHER BUSINESS Babek Raheb, resident, 128 Balfour Drive —asked where is the $550,000 00 letter of credit from WCI7 Mr Treppeda stated that the letter is currently being held in a vault at Sun Trust Bank. 11. ADJOURNS There being no further business to come before the Council, a motion was offered by Assistant Mayor Roth and seconded by Councilman Jacobi to adjourn.
